Drafting, Pleading, and Conveyance

Batch 2019-24 Semester IX

Internal Component Instructions


 All the assignments are to be prepared in Times New Roman with a font size of 12.
 All the required provisions for drafting the below need to be complied with.
 Space should be 1.5.
 Left and Right margins are to be complied with properly, as learned in the office.
 The draft should not be beyond 3 to 4 pages maximum.
 The mode of submission will be informed later.
 Each assignment is of 3 marks (3*15=45 Marks).
 Assignments will be done by the students individually.
 All the assignments are to be submitted within the instructed time.
The final evaluation will be conducted in viva comprising of three components –
Assignment No. 1 (15 exercises), Assignment No. 2 (15 exercises), and learning outcomes
of the internship attended by the students. The Viva exam will be for 10 marks.

Assignment-1

1. SUIT TO RECOVER MONEY DUE ON A PROMISSORY NOTE (PLAINT)


ShyamNarayayan Shukla vs. Raj Bihari Parmanand
Defendant borrowed Rs 50000/- from the plaintiff on --------2021 for a period of 10
months and executed a promissory note on the same day in favour of the plaintiff. The
defendant agreed to the interest at 12@ per annum from the loan date till repayment.
The defendant had taken the amount aforesaid and has neither paid the principal nor
the interest thereon.

2. SUIT FOR SPECIFIC PERFORMANCE OF A CONTRACT


One ---------2022, the plaintiff and the defendant entered into an agreement wherein
the defendant contracted to sell to the plaintiff specific immovable propertyfor the
sum of 5, 00,000/-. Plaintiff is willing to perform the part of the contract and had
advanced the payment of 1 00,000/- in favour of the defendant via cheque no.
---------- and the same was withdrawn by the defendant the very next day. The
defendant presently is not willing to perform his part of the contract.
3. SUIT FOR MAINTENANCE BY WIFE
Mira vs.Gulab
Plaintiff was married to the defendant in -----2021 and still, is a legal wife of the
defendant. On ----------2022, the defendant has married a second woman named
Mukta r/o and started harassment to the plaintiff by beating after that, on -----------
day-2022 has, turned the plaintiff out of his house. The plaintiff has a 2-year-old
daughter, and the defendant has refused to maintain Mira and her daughter.

4. PETITION FOR DECREE OF DIVORCE


Petitioner was married to the respondent at -----------according to the Hindu rites and
ceremonies on -------------. During the stay,the respondent did not show any interest in
married life with the petitioner and often refused to share any marital duty withthe
petitioner. Out of wedlock,the parties have one son. The respondent resides in her
father’s house with her son and does not want to return to her husband’s house.

5. AN APPEAL TO THE HIGH COURT


That the respondent was appointed at the appellant institute as a lecturer in
Mechanical engineering by an order dated-------------and he took over the charge on
----------. That the appointee was on a contractual basis for one year only. Another
appointment letter was issued on -------------by which the respondent was appointed
for another two years on a contractual basis. The further respondent was requested to
communicate the acceptance of the appointment before the end of the month ---------
year-----. In the absence of acceptance, the service got terminated on --------------.
Also respondent informed his unwillingness to accept the job. But later filed an appeal
before the presiding officer, who allowed the appeal and ordered the appellants to pay
unto the respondent salary, including all allowances with effect from------------—
being aggrieved by the same file an appeal.

6. COMPLAINT UNDER SECTION 500 OF IPC


That the complainant is in service of the technical education department for 25 years
and has been working as an assistant professor of mechanical engineering at the
government polytechnic, Pune for the last ten years. The accused is also working in
the same department as a lecturer in Physics. Once accused made a false complaint
before the principal of the institute and police, alleging that the complainant teased
her. Nothing was found in the inquiry. Similarly accused had written anonymous
letters trying to defame the complainant.
7. APPLICATION UNDER SECTION 438 OF THE CRIMINAL PROCEDURE
CODE
The applicant is a social worker and an active member of the shiv sena
party.Applicant won the election. During the election campaign, many allegations
were made by the members of opposite parties to defeat the candidature of this
applicant. An active member of the opposing party could not withstand his defeat.
One day so-called active member was stabbed and lost his life.The applicant has an
apprehension that he may be arrested.
8. COMPLAINT IN THE CONSUMER FORUM
The complainant purchased a washing machine and found the same to be not working.
Even after many complaints filed by the complainant to the shop owner and the
manufacturer, no fruitful action is yet taken.
9. APPLICATION FOR AN INTERIM INJUNCTION
File an interim injunction application during the pendency of suit for partition or suit
for declaration and injunction.

10. Petition for a writ of habeas corpus under article 226 of the constitution of India.

11. Special Leave Petition (SLP) under Article 136 of the Constitution of India.

12. Execution petition for money recovery decree.

13. PIL under 32 of the constitution of India, taking the ground of sustainable
development.

14. Public notice/statutory notice/legal notice/notice under section 138 of the NI Act.

15. Make a Special power of attorney in favour of promoters and builders.
