A. TORT LAW

1 Answer the questions:

Tort law is a type of civil law. It aims to remedy the situation of a person who has suffered
a loss or harm due to the actions of another. It remedies the situation by means of
compensation or damages. It has not basis in a previously established contract . Tort law
requires those who are found to be at fault for harming others to compensate the victims.

Tortious liability is the legal responsability that arises from committting a totious or
wrongful act, has nothing to do with contracts.

Contractual liability is the legal responsability that arises from breach in contract, or not
following the terms and conditions.

The difference between them is the nature of duty. The duties in the torts are fixed by the
law where the duties in the contracts are fixed by the contractual parties. Therefore, there
is more structured and stricter in tortious liability than in contrac- tual liability.. Answer
