Guarantee /Warranty: The supply shall be covered by the maker's standard guarantee as follows: The supplier shall warrant that the equipment supplied under the contract / supply order (a) is new, unused and of current design not likely to be discontinued or become obsolete til the life of the offered equipment. (b) isin accordance with the contract specifications. {c) shall have no defects arising out of design, materials or workmanship. Materials supplied should be guaranteed for a period of 12(twelve) months from the date of installation and commissioning or 18 months from the date of receipt and acceptance at consignee end, whichever is earlier. In the event of any defects in materials, design and workmanship during the aforesaid period is found due to faulty design or poor workmanship, the defective part or parts will be replaced by the supplier at site free of cost within 30 days of settlement of warranty claims. The bidder will be required to stock spare parts to take care of warranty failures. Spares should be available within 2 weeks of the breakdown being intimated to them. ‘The guarantee/composite warranty shall be submitted along with the bill, The warranty shall cover for the total equipment so that the necessity of having to approach different manufacturers of various components/assemblies does not arise and all services under warranty clause shall be the responsibility of the ultimate supplier of the composite equipment. You will also replace the defective parts, if any, during the warranty period free of cost. The responsibility to collect the defective / rejected material will lie with the supplier and the cost for such collection will have to be borne by the supplier. 13. Price Certificate: You should submit a certificate along with bill as stated below: “The rates of the stores under this contract are the lowest at which we are selling to any other customer/Gowt Deptt,/ Subsidiaries of CIL/ Other PSUs. If the materials are sold at any lower rate than that mentioned in this. contract to any other agency, the same will automatically be applied to this contract from that date”, 14. Security Deposit: You are required to deposit 10 % of value of the contract (contract value means FOR destination price including taxes, duties, transportation & insurance charges & other charges if any) ie. TYPE AND RATING: 4.1The transformer shall be of two winding, 3 phase oil immersed core type with ONAN/ONAF cooling suitable for outdoor service as step-down transformer. GENERAL DESIGN OF TRANSFORMER: 5.1 The transformer and accessories shall be so designed as to facilitate inspection, cleaning and repairs. The requirement of CEA Regulations 2010 shall be kept in view. 5.2 The design shall ensure satisfactory operation under severe working conditions due to Auctuating load of ‘mines and voltage variations in the system including those, due to short circuits. The transformers shall be designed 85 to minimize the risk of accidental short circuits caused by animals, birds or vermin. ‘The design shall incorporate every reasonable precaution and provision forthe safety of all those concemed in the operation and maintenance of the equipment. '5.3 All material used shall be of the best quality and of class most suitable for working under specified conditions and shall withstand the atmospheric conditions and temperature variations without undue deterioration or distortion or setting up of undue stress in any part thereof. ‘5.4 Cast iron shall not be used for any parts other than the radiator valve bodies, '5.5__ Corresponding parts lable to replace shall be interchangeable. '5.6__ All taper pins to be used in the mechanism shall be split types as per latest edition of 1S:2393, ‘5.7 All mechanism should be rust and corrosion proof. '5.15 The interior of mechanism chambers and Kiosks shall be given 3 coats of paint, the Final coat being oF aight coloured anti-condensation mixture. 5.16 LOCKING OF OUTER RADIAL SPACERS : ‘The outer most radial spacers of the winding shall be locked in position by means of vertical strips so thatthe same can not fll off/got displaced. 5.17 TIGHTENING OF THE NUTS OF THE COIL CLAMPING BOLTS: ‘The proper & complete tightening of the nuts of the coil clamping bolts must be ensured by the manufacturers. LIMIT OF TEMPERATURE RISE: 7.1 With the above climatie conditions given in clause-3 each transformer shall be capable of operating continuously on any tap at their normal rating without exceeding the following temperature (j)__45 deg C in oil by thermometer 355 deg C in winding by resistance ii) Winding Gradient ie the difference between average winding average oil temperature not to exesed 13 degC. (iv) Temperature of hot spot in windings not to exceed 95 deg C when calculated over max annual weighted average temperature of 40 deg C. "72 The limits of temperature rise mentioned above will have 1o be satisfied by the manufacturer by carrying out the hheat run test atthe lowest negative tap. This test shall be carried out by feeding 1.1 times the total losses at 75 deg C at highest current tap. 7.3. OVERLOAD CAPACITY & CONTINOUS RATING: ‘The safe overload capacity of the transformer and the duration of overload under maximum temperature conditions without any damage to the winding or harmful effects on the insulation shall be clearly stated in the tender which must be as per IEC-60076, guide for loading of oil immersed transformer. 8. IMPEDANCE: 4.2.7 Percentage impedance with respect to rated current and frequency at 75 degree celsius . : Percentage Impedance shall be 11% with variation of (+)5% and (-)0% at 20 MVA base and 1 KV secondary Voltage. 9. FREQUENCY: ‘The transformer shall be suitable for continuous operation with a+5% frequency variation from a normal of 50 HZ without exceeding the temperature rise as specified in clause-7.1 above. 10.0 FLUX DENSITY, CORE CONSTRUCTION AND INSPECTION: 10.1 The transformer should be so designed that the working flux density should not exceed 1.57 Tesla at normal voltage, frequency. 10.2 Tenders with higher fx density than specified limit shall not be considered. 103 The core shall be built up with thin laminations of high grade. non-ageing, low loss, high permeability cold rolled super grain oriented silicon steel known as MOH High B Grade or superior grade CRGO steels of maximam 0.27 mm or low lamination thickness especially suitable for transformer core. 10.4{a) Bidder should have in house core cutting facility for proper monitoring & control on quality and also to avoid any possibility of mixing of prime material with defective/second grade material. The purchaser may witness the core-cutting operation. Incase the in house core eutting facility for core cutting isnot available then the same shall be carried out in the presence of the representative of BCCL. 10.4(b) After being sheared, the laminations shall be treated to remove all burrs. They shall be coaied with a baked enamel insulation coating. The insulation shall be inert to the action of hot transformer oil and shall be perfectly adhesive. Paper and varnish insulation shall not be accepted. Particulars of proposed insulation shal be stated in the tender. Laminations shall be checked for burrs during stage inspection. T0.5 The core shall be rigidly clamped and/or bolted to ensure adequate mechanical strength and to prevent vibrations during operation, The bolts used in the assembly of the core shall be suitably insulated and the clamping | structure shall be constructed that the eddy currents will be minimum. } 10.6 Construction ofthe core shall be such that number of steps inthe limb and yoke shall be matching and dimensionally identical to minimize the effect of cross fluxing and better mechanical strength. 10.7 Thecore shall be provided with Lugs suitable for lifting the complete core and coll assembly of transformer. The Core & coil shall be fixed inthe tank such that its shifting will not occur when the transformer in | moved or when a short circuit occurs. aoe Page 10 of 30 Supply Order No. BCCL/Pur/215212/Power Transformer/OTE/20-21/62 Date: 20-10-2020 108 ‘The design of magnetic circuit shall be such as to avoid static discharge development of short cireuit paths within itself orto the earthing clamping structure and the production of flux component at right angle tothe plane of the lamination which may cause local heating. 10.9 Every care shal be exercised inthe selection treatment and handling of core steel to ensure thatthe laminations are flat and that finally assembled core is free from distortions. 10.10 The supporting frame work of the core shall be so designed as to avoid the presence of pockets which ‘would prevent complete emptying ofthe tank through the drain valve or cause trapping of air during filling. 10-11 Oil ducts where necessary should be formed across the plane ofthe lamination and be given suitable slope to assist oil circulation. The overall design of core and winding should be such that free flow of ol is not obstructed. 10.12 The frame work and clamping arrangement shall be earthed by connecting to the tank body through a ‘copper strip. Yoke bolt area should be compensated if bolts are used for fastening of the core. 10.13 The insulation of core to bolts and core to clamp plates shall be able to withstand a voltage of 2 KV RMS for one minute. 10-14 Core and windings shall be capable of withstanding shocks during transport, installation, service and adequate provision shall be made to prevent movement of core and winding relative to tank during these conditions. 10.15 All steel sections used for supporting the core shall be thoroughly sand blasted after cutting drilling and welding. 10.16 All the CRGO vendors having BIS certification and approval from PGCIL, shall be considered. 10:17 The tenderers should indicate the maximum flux density allowable continuously as well as for time intervals of | minute and 5 secs. and the limit of flux density at which core material used by them saturates. 10.18 The name of the core material must be mentioned in the tender. The successful tenderer shall be required to furnish magnetization curves of the core material/design calculations and such other data/documents deemed fit by the Purchaser for being satisfied that flux density is as desired. 10.19 Purchaser shall inspect the built-up core for verification of flux density for which all facilities shall be provided. The purchaser shall inspecttest the core material for various tests as per relevant IEC/IS to ensure quality. Core may also be inspected during horizontal assembly, built-up assembly. ‘NOTES 4). ‘The above flux density has been specified to meet with the over fluxing of the core due to temporary over voltage of the order of 31% for | min, 44%6for 5 sec. that may appear abnormal conditions such as those following sudden loss of large loads. ii) Yoke bolt area and flitch plate areas shall not be counted in the net core area if these are provided for fastening core. iii)_The design of limb and yoke shall be so co-ordinate that there is no cross fluxing atthe joints iv) __ The tenderer shall ensure that the CRGO supplier should have BIS certification. Ii. SUPPRESSION OF HARMONICS: ‘The transformer shall be so designed as to suppress the harmonics voltage specially the 3rd & Sth, to eliminate -wave form distortion and interference with communication circuits due to high frequency disturbances. Limiting ‘of harmonics at normal voltage and at maximum system voltage shall be stated in the tender. 12. WINDING: 12.1 The conductor for winding shall be of electrolytic grade copper. The winding shall be so designed that all coil assemblies of identical voltage ratings shall be interchangeable and field repairs can be readily done, without special equipment. The coils shall be supported between adjacent sections by insulating spacers and the barriers, bracings and other insulation used in the assembly ofthe windings shall be arranged to ensure a free circulation of the oil and to reduce hot spots in the windings. The insulation paper shall be of high quality and the value of degree ‘of polymerization shall not be less than 1200 PV and the necessary test certificate shall be submitted along with the stage inspection report. Provision shall be made in the tank, for taking sample, in future, of paper for testing purpose and location shall be easily accessible and indieated on the transformer tank by affixing special caution plate, 12.2 All winding shall be fully insulated . No graded insolation shall be accepted . Use of enamel as a sole conductor insulation is prohibited 12.3. The transformer shall be capable of operation without danger on any particular tapping atthe rated KVA Page 11.0f 30” when the voltage may vary by +10% of the voltage corresponding to the tapping. : 2 Deore Supply Order No.: BCCL/Pur/215212/Power Transformer/OTE/20-21/62 Date: 20-10-2020 124 The windings and connections, insulation material shall not soften, ooze out, shrink or collapse during service. 12.5 The insulation ofthe coils shal be such as to develop the full electrical strength ofthe windings. All materials used inthe insulation and assembly of the windings shal be insoluble, non-cataytic and chemically inactive in the hot transformer oil and shall not soften or otherwise be adversely affected under the operating conditions. 126 Alll threaded connections shall be provided with locking facilities. All leads from the winding to the terminal board and bushings shall be rigidly supported to prevent injury from vibration. Guide tubes shall be used where practicable. 12.7 The windings shall be clamped securely in place so that they will not be displaced or deformed during short circuits. The assembled core and windings shall be vacuum dried and suitably impregnated before removal from the ‘treating tank. The copper conductors used in the coil structure shall be best suited to the requirements and all ‘permanent current carrying joins in the windings and the locks shall be welded or brazed. 12.8 Windings shall be subjected to a shrinkage treatment before final assembly, o that no further shrinkage ‘occurs during service. Adjustable device shall be provided for taking up any possible shrinkage of coils in service if 12.9. The conductor shall be ransposed at sufficient intervals in order to minimize eddy currents and equalize the distribution of currents and temperature along the windings. 12.10 The tapping winding shall be provided separately from main winding to minimize the out of balance forces in the transformer at all voltage ratios. 12.11 Transformer shall be designed and constructed to withstand, without damage, the thermal effects on external short circuits (SC) for 3 seconds under conditions specified in IS: 2026 (Part-I, amended up to date). 12.12 Bidder shall invariably indicate in the GTP, the cross sectional area ofall windings with respect to the ccurrent density adopted. 12.13 Bidder shall have to submit the calculations for thermal & dynamic ability to withstand short circu 12.14 Cooling calculations shall be submitted with technical bid. 12.15 Insulation materials: * Class “A” insulating materials specified in IS 1271 or latest version shall be used . Wood insulation , where used , shall be well seasoned and treated . 13. CURRENT DENSITY: The employer shall be at liberty to inspect built-up winding for its quality, weight of copper, insulation and overall ‘weight of coil assembly. The size of conductor used for different windings shall also be checked during stage . Thertransformer shall be so designed that the current density at any tap 250A/em.sq.in HV & regulating winding and 200A/em.sa.in LV winding. 14.1 TANKS: 14.1.1 Tanks shall be of welded construction and fabricated from boiler steel plates of adequate thickness . The weld procedure and performance shall be in line with ASME BPV ~IX. 14.1.2 Alll seams and joints those are not required to be opened at site shall be factory welded and wherever possible shall be double welded. 14.1.3 Tanks stiffeners shall be provided for general rigidity and these shall be designed to prevent retention of water. 14.1.4 The tanks shall be designed to withstand — Mechanical shocks during transportation , Vacuum filling of oil & short circuit force 14.1.5 The transformer tank and iis accessories shall be designed without pockets wherein gas may collect. 14.1.6 Adequate space shall be provided atthe bottom of the tank for settlement of sediments - 14.1.7 Suitable guides shall be provided in the tank for positioning the core & coil assembly. 14.1.8 The tanks shall be suitable for movement in both direction during shipment & each tanks shall be provided with Lifting lugs suitable for lifting the complete transformer and a minimum of four jacking pads. 14.19 The tank shall be ftted with outside access ladder, inet & outlet valve, oil sampling valve with suitable adopter oil drainage valve, air vent etc. 14.1.10 Suitable lifting lugs for lifting the transformer filled with oil shall be provided on the tank. 14.1 11 Four jacking lugs shall be provided to enable the transformer complete with ol to be lifted or lowered by means of jac. The tank cover shall be sloped to prevent retention of rain water and shall not distort when lifted . 14.2.2 At least two adequately sized inspection covers one at each end of the tank shall be provided for easy access to bushing and earth connection . The inspection covers shall have suitable lifting arrangement - 14.2.3. The thermometer pocket shall be fitted witha captive screwed top to prevent ingress of water It shall be possible to remove these bulbs without lowering the oil inthe tank. 14.2.4 Bushing , turrets , inspection covers , thermometers pockets ete shall be designed to prevent ingress Of ‘water in to or leakage of oil from the tank. 142.5 All bolted connections shall be fitted with weather proof hot oil resistant neoprene gasket in between Tor complete oil tightness . If gasket is compressible metallic stop shall be provided to prevent over compression . 143 CONSERVATOR TANK, OIL GAUGE AND BREATHER: 14.3.1. An adequate conservator tank of air cell ype complete with sump and drain valves shall be provided in such _a position as not to obstruct the electrical connections to the transformer. 143.2 The conservator tank shall have adequate capacity to accommodate oil preservation system and volumelric ‘expansion of the total cold oil volumetric expansion of the total cold oil volume in transformer and radiators for a change in temperature from minimum ambient air temperature of S*C to 110°C. 14.3.3 The conservator shall be bolted into position so that it can be removed for cleaning purpose. 14.3.4 The conservator tank , shall be fitted witha silica gel filter breather. 14.3.5 The oil level at 30°C shall be marked on the gauge. 14.3.6 Ifthe sump is formed by extending the feed pipe inside the conservator, this extension shall Be atleast 25mm. 14.3.7 The oll connections from the transformer tank to the conservator shall be at rising angle of 3 to 9 degrees to the horizontal upto Buchholz relay. The inside diameter ofthe pipe shall be 80 mm. The Buchholz relay will have suitable valves on its both sie so as to facilitate its testing a site as well as cut off oil supply to the transformer. 14.3.8 The conservator shall be provided with oil preservation system, which should be suitable either to remove ‘moisture continuously from air entering the air space with which they are connected or may not allow direct contact ‘of atmospheric air with oil during operation, in addition to silica gel breather. 144 VALVES: 144.1 The transformers shall be provided with 2 No. filter valve each of 50 mm size one mounted close to the top ‘of the main tank & the other close to bottom of the tank oil circulation and one drain valve of 80mm size with plug. ‘The conservator shall have drain plug of 25mm size. 1442 Two robust sampling valves with spouts suitable Tor taking samples of top, and bottom oil ‘The top sampling valves shall be brought down by internal pipe connections. Suitable name plates shal be affixed 1 the sampling valves. The sampling device shall not be fitted on the filter valve. 14.4.3 Two air release plug of 15mm shall be provided. 14.4.4 Plugs shall be supplied forall valves opening to atmosphere. 14.45 All valves shall be of gun metal and comply with the latest edition of IS: 3639. 14.5 PRESSURE RELIEF DEVICES: A suitable pressure relief device of 6" diameter shall be provided on the main tank and of 3" diameter shall be provided on OLTC for rapid release of any pressure in transformer, which may endanger the equipment. The ‘device (3) shall operate at static pressure less than hydraulic test pressure for transformer tank of OLTC chamber. If ‘the device is mounted on tank cover, it shall be fitted with a skirt projecting 25mm inside the tank and of such construction as to avoid gas accumulation. In addition to pressure relief device(s) the provision of explosion vent should also be made and the diaphragm shall ‘be situated above max. oil level or second PRD on the opposite side of the first PRD be provided. 146 EARTHING TERMINALS: ‘Two earthing pads suitable for connecting SOxfmm mild stel flat shall be provided at positions close to the two diagonally opposite bottom comers of tank. These grounding terminals shall be suitable for bolted connection. Suitably painted wire mesh guards with mesh not greater than 25mm shall be provided to _prevent accidental contact with the blades 153 MOTORS: 15.3.1 The motor shall be squirrel cage totally enclosed weather proof type suitable for direct starting and for continuous running from 415-240 volts, three phase/single phase 50 CIS supply. ‘The motors shall comply with IS as applicable for continuous rated machine. 15.3.2 All motors shall be capable of continuous operation at Requency SOHEz with variation of £5 % and 415240 V-AC 10% variation ofthe normal voltage without injurious over heating. 15.3.3 All motors shall have ball or roller bearing with hexagonal nipples for greasing, In case of vertical spindle, motor shall have bearing capable of withstanding thrust, due to weight of the moving parts. 15.3.4 Vamished cambric or glass insulator shall be used for connections from stator winding to the terminal suitable for external wiring, The motor terminals shall be of stud type and totally enclosed. 154 COOLER CONTROL: 15.4.1 Each motor or group of motors shall be provided with a 3 pole electrically operated contactor with control gear for motor operation by hand and automatically through winding temperature indicator. Provision shall be made for over load protection but no volt release shall not be provided. 15.42 All connection shall be so arranged as to allow either individual or collective operation of the motors, Alarm indication (audio and visual) for failure of fans and to indicate failure of power supply shall be provided. 15.43 The control equipment shall be installed in the marshalling box as specified in CI.21 in readily accessible position. 15.44 The alarm indication for failure of power supply and failure of individual fans be provided through independent non trip alarm scheme conforming to the following:- {) The closing of an initiating contact shall actuate a buzzer and will be accompanied by a flag indication on the concemed auxiliary relay. ii) The closing of an initiating contact shall glow a lamp, which will not reset unt the Fault has cleared iit) It shall be possible to silence the buzzer by pressing ‘Accept push button. PARALLEL OPERATION: 17.1 In addition to individual control of tap changer, provision shall be made to enable parallel operation of the ‘ap changer when one unit is running in parallel with another similar unit of same rating. 17.2 Suitable selector switch and controls shall be provided so that any transformer of the group can at a time be selected as master, follower or independent. Arrangement shall be made that only one of the transformers can be selected as master ata time. 17.3 Anout of step device shall be provided for each transformer indicating out of step condition by an indicating lamp and buzzer. It shall be arranged to prevent further tap changing when transformers in @ group ‘operating in parallel control are one tap out of step. 18. TEMPERATURE INDICATING DEVICES: 19.1 The transformer shall be provided with a 150 mm dial type thermometer for top oil temperature indication . ‘The thermometer shall have adjustable, potential fre alarm and trip contacts, maximum reading pointer and ‘resetting device and shall be mounted in the marshalling box .A temperature sensing element located in a pocket in the top oil shall be furnished. This shall be connected to the OT! by means of capacity tubing. Accuracy class of ‘OTI shall be 2° C or better. GAS AND OIL ACTUATED RELAYS: 20.1 The transformer shall be provided with a gas and oil actuated relay fitted with alarm and trip contacts for ‘ain tank & oil surge relay for its OL as per IS:3637. 202 Each such relay shall be provided witha test cock to take a flexible connection for checking relay ‘operation. 203 A machined surface shall be provided on top of relay for checking mounting angles in the pipe cross level ofrrelay and its setting. ‘The pipe work shall be such as to allow any gas formed in the tank to pass through the relay. The oil circuit through the relay shall not form a parallel delivery path with any circulating oil pipe, nor shall it be tied into or ‘connected through the pressure relief vent. Adequate clearance between oil pipe work and live metal parts shall be provided. 21, MARSHALLING BO? 21.1 A sheet steel (of 10 SWG size) vermin proof well ventilated and weather proof marshalling box of suitable construction shall be provided forthe transformer auxiliary apparatus. The box shall have domed or sloping roofs. ‘Ventilation louvers, suitably padded with felt, shall also be provided. It shall be painted as per C1.5.14. 21.2 The marshalling box shall accommodate temperature indicators. Local electrical control of tap changer (if ‘same cannot be housed in motor drive housing.), Control & protection equipment for cooling plant, terminal boards and gland plates for cable etc. The equipment shall be mounted on panels and panels wiring shall be done at the back_for interconnections. 21.3 The temperature indicators shall be mounted at about 1600mm from ground level. 21.4 A metal clad heater with thermostat, controlled by a waterproof rotary switch on the outside of the box, shall be provided. 21.5 The incoming cables shall enter from the bottom with gland plate not less than 450mm from the base of the ‘box. The screens of screened pairs of mult core cables shal be earthed at one end ofthe cable only. 22.6 All terminal boards shall be of stud-ype & mounted obliquely towards the rear door and these boards shall be spaced not less than 100mm apart. Definition: In the interpretation of the Contract and the general and special conditions governing it unless the context otherwise requires: i. “Contract” means the invitation of tender, instructions to tenderers, acceptance of tender, particulars and the keneral and special conditions specified in the acceptance of tender and include a repeat order which has been accepted and acted upon by the supplier. ll, The term “SUPPLIER” shall mean the person, firm or company with whom the contract is placed and shall be deemed to include the supplier in successors (approved by the Purchaser) representatives, heirs, executors, administrators and permitted assignee as the case may be, ii. “CONTRACT PRICE’ shall mean the sum accepted or the sum calculated in accordance with the price and / or terms accepted by or on behalf of the purchaser. iv. (a) Parties ‘The Parties to the contract are the supplier and the purchaser named in the schedule or any other specifically mentioned in the contract. (b) Address to which communications are to be sent forall purposes of the contract, including arbitration there under, the address of the supplier mentioned in the tender shall be the address to which all communications addressed to the supplier shall be sent, unless the supplier has notified a change by a change by a separate letter containing no other communication and sent by registered post acknowledgement due to the head of the office placing the supply order. The supplier shall be solely responsible for the consequence of an omission to notify a change of address in the manner aforesaid. In case the terms and conditions of contract applicable to this invitation to tender are not acceptable to the tendering firms, they should clearly specify deviations there from in their tender. ix. Typed quotations should be submitted. Those containing erasures and over-writings are liable to be rejected. Any corrections made in the tenders must be initialed by the tenderers, falling which their tenders will not be considered. x. Provided nevertheless that any such consent shall not relieve the supplier from. any obligation, duty or responsibility under the contract. bb} Change in a Firm |. Where the supplier is a partnership firm, a new partner shall not be introduced in the firm except with the previous consent in writing of the purchaser (which may be granted only as an exception) of 2 written ‘undertaking by the new partner to perform the contract and accept as liabilities incurred by the firm under the contract prior to the date of such undertaking. ii, On the death or retirement of any partner of the supplier firm before complete performance of the contract. the purchaser may at his option cancel the contract in such case the supplier shall have no claim whatsoever for compensation against the purchase, it tf the contract is not determined as provided in the sub-clause 1.i above notwithstanding the retirement of a partner from the firm, he shall continue to be liable under the contract for acts of the firm until a copy of the public notice given by him under Section 32 of the Partnership Act has been sent by him to the purchaser by registered post acknowledgement due. 10. (a) Consequence of Breach: Should the supplier or a partner in the supplier firm commit breach of either of the conditions (a) or (b) ofthis sub-clause, it shall be lawful of the purchaser to cancel the contract and purchase. cr authorise the purchaser of the stores at the risk and cast of the supplier and in that event the provisions of clause 20 shall as far as applicable shall apply. (b) The decision of Coal India Ltd. and/or its subsidiary companies as to any matter or thing concerning or arising ‘out ofthis sub-clause or any question whether the supplier or any partner of the supplier firm has committed a breach of any of the conditions in this sub-clause contained shall be final and binding on the supplier. 11. Use of raw materials secured with Government assistance: ‘a. Where any raw material for the execution of the cantract is procured with the assistance of Clik and or its subsidiary companies by purchase or under arrangement made or permit, license, quota certificate or release order issued by or on behalf of or under authority or by any officer empowered in that behalf by law, oris issued from government stock and where advance payments are made to the supplier to enable him to purchase such raw materials for the execution of the contract, the supplier, | Shall hold such material as trustee of Coal India Limited and / or its subsidiary companies. 1, Shall use such material economically and solely for the purpose of the contract. Il Shall not dispose of the same without the previous permission in writing of the purchaser; and IV. Shall tender due account of such material and return to the purchaser at such place as the purchaser may direct all surplus or unserviceable material that may be left after the completion of the contract or its termination for any reason whatsoever. On returning sich material, the supplier shall be entitled to such price thereof as the purchaser may fix having regarding the condition of such material. 'b. Where the contract is terminated due to any default on the part of the supplier, the supplier shall pay all transport charges incurred for returning any material up to such destination as may be determined by Cll and / or its subsidiary companies whose decision shall be final «.
