1
Robbery with Violence Against or Intimidation of Persons
People v. Daguman, G.R. No. 219116, August 26, 2020

On August 16, 2022 at around 7:45 in the morning, Crisostomo, store manager of Starbox Cafe
in Iriga City, opened the store and went straight to the back office to count the money in the
vault. Fidel, the store’s security guard, arrived next and was placing his things inside when
Damaso entered and poked a knife at him declaring hold-up. Fidel raised his hands and Damaso
took Fidel’s gun in his holster. Damaso passed the gun to his companion, Clara. Damaso and
Clara forced Fidel to walk inside the office with Clara pointing a gun behind him. When the
robbers saw Crisostomo counting the money, Damaso again declared hold-up. Fidel and
Crisostomo were told to lie down; they were tied and blindfolded. Thereafter, the two (2) robbers
took the money and left. Incidentally, SPO2 Bernardo and two (2) other police officers namely,
PO3 Basilio and PO3 Crispin were patrolling the road when they chanced upon two (2)
individuals hurriedly leaving Starbox Cafe. The first individual was Clara who was wearing blue
maong pants and white T-Shirt, wearing a black cap and holding in her hand a firearm. She was
followed by Damaso who wore a black jacket in yellow shirt and maong shorts, carrying a black
bag. When the police team saw that Clara was armed, they alighted from the vehicle and
introduced themselves as officers. Clara however responded by firing her gun at the officers. The
officers fired back killing Clara. When Damaso tried to pull something out from the bag, the
officers subdued him. The officers recovered from Damaso the following: (1) a kitchen knife
measuring 12 inches long; and (2) a black bag containing a homemade .38 caliber revolver, color
nickel, with five (5) live ammunitions and undetermined cash in different peso denominations.
The police officers eventually released Fidel and Crisostomo from being hogtied, took off their
blindfolds, and brought them to the police station.

SCENARIO NO. 2
Kidnapping for Ransom with Homicide
People v. Dionaldo, G.R. No. 207949, July 23, 2014

At around 8:00 in the morning of May 16, 2023, Pedro Cruz dropped his brother Carlo Santos
off at Workout World Gym in Naga City. Thirty minutes later, three (3) men, identified as
Armando, Renato, and Mariano, forcibly dragged a bloodied Carlo down the stairway of the gym
and pushed him inside a green Toyota car with plate number THV 1230. Pedro then received a
text message that Carlo had been kidnapped and that the latter will be killed if the matter is
reported to the police. The kidnappers also demanded the payment of ransom money in the
amount of ₱15,000,000.00. Pedro told them he had no such money, as he only had ₱50,000.00.
After negotiations over the phone, the kidnappers agreed to release Carlo in exchange for the
amount of ₱100,000.00. Pedro was instructed to bring the money to Plaza Rizal in Iriga City.
Upon arrival, an orange Mitsubishi car with plate number PJM 013 pulled up in front of his
vehicle where four (4) men alighted. Pedro saw one of the men take a mobile phone and upon
uttering the word "alat," the men returned to their car and drove away. Rudolph, an employee at
Workout World Gym, confessed that he was part of the plan to kidnap Carlo, as in fact he was
the one who tipped off Mariano, Renato, and Armando on the condition that he will be given a
share in the ransom money. On June 13, 2023, the dead body of Carlo was found at Barangay
San Agustin, Iriga City.
Judgment of Acquittal

Scenario No. 1
KIDNAPPING AND SERIOUS ILLEGAL DETENTION
People v. Carreon, G.R. No. 229086, January 15, 2020

Moira Dela Turri, seventeen (17) years old, became sweethearts with Jason Hernando, twenty-
one (21) years old. On September 1, 2022, at around 7:00 in the evening, Jason was supposed to
walk Moira home after a date but instead brought her to the house of his cousin, Morissete, in
Sta. Cruz, Ligao City. After staying for about three (3) hours, Moira asked Jason to take her
home but the latter refused. She could not go home on her own because she did not have money
and did not know how to get home from there. They stayed in Morisette's house for three (3)
days. She cried a lot during that time but Jason did not do anything. She had a cellphone but sold
it to buy medicine for her leg that got swollen after getting hit by a motorcycle. Her parents were
able to contact her when she still had her cellphone but she could not respond because she had no
money to buy phone credits. Jason later on brought her to the house of another cousin, Yeng, also
in Ligao City. There, Moira met Jason's father, Erik, who informed her that her father had filed a
case against his son and that she should not leave Ligao City. Jason made her stay in Yeng’s
house for seven (7) more days. Fortunately, the police arrived and took her into custody and
brought her to the Martyr Nievera Hospital in Ligao City. She was then eventually reunited with
her parents.

Scenario No. 2
ROBBERY WITH HOMICIDE
People v. Canlas, et al., G.R. No. 141633, December 14, 2001

On June 13, 2022, at around 2:00 in the afternoon, Paul Macartne, Ringo Estar, and Juan
Lennon, all vendors, went to San Isidro, Santa Magdalena, Sorsogon to sell clothes. Ringo and
Paul were called by customers, while Juan continued walking and entered a small alley to look
for other customers. After Paul finished attending to his buyer, he followed Juan at the alley but
failed to find him. Paul then asked Ringo to help him look for Juan. They searched the whole
alley, but to no avail. At the time he disappeared, Juan was wearing a white Hanes t-shirt, maong
short pants, blue sandals, a cap with "Bench" marking and a red towel. Paul and Ringo went to
the town market to continue selling their goods and returned to San Isidro an hour later where
they continued looking for Juan until 8:00 in the evening. Thereafter, they went home to Irosin,
Sorsogon.

Upon learning that Juan had not yet gone home, Paul and Ringo sought the help of the police.
They went back to San Isidro, Santa Magdalena where they searched the whole barangay for
hours. At around 6:00 in the morning the following day, the lifeless body of Juan was found in a
creek. Traces of blood were seen at the place where the body was found and on the leaves of the
plants which lead to an open nipa hut in the backyard of George Haresun. The police entered the
hut and found underneath a bamboo bed a bag containing assorted clothes identified as the ones
Juan were selling, some of which were soaked in blood. They likewise found a blue cap with
"Bench" markings, a red towel wet with blood, a bed sheet with blood stains, blue sandals, and a
hunting knife inside one of the drawers. George told the police that the hut is occupied by Danny,
his grandson, and that the bag which was recovered belongs to the latter.
