DEED OF CONDITIONAL DONATION

KNOW ALL MEN BY THESE PRESENTS:

This DEED OF DONATION is made and entered into this _______________,

by and between:

Spouses PETER DELA CRUZ SALVATIERRA &

ROSALINDA TELAN SALVATIERRA, both of legal age, Filipinos,
and residents of 599-E Meman Street, Zone 7, Atulayan Norte
Tuguegarao City (hereinafter referred to as the “DONORS”);

- and -

DARYLL TELAN SALVATIERRA & KEVIN RAY TELAN

SALVATIERRA, both of legal age, Filipinos, and with postal
address at and 2A-1360 Instruccion Street Sampaloc, Manila
respectively. (hereinafter referred to as the “DONEES”);

WITNESSETH:

WHEREAS, the DONORS wish to donate their property to DONEES who

are their legitimate and natural children.

WHEREAS, the DONORS are the owner in fee simple of a certain

parcel of land situated at Brgy. Atulayan Norte, covered by Transfer
Certificate of Title No. T-161835 of the Register of Deeds of Tuguegarao City,
and more particularly described as follows:

A parcel of land L6845-C-1 of the subd. plan

Psd(sf)02-047446 being A portion of Lot No. 6845-, Psd-2-01-
017079, situated in the Bario of Atulayan, City of Tuguegarao,
Prov. of Cagayan, island of Luzon. Bounded on the SW.
alongline1-2 by Lot 6844, Cad-151, on the NW. along line 2-3by
Lot 6845-B, Psd-2-01-017978, on the NE. along line 3-4 by Road
and on the SE. along line 4-1 by Lot 6845-C-2, of the subd. Plan.
Beginning at a pt. marked “1”on plan being S. 81 deg. 11E.,
810.82 m. from BBM No. 12, Cad-151, thence N. 13 deg. 33’W.,
11.06 m. to pt. 2; N. 79 deg. 37’E., 22.85 m. to pt. 3; 8.12 deg.
22’E., 10.95 m. to pt 4; S. 79 deg. 23’W., 22.63 m. to pt. 1; pt. of
beginning containing an area of TWO HUNDRED FIFTY (250) sq.
m. more or less. –xxx-

Copy of Transfer Certificate of Title No. T-161835 is attached hereto as

Annex “A” and made an integral part hereof.

NOW, THEREFORE, for and in consideration of the foregoing and the

terms and conditions hereinafter set forth, the Parties hereby agree, as they
have agreed, as follows:
 1. That for and in consideration of the love and affection which the
DONEES inspires in the DONORS, and as an act of liberality and
generosity, the DONORS hereby voluntarily and freely give, transfer
and convey, by way of donation, unto said DONEES, their heirs,
executors and assigns, all of the right, title and interest which said
DONORS have in the above-described real property, together with all
the buildings and improvements found therein, free from all liens and
encumbrances and charges of whatsoever nature;

2. That the DONORS hereby states, for the purpose of giving full effect
and validity to this donation, that they had reserved to themselves
sufficient properties, in full ownership or in usufruct, which are
necessary and adequate for their support in consonance with their
standing in society;

3. That the DONORS further states, for the same purpose as expressed
in the next preceding paragraph, that this donation is not made with
the object of defrauding his creditors, having reserved to himself
property sufficient to answer for his debts contracted prior to this date;

4. That as a condition of this donation, DONOR Peter Dela Cruz

Salvatierra be allowed to live within the premises of the subject
property and make use of all household items and utilities available
thereto until the time he wishes to move out or for as long as he lives;

5. That the DONEES hereby accept and receive this gift and donation
made in their favor by the DONORS, and they hereby expresses their
appreciation and gratefulness for the kindness and generosity of the
DONORS.

the date and at the place above written.

The foregoing instrument is a Deed of Donation and consists of three

(3) pages, including the page on which the acknowledgment is written, and

witnesses.
