EXECUTIVE ORDER NO. 63, SERIES OF 2023


“UPDATING THE COMPOSITION OF THE
CITY INTER-AGENCY COMMITTEE (CIAC) ON INFORMAL SETTLERS
IN THE CITY OF BALANGA”

WHEREAS, Article XIII, Section 9, of the 1987 Philippine Constitution mandates the State
to “undertake, in cooperation with the private sector, a continuing program of urban land
reform and housing which shall make at affordable cost decent housing and basic services to
underprivileged and homeless citizens in urban and resettlement areas”;

WHEREAS, Section 29 of Republic Act (RA) No. 7279, otherwise known as the “Urban
Development and Housing Act of 1992,” also provides that “local government units (LGUs shall
“implement the relocation and resettlement of persons living in danger areas”; and, in
coordination with the National Housing Authority (NHA), “shall provide relocation or
resettlement sites with basic services and facilities and access to employment and livelihood
opportunities sufficient to meet the basic needs of the affected families”, among others;

WHEREAS, the magnitude of the problem and the government’s limited resources
dictate that priority should be given to the great number of informal settlers affected by
government priority infrastructure projects and those living in, near or along danger areas such
as esteros, railroad tracks, roadways, garbage dumps, riverbanks, shorelines, waterways, and in
other public places as sidewalks, roads, parks, bridges and playgrounds;

WHEREAS, it is imperative that the nefarious and illegal activities of professional


squatters and squatting syndicates are effectively curtailed to ensure that only qualified and
deserving informal settlers are benefited by the government’s housing programs;

WHEREAS, in order to adopt an effective identification and registration process in


determining the rightful and qualified beneficiaries of the government’s housing programs as
against professional squatters and squatting syndicates, the City Government created the
City Inter Agency Committee on Informal Settlers (CIAC) through E.O. No. 11, Series of 2018;

WHEREAS, due to the need to include other government agencies crucial to the
mandate of the committee, there is now a need to update its composition;

NOW THEREFORE, I, FRANCIS ANTHONY S. GARCIA, by virtue of the powers vested


upon me by law as the Chief Executive of the City of Balanga, do hereby update the
composition of the City Inter Agency Committee on Informal Settlers (CIAC) in Balanga City.

SECTION I
COMPOSITION

That the committee should be known as the City Inter Agency Committee (CIAC) on
Informal Settlers, to be composed of the following, to wit :

The CIAC shall invite the Commission on Human Rights (CHR) and other socio-civic
organizations and associations to become members of the Committee.

The sub-committees composition of the Local Housing Management Committee


(LHMC) of the City of Balanga, pursuant to Executive Order No. 67, Series of 2020, shall also
serve as the sub-committees composition of the CIAC.

SECTION II
ASSISTANCE FROM GOVERNMENT AGENCIES,
DEPARTMENTS OR OFFICES

The CIAC may call upon any agency of the government, departments or offices for
assistance and cooperation, including, but not limited to, seeking the necessary technical
services and support to the implementation of a Local Shelter Program (LSP), such as the
provision of basic community facilities, including logistics and the conduct of continuing training
and development with emphasis on livelihood and educational programs in collaboration with
the private sector, religious organizations and participating NGOs.

SECTION III
LEAD DEPARTMENTS/OFFICES

The City Administrator’s Office, City Engineer’s Office (CEO), City Planning &
Development Office (CPDO) and City Assessor’s Office shall be the lead agencies in the
implementation of the LSP for informal settlers within the City of Balanga, such as those
affected by government infrastructure projects, and those living in, near or along danger areas
such as riverbanks, esteros, roadways, sidewalks, aqueducts, bridges, railroad tracks, garbage
dumps, shorelines and waterways.

SECTION IV
FUNCTIONS OF THE CIAC

The City Inter-Agency Committee on Informal Settlers in the City of Balanga shall plan,
coordinate and implement, in coordination with concerned government agencies, a
comprehensive shelter program for informal settlers affected by government priority
infrastructure projects and those living in danger areas within the city’s territorial jurisdiction. It
shall have the following major functions:

a. Develop a LSP for qualified informal settlers affected by government priority


infrastructure projects and those living in danger areas;
b. Provide policy directions and guidelines for the smooth and effective implementation
of the LSP;
c. Seek funds and logistical support and resources from participating agencies and
other concerned entities and the private sector for the effective and efficient
implementation of the LSP;
d. Enter into a memorandum of agreement or other local institutional arrangement
with and among concerned national and local government agencies, nongovernment
organizations and private entities for the speedy implementation of the LSP;
e. Exercise oversight functions on the implementation of the specific components of the
LSP; and
f. Perform such other functions as may be assigned by the LCE.

SECTION V
IMPLEMENTING RULES AND REGULATIONS

The CIAC shall promulgate its Implementing Rules and Regulations to implement the LSP
as well as provisions of this Executive Order.

SECTION VI
FUNDING

The City Government of Balanga shall set up funds in accordance with law, subject to
accounting and auditing rules and regulations, to expedite the implementation of the LSP as
well as the other housing strategies and policies developed by the CIAC.

SECTION VII
SEPARABILITY CLAUSE

If, for any reason, any portion of this Order is declared unconstitutional or invalid, the
same shall not affect the validity of the other provisions not affected thereby.

SECTION VIII
REPEALING CLAUSE

All orders, rules, regulations and issuances or parts thereof, which shall be found
contrary to or inconsistent with the provisions of this Order are hereby amended, repealed or
modified accordingly.

SECTION IX
EFFECTIVITY

This Executive Order shall take effect immediately upon approval and shall remain valid
and effective, unless sooner revoked, amended or terminated.
