BULAW1502 FUNDAMENTALS OF LAW

Weighting: 30% (total)

The purpose of the assignment is for you to undertake independent research into
business law, to reflect on and consider factual and legal issues, and to apply your
legal skills. We are looking for a demonstrated understanding of topics B & C which
requires you to use relevant legal principles to support your arguments. You must limit
your response to the topic content coverage mentioned above.
The total word length for this assignment is 1,500 words (a maximum only of 10%
over or under this limit is acceptable). Given the distribution of grades across the
questions, you may wish to apportion your words accordingly. Please include a word
count in your assignment document, and do not include references within your word
count.
The referencing method used in your assignment must be strictly in accordance with

In writing your response, please ensure that you answer the questions posed in this
document and address the criteria outlined in the Criterion-Referenced Marking
Considerations Rubric (below). There are two separate questions below. One of
these questions is a short essay discussion question and the other, a problem-based
question. Most marks are given for critical analysis; very few marks (if any) are given
for merely restating information (including the facts or question). Please do not repeat
the facts of the questions in verbatim at the start of your response to the questions.
You will be assessed on your ability to critique, to apply knowledge and present legal
arguments to justify your analysis (as explained in the rubric (below). In your answers
to the questions, only consider Australian case law principles and statute (where
relevant). You must complete BOTH questions in the one document.

Question 1 (short essay discussion question):
Milly and Jasmine are considering a business together. They propose to share both
the profits and losses of the business equally. They would like to keep the costs low
whilst mitigating risk. Discuss the options available to Milly and Jasmine with reference
to course content on business structures. (10 marks)

Question 2 (problem question: consider using the IRAC method):


Glenda (aged 18) enters an agreement with her sister Jill (aged 16), for house
cleaning. The work is on a weekly basis and involves Jill cleaning the bathroom, toilet
and kitchen areas in return for Glenda paying Jill $70. The agreement is reached
verbally. They decide not to document the agreement as they ‘know each other’ and
are ‘siblings.’ Three months later, Jill refuses to do the housework and a massive
argument ensues. Glenda threatens Jill with legal action.

1. First, identify the expectations of the parties with due regard to the legalities of an
agreement. Secondly, identify the legal issues that arise from the facts (with
