CONTRACT TO SELL

KNOW ALL MEN BY THESE PRESENTS:

This CONTRACT made and entered into this 17th day of August
2017 at Davao City Philippines, by and between:

ANASTACIA A. MARAMION, of legal age, widow and a


resident of Purok 4-B, Km. 7.5, Matina Pangi, Davao City, herein referred
to as the FIRST PARTY.
---- and ----
RONEL O. MAGBUTONG, of legal age, married, Filipino and a
resident of Barangay Matina Pangi, Davao City herein referred to as the
SECOND PARTY.

W I T N E S S E T H:
WHEREAS, the FIRST PARTY is the owner of a property located at Purok
4-B Barangay Matina Pangi, Talomo District Davao City containing an area of
ONE HUNDRED SQUARE METERS (100 sq. m.).

1. CONSIDERATION: That for and in consideration of the sum of Ninety


Thousand Pesos (P 90, 000.00) Philippine currency, which the SECOND
PARTY has bound herself to pay in the manner herein specified and in
compliance by the SECOND PARTY of the terms and conditions herein
enumerated, the FIRST PARTY has contracted to sell the said property of
land

2. MANNER OF PAYMENT: The SECOND PARTY hereby agrees to pay the


total contract price of Ninety Thousand Pesos only. (P 90, 000.00),
Philippine Currency, in a following terms and conditions to wit:

a. The amount of Twenty Thousand Pesos (Php. 20, 000.00)


representing Down Payment upon execution of this contract.

b. The balance of Seventy Thousand Pesos (P 70, 000.00) shall be


payable within twenty four (24) months on the following manner;

b.1. In equal, consecutive and successive months beg.


September 30, 2017 at Two Thousand Nine Hundred
Sixteen Pesos & 66/100 (P 2, 916.66) per month;

b.2. That if the Second Party failed to pay the monthly


obligation of Two Thousand Nine Hundred Sixteen Pesos
& 66/100 (P2, 916.66) in three (3) consecutive months the
amount paid by the latter as initial payment/down payment
shall be forfeited in favor of the first party.

3. POSSESION:

a. The SECOND PARTY shall be allowed introduce any structure


permanent or temporary inside the said lots despite the entire
obligation is not yet totally paid.
b. The SECOND PARTY is not allowed during the term of this contract
to cede or transfer, in any manner the lot to any third person
without permission of the FIRST PARTY;
c. Deed of Absolute Sale shall be executed upon payment of the entire
obligation and shall be facilitated by the FIRST PARTY.
d. The SECOND PARTY shall shoulder the expenses for the transfer
of the new title based on the appraisal/valuation of the total contract
price;
e. This contract shall be considered final and legal upon compliance
with all the requirements submitted by the SECOND PARTY and
after affixing their respective signatures of this deed and other
contract.

IN WITNESS WHEREOF, the parties hereunto set their hands this 17th
day May 2017 at Davao City Philippines.

same is their own free and voluntary acts and deeds.

the FIRST PARTY.

MARITES TADLIP, of legal age, married, Filipino and a
resident of Barangay Matina Pangi, Davao City herein referred to as the
SECOND PARTY.

W I T N E S S E T H:
WHEREAS, the FIRST PARTY is the owner of a property located at Purok
4-B Barangay Matina Pangi, Talomo District Davao City containing an area of
ONE HUNDRED SQUARE METERS (100 sq. m.).

4. CONSIDERATION: That for and in consideration of the sum of One


Hundred Twenty Thousand Pesos (P 120, 000.00) Philippine currency,
which the SECOND PARTY has bound herself to pay in the manner herein
specified and in compliance by the SECOND PARTY of the terms and
conditions herein enumerated, the FIRST PARTY has contracted to sell
the said property of land

5. MANNER OF PAYMENT: The SECOND PARTY hereby agrees to pay the


total contract price of One Hundred Twenty Thousand Pesos only. (P 90,
000.00), Philippine Currency, in a following terms and conditions to wit:

a. The amount of Thirty Thousand Pesos (Php. 30, 000.00)


representing Down Payment upon execution of this contract.

b. The balance of Ninety Thousand Pesos (P 90, 000.00) shall be


payable within twenty four (24) months on the following manner;

b.1. In equal, consecutive and successive months beg.


August 31, 2017 at Three Thousand Seven Hundred Fifty
Pesos (P 3, 750.00) per month;

b.2. That if the Second Party failed to pay the monthly


obligation of Three Thousand Seven Hundred Fifty Pesos
(P3, 750.00) in three (3) consecutive months the amount
paid by the latter as initial payment/down payment shall be
forfeited in favor of the first party.

6. POSSESION:

c. The SECOND PARTY shall be allowed introduce any structure


permanent or temporary inside the said lots despite the entire
obligation is not yet totally paid.
