Particular Conditions

Architecture :

1. TRK individual NOC for Facilities outside plot limits including landscape ,Road access ,parking ,etc  to be
obtained prior any construction outside plot limits whereas all facilities shall be accessible  as per (DBC)
Dubai Building Code; The consultant shall bear full responsibility to comply with Master developer and 
RTA Authority further implications changes may be required upon issuing RTA final NOC – [ To be
responded ]

Structure :

● This Building Permit is issued based on the submitted Contractor All Risk Insurance (CAR)

Policy No. P/01/4022/2023/648 for the period from: 21/06/2023 To 20/10/2024 + 12
MONTHS MAINTENANCE PERIOD Based on the consultant responsibility/liability letter dated
22/06/2023.
● The provided Contractor All Risk Insurance (CAR) policy is accepted based on the consultant
liability/responsibility letter with no liability/responsibility whatsoever, to the authority parts.
● Contractor All Risk Insurance (CAR) shall be included one-year maintenance period started
from the completion certificate issuance date for the Building permits and
alternations/additional works NOCs.

2. The Building Permit has been issued based on the consultant undertaking letter stating that the
consultant will bear full responsibility to comply with the DCD requirements and any implications
might be required by DCD authority.
3. DEWA as well as Telecommunication shall be obtained prior to commence any construction on
site. The consultant shall bear full responsibility to comply with related Authority requirements.
Consultant shall approach Trakhees -CED to remove this condition by BP amendment & BP
Revalidation if required.

Sustainability :

1. ADVISORY COMMENTS FOR EFFECTIVE ADMINISTRATION:


Provide a comprehensive project specific “Green briefing / training” to the site team for

proper site compliance.
Please ensure adequate controls for proper implementation of green building requirements

in all phases including procurement, commissioning and -handing over.-
Any green building issues / challenges that may potentially impact the original commitments

made shall be brought to Trakhees attention for necessary advice and clearance. Request for
waivers at BCC stage will not be entertained.
You are advised to look into Circulars and guidelines available in our portal for additional

information.
 
General Conditions
1. Revalidation is required if the construction activities (permitted via this BP) does not
commence within nine (9) months from the date of issuance of this permit. In addition,
Revalidation of the building permit can be carried out up to three times for a period of 6
months.
2. The above mentioned project should be built /constructed as per the approved drawings &
Calculations including U –value that issued with this permit, Construction Safety, Trakhees
regulations & Local authorities regulations.
3. The consultant is solely responsible for carrying out full coordination between Architectural,
Structural, HVAC and EHS drawings to ensure that there is no conflict between all the
construction details related to different activities.

4. It is your responsibility to achieve the thermal values (U ) stipulated by EHS as part of Green
building compliance. In case of conflict with other values, the more stringent of the two
would prevail.
5. The consultant and the contractors shall fully abide by the advisory comments made by the
Green Building department as part of its conditional approval. Failure to do this would be
deemed as non-compliance.
6. Projects pursuing the EHS Green Building Certification should complete certification
payment and get the project registered prior to making NOC-BCC submissions
7. The consultant shall ensure that all necessary construction N.O.C's from services authorities
(DEWA, Etisalat/DU/Empower etc.) have been obtained prior any construction
commencement on site.
8. Excavation construction shall not extend beyond the plot limits unless obtaining the
necessary approvals.
9. Consultant / Contractor shall be responsible for any damages to existing services within and
outside the plot limits during the construction period and shall inform (Trakhees – CED &
EHS) of any accidents or collapse during construction period.
10. Soil report measures and recommendations shall be strictly implemented.
11. All revised drawings shall be submitted to Trakhees-CED & EHS clearly highlighting the
revisions carried out for approval before commencement. Any modification / remedial
measure required for the structural system due to design changes, site related incidents
shall be reported to Trakhees CED & EHS immediately & revised drawings & calculations
shall be submitted for Trakhees-CED & EHS review / approval, prior for execution of related
works. Major Revisions may result in application for Building Permit amendment & master
developer approval.
12. The consultant shall apply and obtain contractor mobilization & signboard NOC from
Trakhees CED before carrying out any mobilization activity on the site.
13. As Built drawings shall incorporate all revisions undertaken during construction period &
should be submit Architectural As-Built Drawings in CAD format with DLTM coordinates &
showing Building Foot-print, Floor layout and Facility numbering. (P-Line) prior your
application for completion certificate.
14. Attention is drawn to all EHS Regulations in regard to requirements for establishment &
operations in areas under the PCFC jurisdiction.
15. All Comments should be addressed prior to applying for BCC.
16. Facilities under Construction should not be used by client/End-user for storage/operations
until BCC is obtained.
17. Trakhees demarcation certificate for (Building/Infrastructure/Marine works) to be obtained
prior to any construction activity. Consultant/Contractor can refer Client Procedure (CED-
CP-025 Planning-Demarcation) on Trakhees CED website for related information.
18. The project consultant/contractor should obtain Completion Certificate & refund the
deposit when the all construction work completed in the project.

19. The consultant and the contractor(s) shall remain entirely responsible for the design,
accuracy of drawings and execution of the project, as well as the stability and safety of
construction during the progression of works and following its completion. Trakhees-CED &
EHS NOCs and structural inspection approvals shall not be constructed to impose legal
liability or responsibility upon Trakhees for errors, omissions, accident relating to design,
Construction, installation & operation of facility, machine, equipment, system that are
directly or indirectly associated with the subject/project of the submission.
20. Zero-setback between adjacent buildings/plots is not accepted & a seismic gap shall be left
between adjacent structures to account for the lateral movement due to seismic loads. The
gap values are estimated for the entire plot by the project consultant according to relevant
international and local standards and reflected in the submitted drawings in addition to all
architectural technical & Aesthetic treatments to be considered to cover seismic gaps.

impose any legal responsibility or liability on the authority. The consultant and the contractor shall
remain entirely responsible for design, execution of the works and for the stability and safety
during construction and after completion as per related rules.
