Procceeding These proceedings shall be read in continuation of earlier proceedings of


the Commission.

The complaint pertains to death in sewage tank. In his complaint, the


complainant, based on the news report, has alleged that three sanitation
workers died inside the Sewage tank in Singrauli distt., MP. The workers
asphyxiated due to toxic gases. They were working for a company hired by
the Municipal Corporation to clean the underground sewage tank. The
complainant had requested the Commission for compensation to the family
of the deceased and for filing of complaint against the Company.

Pursuant to the directions of the Commission issued vide proceedings dated


29.09.2022, a report dated 17.10.2022, was received from the
Commissioner, Municipal Corporation, Singrauli. As per report, sewer
project of Singrauli city is under construction. No work of sewer cleaning
was going on. During the course of repairing of manhole, labourers died.
After the occurrence, the contractor M/S K.K. Spun India Limited had
given Rs. 4,00,000/- each to the dependents of all the three deceased. The
proof of payment is also attached with the report.

It was further reported that on the direction of Vice President, National


Commission for Safai Karamchari, the following action has also been
taken:-

1) FIR has been initiated.


2) Rs. 10 lakhs each to the dependents of three deceased workers had been
paid by the Government as per M.S. Act, 2013.
3) The family member of the three deceased workers have been provided
job on outsource.
4) A letter to CMO, Singrauli had been issued for better treatment, on the
cost of government, for two minor daughters of deceased Kanhaiya Lal
Yadav who are blind by birth.

The Commission, vide its proceedings dated 20.01.2023, directed the SP,
Singrauli, Madhya Pradesh, to submit the detailed report whether the FIR
has been lodged on the occurrence or not? An action taken report be
submitted within four weeks. The Commission also directed to send a copy
of report dated 17.10.2022, of the Commissioner, Municipal Corporation,
Singrauli, to the complainant for comments, if any, within four weeks.

The report called for, from the SP, Singrauli, Madhya Pradesh, is still
awaited. Also, no comments received from the complainant on the report
dated 17.10.2022 of the Commissioner, Municipal Corporation, Singrauli.

The Commission has received requisite reports. Pursuant of the Reports, it


found that an FIR vide number 1116/2021 dated 24/09/2021 has been
already lodged u/s 304 and 34 of the Indian Penal Code, 1860.

Furthermore, a report is also received from the Municipal


Commissioner, Singrauli, Madhya Pradesh vide letter number
4171/tech./2022 dated 17.10.2022 has been received. Further, report from
the Labour Commissioner vide letter number 22/13/VI/2022/236 dated
24.01.2023. Also, a report from District Magistrate and Collector,
Singrauli, Madhya Pradesh vide number 8579/2022 dated 08.03.2022 has
been received.

Upon, comprehensive analysis of the above-mentioned reports, it


concluded as follows. That dependents of the victims have received a
compensation of 4 Lakhs from M/S K.K. Spun India Limited, working on
hire by Municipal Corporation, Singrauli, Madhya Pradesh and 10 Lakhs
from the state government as per the M.S. Act, 2013 has been received by
the dependents of the victims. It also observed that for better treatment, on
the cost of government, for two minor daughters of deceased Kanhaiya Lal
Yadav who are blind by birth, a letter was issued to the concerned CMO.
Further, the family member of the three deceased workers have been
provided job on outsource by Municipal Corporation, Singrauli, Madhya
Pradesh.
