MOTION FOR EXTENSION OF TIME

TO FILE COUNTER-AFFIDAVIT

Respondents xxx and xxx, unto the Honorable City Prosecutor, most
respectfully state that:

1. On xxx, respondent xxx received a subpoena from the Deputy Provincial

City Prosecutor’s Office charging the above respondents of the above-
stated offenses and requiring them to submit their counter-affidavit on
xxx;

2. Respondent xxx did not receive a Subpoena and a copy of the complaint
but was informed by respondent xxx about the case on xxx;

3. However, due to time constraints since the subpoena along with the
complaint was just received on xxx, respondents are constrained to
request for an additional period of fifteen (15) days from today, or a
period until xxx, within which to find legal representation and submit
their Counter-Affidavit in the case; and

 4. Their filing of this motion is not intended for delay, but was necessitated

only by the foregoing reasons.

PRAYER

WHEREFORE, in view of the foregoing, it is respectfully prayed of the

Honorable Office to grant the respondents an additional period of fifteen (15) days
from today, or a period until xxx, within which to file their Counter-Affidavit and
other documentary evidence.
