Follow ALL of the following instructions when you attempt this Assessment:

1. Study the learning units in your Study guide for LML4805 before you
attempt this assignment:

Note: The memorandum of this Assessment is based on the Study guide


and students will not be penalized if they do not consult the prescribed
textbook. However, all prescribed study material (as set out in Tutorial letter
101 par 6 and further tutorial letters) should be studied and consulted for the
examination.

2. Read Tutorial Letter 301/4/2023 with General information for all students
in the School of law and follow the instructions and guidelines therein. See,
in particular, par 5 on Assignments. Paragraph 5.2.3.6 deals with the
Answering of assignments and par 5.2.3.7 sets out Formal requirements.
You should also specifically follow the instructions on Ethical behaviour as
a student in par 5.2.4.

3. Read Tutorial letter 302/4/2023 that contains the School of Law


Referencing Guide and follow the instructions and guidelines therein. Your
answers should contain references in footnotes as well as a bibliography in
the prescribed and consistent style. Written answers may contain end notes
instead of footnotes.

4. Your Assessment answer should not exceed the following page limitation:

2 (two) typed pages or 3 (three) handwritten pages.

This excludes the cover page and the bibliography. Answers in extent of the
page limitation will not be marked.

The Assessment Questions follow below:

1. Good faith and insurable interest may be regarded as possible essential


requirements of an insurance contract. Provide reasons why some
commentators are of the view that good faith and insurable interest should not
be regarded as essential requirements. Refer to relevant authority. (5)

2. Explain the similarities and differences between insurance contracts and


wagering contracts and discuss how one can distinguish between them. (5)
