Mobile Crane RENTAL AGREEMENT

Hereinafter called “THE FIRST PARTY”
And

M/S INTAJ LLC

Hereinafter called “THE SECOND PARTY”

Whereas; THE SECOND PARTY has agreed to hire 25 ton Truck crane from THE
FIRST PARTY with the following Terms & Conditions:

1. The monthly rental rate for 30 ton is OMR 2,000/- Two thousand Omani Rials, With
Operator for Working Hrs 300 Hrs / month – 10 hrs / day, The SECOND PARTY will be
responsible to pay the monthly rate whether or not the 300 Hrs/Month utilization is completed
(unless the crane is de-hired), provided the Crane is in working condition.

2. The Contract between two parties valid From 01st February 2023 to 31st January 2024
Second Party will provide LPO for the above mentioned period.

3. Fuel to crane, food and accommodation for operators will be provided by client.

4. Mobilization and Demobilization: will be provided by the client.

5. Extra hours worked (if any) to calculated on Prorate basis.

6. The minimum Rental period is 1 Year from the date the crane reach the project site. In case
of termination of this Agreement during this period by THE SECOND PARTY for any
reason, THE SECOND PARTY will be responsible for all outstanding Rental charges for
the remaining part of the minimum rental period.

7. At the end of the contract period, if the machine is not returned to the FIRST PARTY, the
contract shall be considered renewed automatically with the same terms and conditions until
the machine is De-hired and returned in good condition to the FIRST PARTY.

8. Payment terms 45 days from the date of invoice as per approved time sheet from project site.

9. THE FIRST PARTY undertakes to complete all Daily Maintenance during the Rental period
strictly in accordance with that detailed in the Manufacturer’s Operating & Maintenance
guide. THE FIRST PARTY is to carryout scheduled maintenance at 300-350 hours interval.

10. The machine will be operated by THE SECOND PARTY OPERATOR under the
supervision of THE SECOND PARTY and THE SECOND PARTY will be responsible for
any damages / accident to the crane caused by the operator or others, any claims, any liability

 caused by the use or misuse of the machine including but not limited to claims arising from
damage to utilities, water pipes, power cables and telephone lines…etc.

11. THE SECOND PARTY shall be responsible for any and all permissions, consents, licenses,
and security/safety clearances.

12. Insurance is limited to THE FIRST PARTY’s “3rd party fleet Insurance Policy” with New
India Assurance Company (Copy of Policy available upon request).

13. THE SECOND PARTY shall indemnify THE FIRST PARTY against and hold THE
FIRST PARTY free and harmless for injury, death and property damage, including but not
limited to all claims, actions, suits, proceedings, costs, expenses, damages and liabilities etc.
in case of accidents involving the machine.

14. The machine is to be used in Sultanate of Oman territory only, unless approved in writing by
THE FIRST PARTY.

15. Client shall not force to use the subject crane which has no possibility to execute the way not
abiding the rules of usage. Manufacturer’s manual is applicable for all site conditions as
weather, ground and wind etc..

16. The FIRST PARTY reserves the right to repossess the machine and terminate the agreement
with a written notice in advance, of not less than 1 Month, in case of any breach, such as
default or delay in payment, negligence, misuse, abuse or improper use of the hired machine
by THE SECOND PARTY. In such event, THE FIRST PARTY will not be liable towards
any third party due to the repossession of the equipment and THE SECOND PARTY will be
responsible for all outstanding rental charges till the end of the minimum rental period.
