AN ORDINANCE PRESCRIBING RULES AND REGULATION ON THE LIVELIHOOD AREA

LOCATED IN-FRONT OF THE MULTIPURPOSE HALL OF BARANGAY WEST CRAME, SAN
JUAN CITY AND FOR OTHER PURPOSES.

WHEREAS, under the Republic Act 7160, otherwise known as the Local Government
Code of 1991, where Sangguniang Barangay has powers and duties to enact revenue
ordinances and regulate the use of facilities constructed with government funds and
change reasonable fees for the use thereof;

WHEREAS, the Sangguniang Barangay deems it necessary to enact this ordinance

which prescribes Rules and Regulations and fees/charges of the Livelihood Area at Multi-
Purpose Hall Road 7, Barangay West Crame, City of San Juan;

WHEREAS, to maximize the barangay facilities, the Barangay Council unanimously

agreed to set up a space for affected micro business from the Road Clearing Operation to
avoid further obstructions on streets/roads/alleys of the barangay;

NOW, THEREFORE, BE IT ORDAINED AS IT IS HEREBY ORDAINED, by the Sangguniang

Barangay of West Crame, City of San Juan by the virtue of powers vested in it by law, in
session assembled, that:

SECTION 1. TITLE – This Ordinance shall be known as “AN ORDINANCE PRESCRIBING RULES
AND REGULATION ON THE LIVELIHOOD AREA LOCATED IN-FRONT OF THE MULTIPURPOSE HALL
OF BARANGAY WEST CRAME, SAN JUAN CITY AND FOR OTHER PURPOSES”.

SECTION 2. DEFINITION OF TERMS. The following terms used in the ordinance shall mean:

a. Fee as used in this ordinance construed to mean, a charge fixed by the Sangguniang
Barangay through this Ordinance for the use of Livelihood Area.
b. Permit means the written authorization issued by the Punong Barangay to a person
for the use of the space in the livelihood area. Said the authorization is subject to the
terms and conditions specified in the permit as well as all applicable laws, city
ordinance and issuances.

 c. Littering refers to the throwing, scattering of garbage / trash within and around the
premises of the Barangay West Crame.
d. Vandalism this refers to the destruction or spoiling of structures including the
markings of the benches, stage, walls and other area of the barangay
establishment

SECTION 3. SECURING PERMITS. Permits may be granted to a person by the Punong

Barangay upon proper applications and approval thereof. The permittee shall file its written
application to the Punong Barangay who shall verify the application if granted.

SECTION 4. IN-CHARGE OF COLLECTION. The Barangay Treasurer or authorized

representative is hereby empowered to collect every week, and shall be recorded on a
separate ledger.

SECTION 8. RENTAL RATES. The following shall be the rates imposed for the use of Barangay
West Crame Livelihood Area:

Fee and Time of operation:

6:00 AM – 11:00 PM Php 100.00 / day

Inclusion: Table, Monoblock Chair 1 pc

SECTION 9. LIMITATION. The use of Barangay West Crame Livelihood Area shall be limited
exclusively for the purpose of business applied. Only the designated slot should be
occupied by the business owner. Dry goods are only allowed at the Livelihood Area;

SECTION 10. PERSON LIABLE. In case of untoward incidents during the said use resulting to
damage of any of the facilities and other properties of the Barangay West Crame Wooden
Basketball Court, the permittee shall be charge and accordingly pay for such damage. The
Barangay West Crame shall be free from any third party claim, in case of any untoward
incidents resulting to injury to the person or damage to the property of performers,
participants and spectators, which claim or liability if any shall be the sole responsibility of
the permittee.

SECTION 11. RESTRICTIONS AND PROHIBITED ACT. The following shall be the restrictions and
prohibitions:
a. Littering and Vandalism
b. Vendors shall occupy only the designated area specified
c. Drinking of intoxicating liquor is prohibited within the premise

SECTION 12. PENALTIES. The penalties shall be imposed on violators of this Ordinance;

First Offense Warning for disciplinary action

Second Offense suspension of permit
Third Offence and Subsequent Offenses 1 year banned with a fine of Php 500.00

SECTION 14. REPEALING CLAUSE. All Barangay ordinances to or inconsistent with this
Ordinance are hereby repealed or modified accordingly.

SECTION 15. SEPARABILITY CLAUSE. If any part or provision of this Ordinance is declared
unconstitutional or invalid, the same shall not affect the validity and affectivity of the other
parts or provision hereof.

 SECTION 16. EFFECTIVITY. The Ordinance shall take effect upon approval of the
Sangguniang Panglungsod.
