APPOINTMENT (DESIGNATION) AS COVID-19 COMPLIANCE OFFICER IN TERMS


OF REGULATION 46 (1) ISSUED IN TERMS OF SECTION 27(2) OF THE DISASTER
MANAGEMENT ACT, NO. 57 OF 2002

In terms of Section 27(2) of the Disaster Management Act, No. 57 of 2002 (“the Act”)
Regulation 46 (1), Company Name is required to appoint (designate) a COVID-19
Compliance Officer.

You are hereby designated as the COVID-19 Compliance Officer in terms of DMA
Regulation 46(1), for (company name) from 20/1/2022 until such time as the “state of
disaster” that has been declared in terms of Section 27(1) of the Disaster Management
Act, is lifted / revoked, or this appointment is superseded or cancelled.

In your capacity as the appointed COVID-19 Compliance Officer, you are required to
develop and implement a plan as referred to in Regulation 46 (1) (b) of the Act. This
plan must, as a minimum contain measures to ensure that the workplace meets the
standards of COVID-19 health protocols, adequate space for employees and social
distancing measures for employees, the public and service providers, as required. You
are required to oversee the implementation of the said plan and ensure strict adherence
to the standards of hygiene and health protocols relating to COVID-19 prevention at the
workplace. You are to retain a copy of the plan for inspection, which plan must also
contain the details of the COVID -19 Compliance Officer.

In accordance with your appointment as the COVID-19 Compliance Officer, you are
required to:
a) Where employees that are tasked to work from home or at risk employees
who have been prohibited from returning to work are called back to work,
develop the Return to Work Plan which must comply with Annexure E to the
DMA Regulation, and contain the relevant information, namely (a) which
employees are permitted to work, (b) what the plans for the phased in return
of employees to the workplace are, (c) what health protocols are in place to
protect employees from COVID-19, and (d) the details of the COVID-19
Compliance Officer;
b) Assist with the implementation of the Return to Work Plan.

In your capacity as the Compliance Employee, in terms of DMA Regulation 79 (1) you
are required to ensure (a) compliance with the measures provided for in the DMA
Regulation, and (b) that all directions in respect of hygiene conditions and limitations of
exposure to persons with COVID-19 are adhered to.
