COMES NOW Plaintiff, David L. Archie, who through counsel, files this Petition
for Judicial Review of his contest of the Election of Anthony "Tony" Smith, unlawfully
returned as the Democratic Nominee for Hinds County, Mississippi Supervisor District 2.
For the reasons set out below, there is more than a preponderance of evidence to support a
finding that actions by the Hinds County Democratic Executive Committee, its officers and
agents, during the August 8, 2023, Democratic Primary constitute serious departure from
statutory compliance as to destroy the integrity of the election and make the will of the
qualified electors impossible to ascertain, and in support hereof would show unto the Court

2. On August 8, 2023, the Plaintiff faced Anthony "Tony" Smith in the Democratic Party
Primary Runoff Election for the office of Hinds County, Mississippi Supervisor District 2. The
primary runoff election was conducted by the Hinds County Democratic Executive Committee.
3. On Monday, August 28, 2023, the Plaintiff in accordance with Miss. Code Ann §23-
15-921, timely filed his petition with the Hinds County Democratic Executive Committee
contesting the nomination of Mr. Smith as the Democratic nominee for Supervisor District 2.
A copy of the August 28, 2023, contest petition and amendment are attached as Exhibit A.
4. The Hinds County Democratic Executive Committee did not promptly meet to address
the Plaintiffs complaint, and the Plaintiff does not have complete knowledge to the extent to
which members of the executive committee investigated the grounds upon which the Plaintiff

5. In accordance with Miss Code Ann. §23-15-927, the Plaintiff timely brings this sworn
petition for judicial review in the Circuit Court for the First Judicial District of Hinds County,
Mississippi, setting forth with particularity how the county executive committee has failed to
act or investigate the Plaintiff's contest petition or has denied the relief required to remedy the
Plaintiff's contest. That upon information and belief the executive committee has
deliberately, intentionally, and willfully failed and refused to perform its statutory duty to
ensure a fair election and conduct an investigation of the allegations set forth in Exhibit A as
required by Mississippi Code Ann §23-15-921, and therefore, the Plaintiff prays for relief.
6. The Official Recapitulation (Exhibit C) for the August 8, 2023, Primary Election in Hinds
County showed the following votes for the office of District 2 Supervisor:

7. On August 18, 2023, the Plaintiff notified the Circuit Clerk of Hinds County,
Mississippi, notified of the items needed to conduct a review, Exhibit D. During the review
August 23, 2023, through August 30, 2023, many of those items were not provided.
8. The examination of the ballot boxes showed that a great number, specifically 26 out of

specifically 26 out of26 precincts were missing the machine tapes (end tape) containing the
actual number of voters that voted on each machine. Thus, these machine tapes (the end tape)
were unavailable for inspection by Plaintiff during his examination of the ballot boxes. Said
machine tapes (end tapes) were required to be maintained in the ballot boxes and their
absence constitutes a radical departure from the requirement that election materials be
securely maintained in the ballot boxes. Reference Waters vs. Gnemi 907 So. 2d (Miss 205)

10. The examination of the ballot boxes showed that a great number, specifically 18 of26
precincts were missing the voter register books (sign-in books) containing the signatures of
voters. Thus, these register books (sign-in books) were unavailable for inspection by Plaintiff
during his examination of the ballot boxes. The only precincts which included register books
were Precincts 25, 40, 41, 84, Bolton, Edwards, Pine Haven-Sumner Hill, and Raymond. Said
sign-in books were required to be maintained in the ballot boxes and their absence constitutes
a radical departure from the requirement that election materials be securely maintained in the
ballot boxes. Reference Miss Code Ann. §23-15-543 and Waters vs. Gnemi 907 So. 2d (Miss
205)
11. The examination of the ballot boxes showed that the ballot accounting form was
missing for a great number of precincts, specifically 21 out of 26 precincts. The only
precincts which included the accounting form were Precincts Brownsville, St. Thomas, 40,
Pinehaven-Sumner Hill, and 28. The ballot accounting form specifies the total numbers of
paper ballots that were used and ballots not used. Thus, these ballot accounting forms were
unavailable for inspection by Plaintiff during his examination of the ballot boxes. Ballot
accounting forms were required to be maintained in the ballot boxes and their absence
constitutes a radical departure that election materials be securely maintained in the ballot

12. The examination of the ballot boxes showed that affidavit ballots were missing in a
great number of precincts. Specifically, 26 out of26 precincts were missing affidavit ballots
from the ballot boxes. Thus, these affidavit ballots were unavailable for inspection by
Plaintiff during his examination of the ballot boxes. Affidavit ballots were required to be
maintained in the ballot boxes and their absence constitutes a radical departure from the
requirement that election materials be securely maintained in the ballot boxes. Reference
Miss Code Ann. §23-15-643 and Waters vs. Gnemi 907 So. 2d (Miss 205)
13. The examination of the ballot boxes showed that Military and Overseas Ballots were
missing from a great number of precincts. Specifically, 26 out of 26 precincts were missing
Military and Overseas Ballets from the ballot boxes. Thus, these Military and Overseas
Ballots were unavailable for inspection by Plaintiff during his examination of the ballot
boxes. Military and Overseas Ballots were required to be maintained in the ballot boxes and
their absence constitutes a radical departure from the requirement that election materials be
securely maintained in the ballot boxes. Reference Miss Code Ann. §23-15-643 and Waters

14. The examination of the ballot boxes showed that a great number of precincts were
missing express ballots. Specifically, 26 out of26 precincts were missing express ballots
from the ballot boxes. Thus, these express ballots were unavailable for inspection by
Plaintiff doing his examination of the ballot boxes. Express ballots were required to be
maintained in the ballot boxes and their absence constitutes a radical departure from the
requirement that election materials be securely maintained in the ballot boxes. Reference
Miss Code Ann. §23-15-911 and Waters vs. Gnemi 907 So. 2d (Miss 205)
15. The examination of the ballot boxes found that tally sheets showing the actual
number of voters that voted on each machine were missing in a great number of precincts.
Specifically, 26 out of26 precincts did not contain tally sheets. Thus, these machine tally
sheets were unavailable for inspection by Plaintiff during his examination of the ballot boxes.
Tally sheets were required to be maintained in the ballot boxes and their absence constitutes
a radical departure from the requirement that election materials be securely maintained in the
ballot boxes. Reference Miss Code Ann. §23-15-911 and Waters vs. Gnemi 907 So. 2d
(Miss 205)

16. The examination of the ballot boxes showed that a great number of precincts,
specifically 26 out of 26 precincts, were missing the receiving and returning form containing
the actual number of voting materials received by the poll manager on the day prior to the
election as well as the actual number of voting materials returned by the poll manager the
night after the election. Thus, these receiving and returning forms were unavailable for
inspection by Plaintiff during his examination of the ballot boxes. Said receiving and
returning forms were required to be maintained in the ballot boxes and their absence
constitutes a radical departure from the requirement that election materials be securely
maintained in the ballot boxes. Reference Miss Code Ann. §23-15-911 and Waters vs.
17. The examination of the ballot boxes showed that in a great number of precincts
machine keys were not contained in the ballot boxes. Specifically, in 25 out of26 precincts
the voting machine keys were not contained in the ballot boxes. Thus, the keys were
unavailable for inspection by Plaintiff during his examination of the ballot boxes. Voting
machine keys were required to be maintained in the ballot boxes and their absence
constitutes a radical department from the requirement that election materials be securely
maintained in the ballot boxes. Reference Miss Code Ann. §23-15-911 and Waters vs.

18. The examination of the ballot boxes showed that in a great number of precincts,
specifically 24 out of 26 precincts, the media bags were missing from the ballot boxes, and
the two bags presented did not include media sticks. Thus, these media bags were
unavailable for inspection by Plaintiff during his examination of the ballot boxes. Said
media bags were required to be maintained in the ballot boxes and their absence constitutes a
radical departure from the requirement that election materials be securely maintained in the
ballot boxes. Reference Miss Code Ann. §23-15-911 and Waters vs. Gnemi 907 So. 2d
(Miss 205)
19. The Plaintiff found during his inspection and examination of the ballot boxes that in a
great number of precincts, specifically 26 out of26 precincts, the seals on the ballot boxes
were not properly affixed and did not void upon the ballot boxes being opened. The failure
to seal the ballot boxes constitutes a radical departure from the requirement that election
materials be securely maintained in the ballot boxes pursuant to Miss. Code Ann §23-15-595
addressing the sealing and retention of proof of such sealing. Reference Waters vs. Gnemi

20. The examination of the ballot boxes showed that for a great number of precincts,
specifically 20 out of 26 precincts, seal logs were unavailable for inspection by Plaintiff
during his examination of the ballot boxes. The only precincts which included seal logs were
Precincts 16, 28, 40, Brownsville, Pinehaven-Sumner Hill, and St. Thomas. Seal logs were
required to be maintained in the ballot boxes and their absence constitute a radical departure
from the requirement that election materials be securely maintained in the ballot boxes.
21. The examination of the ballot boxes showed that for a great number of precincts,
specifically 25 out of26 precincts, that the seals were not affixed to more than 12,000 unused
(blank) ballots. Said blank ballots were required to be maintained in the ballot boxes and
their absence of a seal constitutes a radical departure from the requirement that election
materials be securely maintained in the ballot boxes. Reference Miss Code Ann. §23-15-911
22. The examination of the ballot boxes showed that a great number of precincts,
specifically 20 of26 precincts' blue document transport bags did not include any documents.
Thus, documents which should have been in those bags were unavailable for inspection by
Plaintiff during his examination of the ballot boxes. Said blue document transport bags with
election documents were required to be maintained in the ballot boxes and their absence
constitutes a radical departure from the requirement that election materials be securely
maintained in the ballot boxes. Reference Miss Code Ann. §23-15-911 and Waters vs.

23. ES&S representative Ken Williams notified the Hinds County Circuit Clerk that he
would attend the Ballot Box Review to address the Plaintiff's concerns. Mr. Ken Williams
did not attend the review, reference Miss Code Ann. §97-13-9 and §97-13-41.
24. It was determined that Hinds County District 3 Election Commissioner Jamal Clark
was in possession of the media sticks for all races and precincts. Media sticks for all 107
precincts county-wide were commingled in a bag which had no label or seal and which was
housed in Mr. Clark's desk in an open cubicle. Mr. Clark stated that he had received the
media sticks from ES&S representative Melvina Pye, and he could not speak to how long he
had the media sticks in his possession. The media sticks were not placed in the custody of
the Hinds County Circuit Clerk as required. The undocumented transfer of the media sticks
from Ms. Pye to Mr. Clark, commingling of the media sticks, and gaps in chain of custody of
the media sticks dictate radical departures of election laws. Reference Miss Code Ann. §97-
13-9 and §97-13-41 and Waters vs. Gnemi 907 So. 2d (Miss 205).
25. It was requested that ES&S provide digital imaging of the ballots. ES&S did not
provide 26 out of26 voting precincts' images of the ballots. This failure dictates radical
departure from election laws. Reference Waters vs. Gnemi 907 So. 2d (Miss 205) and Miss

26. The chairperson of the Hinds County Democratic Executive Committee, Jacqueline
Amos, exhibited gross misconduct and deliberate, willful, premeditated intent to manipulate,
subvert, and overthrow the election. See Ms. Amos' text message Exhibit E. Ms. Amos'
conduct constitutes a radical departure of election laws. Reference Miss Code Ann §97-13-23
(2013), §23-13-23, §97-13-9 and 97-13-19(2019), and Waters vs. Gnemi 907 So. 2d (Miss
205)
27. The secretary of the Hinds County Democratic Executive Committee, Sandra McCall,
exhibited misconduct in handling and marking ballots during the Hinds County Democratic
Resolution process. Ms. McCall's conduct constitutes a radical departure of election laws.
Reference Miss Code Ann §97-13-23 (2013), §23-13-23, §97-13-9 and 97-13-19(2019), and

Miss. Code Ann. 23-15-591 contains provisions to "ensure a just and trustworthy result of an
election. It provides that "when the count of the votes and the tally thereof have been
completed, the managers shall lock and seal the box, having first placed therein all ballots
voted, all spoiled ballots and all unused ballots." §23-15-591 further provides that the
securely sealed ballot boxes shall also contain " ...the tally list and the receipt booklet
containing the signed names of the voters who vote." These aforementioned mandatory
requirements of law were violated. Hence, the failure to secure and account for all ballots cast
in said primary election, including failure to include the receipt booklets of voters' signatures
in the ballot boxes constitute just cause to set aside the election.
All of the foregoing taken together as a whole, constitute willful, deliberate and serious
violations of the election laws and/or represent radical departures from the requirements of

Prayer of Relief
(1) That the Court will appoint a circuit judge or chancellor from a district not embraced by
(2) That the duly appointed judge will proceed by promptly performing his statutory
(3) That the duly appointed judge will proceed to hear the election contest as the presiding
judge of a special tribunal, composed of the judge and the five county election commissioners
as the provisions are provided in Miss. Code Ann.§§ 23-15-927, -929, -931 (Rev. 2001).
(4) The gross misconduct of the Hinds County Democratic Executive Committee, Jacqueline
Amos, Sandra McCall, ES&S, and the Hinds County Circuit Clerk dictates that the District 2
Supervisor Primary election held on August 8, 2023, should be voided as there is no way to
determine how many people actually voted in the election. This constitutes a radical
departure from statutory compliance "as to destroy the integrity of the election and make the
will of the qualified electors impossible to ascertain." Riley v. Clayton, 441 So.2d

WHEREFORE, PREMISES CONSIDERED Petitioner requests that the Court, guided by the
elections statutes setforth above and the Miss. Supreme Court's pronouncement in Waters v.
Gnemi, 905 So. 2d 307 (Miss. 2005), set a trial on the facts in this case and after such trial
find that the August 8, 2023, election for Supervisor in Hinds County District 2 was
conducted in such a manner that the actions of election officials and the circuit clerk and

(1) The paper ballots are marked in secret by a voter who then
inserts them into the DS-200 to be scanned. These ballots go
into a locked box. These are the votes reported at the polling
place by the precinct manger and the printouts* are sent to the
Courthouse in a sealed blue transport bag.
(2) After the polls are closed the machine produces a printout
(end of day paper tape) of the votes on each voting
machine. These are the votes reported at the polling place by
the precinct manger and the printouts* are sent to the
Courthouse in a sealed blue transport bag.
(3) Each voting machine also has a US media stick which
records the total votes on that machine. The precinct manager
removes the media stick from the machine and it is *sent to
the Courthouse in a sealed black media bag. The media sticks
are used to produce all of the machine totals for the
certification process of the election. And
(4) Additionally, there is a Voter Register Book (where each
voter presents their identification and when the voter enters
the poll, the poll worker locates the voter's name on the voter
roll; and upon locating the voter's name, the voter signs their
name on a numbered line.
*These are also the votes reported at the polling place by the
precinct manger and the*Voter Register Book is sent to the
Courthouse in a sealed blue transportation bag.
During the certification process and the Ballot Box Review the
TOTALS
.A (1) from the paper ballots and

.A (3) the media sticks can be checked against each other in addition

To achieve a verification of the actual number of voters per precinct.
During the current Full Examination and Ballot Box Partial Review
performed on behalf of Candidate David Archie for Supervisor in the
Hinds County District 2 Race - the findings are listed as follows:
.A (1) 14 out of 14 Ballot Boxes contained Paper Ballots;
.A {2) 14 out 14 Ballot Boxes did not contain Ballot Images from the
media sticks
/\.(3) 1 out of 14 Ballot Boxes contained the Paper Print Out (End of
day paper tape containing the vote count);
/\.(4) 0 out of 14 Ballot Boxes contained the media sticks; and
.A(S) SdfslO out of 14 Ballot Boxes Did Not contain the voter
register (signature sign in) book
The election officials' failure to return the above items back into the
Ballot Box (in order to perform the Full Examination and Ballot Box
Review) dictates it is impossible to achieve a verification of the
actual number of votes per voting precinct within District 2.
Further,

HINDS COUNTY DISTRICT TWO SUPERVISOR CANDIDATE (INCUMBENT)
I David L. Archie hereby amend my petition submitted on August 28, 2023, to include the following
specifics.
An election should be voided when there has been such a departure from statutory compliance "as to
destroy the integrity of the election and make the will of the qualified electors impossible to ascertain."
(Riley v. Blayton, 441 So.2d. Based on this ruling, I am demanding that you void the August 8, 2023
Hinds County Democratic Primary Race for Supervisor District 2 based on the contents of this petition
amendment and the information submitted on August 28, 2023.
The removal and omission of the voting machine end paper tape-print out reflecting the total vote on
each machine is a blatant violation of mandated election statutes. (2019 Mississippi Code Title 97 -
Crimes Chapter 13 - Election Crimes Section 97-13-19. Corrupt conduct, etc, by election official.)
Further, the removal and omissions of these machine printouts prohibits the voter count verification
process which dictates radical departures from election laws. (MS Supreme Court, Debra Waters v.

Be us further reminded the failure to include these pertinent documents as mandated by election
statute is a criminal offense.
Upon review and examination of every ballot box, the Hinds County Democratic Election Executive
Committee actions included gross misconduct in the failure to include the absentee ballots, the counted
affidavit ballots, including the excess ballots.
Including the careless acts of commingling (mixing and blending of) different voting Districts by the
Hinds County Democratic Election Executive Committee confirms that each member who participated
was derelict in their duties; and their actions have made mockery of their oath to serve, and their
actions offered shame and disgrace to the entire election process.
We were denied the opportunity to examine the data on the media sticks and review the ballot images.
he media sticks were commingled. Custody of the media sticks was irregular in that neither Zack
Wallace nor the Circuit Clerk's office was in possession of them for the duration of the review.
There was no official record of the work of the Resolution Board. Instead of one person per district,
eight (8) people participated in the resolution process with no accountability.
As there is no legal justification for the removal or omission of the voting materials from the ballot
boxes, the removal of the voting material positions forces me to declare that the actions of the Hinds
County Democratic Executive Committee, specifically Chairperson Jacqui Amos and Secretary Sandra
McCall, were calculated and premeditated. Therefore, I demand the removal of Amos and McCall from
all participation regarding this contest and challenge.
My review has confirmed my position that the August 8, 2023 Hinds County District Two Supervisor
Democratic Primary is a high-tech, election heist, fraud and corruption.
Our finding of a large scale of irregularities throughout the ballot examination process exposes gross
breach of duty at the highest level.
I have been forced into a position that affords the only recourse is to challenge the validity of the voter
count of the Hinds County District 2 Supervisor Race as there is no measure to ascertain the true will of
the voter.
As we set forth the grounds of this contest and challenge, we demand to be heard at the hearing, call
witnesses, and present evidence in support of our position including
• Audio
• Video
• Still pictures from videos
• Actual Ballot Boxes
• Text Messages
Prayer of Relief:
1. That the Hinds County Democratic Executive Committee responds to this challenge process in a
timely fashion,
2. That the Hinds County Democratic Executive Committee uses the power and authority invested
in them to declare the August 8, 2023,Hinds County Democratic Primary Race for Supervisor
District 2 null and void,
3. That the Hinds County Democratic Executive Committee declare a new Special Primary Race
upon voiding the aforementioned race,
4. That the Hinds County Democratic Executive Committee assert no other candidate be permitted
to enter the race other than myself, David L. Archie, and my opponent Anthony "Tony'' Smith
upon recognizing that the qualifying deadline date to enter the race has expired, and
5. That the Hinds County Democratic Executive Committee relinquishes their right to conduct and
operate the newly ordered Hinds County Democratic Special Primary Election for Supervisor
District 2 by granting the Hinds County Election Commission the authority to conduct the newly
ordered Special Primary Election.
In closing, all participating parties will be held accountable to the highest standard of the law.

"All Forms related to the Receipt and Return Process from each Voting Precinct within HCD2;
"All Voting Machines Tapes/proof sheets at Closing of the Polls from each Voting Precinct
within HCD2;
"All Voting Machines Zero Tapes from each Voting Precinct within HCD2;
"Official Ballot Counts from the ES&S uploads from each HCD2 Voting Precinct;
AQfficial Counts from the thumb drives/media drives/flash drives from every Voting Precinct
within HCD2;
"To Provide an Official Copy of the Recapitulation Report from every Voting Precinct within
HCD2;
"To Review the Digital Imaging of each ballot cast on every machine at each Voting Precinct
within HCD2;
"Serial Numbers used for each machine at each Voting Precinct within HCD2;
ASerial Number Logs used for each machine at each Voting Precinct within HCD2;
/\ All Seals and Locks used or not used from all Voting Precincts within HCD2;
ATo Provide two (2) DS200 Machine.
ATo Provide the Express Vote Machine Ballots and Numbers and Paper Receipts from all
Voting Precincts within HCD2
Afurther, it is requested that all Ballot Images be converted to PDF from programming code and
to ensure that the Time Stamps associated with each ballot image is reflected or readable.
"Further; it is requested that ALL OF THE VOTING MACHINES used during the Primary
Election on August 8, 2023 for the Voting Precincts within HCD2; NOT TO BE USED in the
Tuesday, August 29, 2023 Run Off Election.
And
AYou are hereby requested to provide all of the above requested items but not just limited to the
those listed items - all items that falls within the scope of the ballot boxes from the Voting
Precinct within HCD2 are requested for this Full Examination and Ballot Box Review
