- Having seen the Royal Code NS/RKM/0618/012 dated 28 June 2018 promulgating the law
on Organization and Functioning of the Council of Ministers
- Having seen Royal Decree NS/RKT/0805/354 dated 05 August 2005 on Modification of
the Permanent Commission for National and International Festivals into the National
Committee for Organizing National and International Festivals.

Civil Servants, Workers/Employees for 2021;

Decide
Article 1:
Workers/employees of all factories/enterprises stipulated in Article 1 of the Labour Law shall be
entitled to the following paid holidays:
- 01 January International New Year Day One day
- 07 January Victory Day over Genocide One day
- 08 March International Women's Day One day
- 14, 15, 16 April Khmer New Year Days Three days
- 01 May International Labor Day One day
- 14 May King Norodom Sihamoni’s Birthday One days
- 15 May Visak Bochea Day One day
- 19 May Royal Plowing Ceremony One day

Article 2:
For factories/enterprises whose business is of global nature that requires regular operations
which cannot be halted and allowing all workers/employees to have a public holiday at the same
time affects the public interests or affects the operations of the factory/enterprise, the owner or
director of the factory/enterprise shall arrange workers/employees to have a public holiday as
per each public holiday in a rotating manner.

In the event that there is an agreement between workers/employees and the employer or it is
stipulated in the factory/enterprise’s internal regulation or collective bargaining agreement
(CBA), the day off of workers/employees can be taken on another day that is different from the
public holiday stipulated in this Prakas.

The owner or director of factory/enterprise shall prepare a name list of workers/employees who
have to take their public holiday in a rotating manner and must keep it all the time for an
inspection of labour inspectors.

During the rotating day off, the owner or director of factory/enterprise can use other
workers/employees temporarily to replace the workers/employees who are taking their day off.

Article 3:
Any provision contrary to this Prakas shall be abrogated.

Article 4:
Chief of cabinet, Director General of General Department of Administration and Finance,
Director General of General Department of Labour, Director General of General Department of
Technical and Vocational Education and Training, and Director of Labour Inspection
Department, Director of Labour Dispute Department and Directors of relevant units,
workers/employees and employers shall implement this Prakas from 01 January 2022.

条款 1:
劳工法第一条规定的企业/商行的工人/职员可享用带薪年假如下：
- 01 月 01 日 元旦 一天
- 01 月 07 日 胜利日 一天
- 03 月 08 日 国际妇女节 一天
- 04 月 14、15、16 日 柬新年 三天
- 05 月 01 日 劳动节 一天
- 05 月 14 日 国王诞辰 一天
- 05 月 15 日 比萨宝蕉节 一天
- 05 月 19 日 御耕节 一天
- 06 月 18 日 国母诞辰 一天
- 09 月 24 日 立宪节 一天
- 09 月 24、25、26 日 亡人节 三天
- 10 月 15 日 国父逝世纪念日 一天
- 10 月 29 日 国王登基日 一天
- 11 月 07、08、09 日 送水节 三天
- 11 月 09 日 独立节 一天

条款 2：
对于其业务具有全球性的企业/商行，需要定期进行业务并不能暂停，但还
允许所有工人/职员在同一时间放假，这会影响到公共利益或影响到企业/
商行的正常运营，该企业/商行的所有者或总经理应按轮休的方式安排工人
/职员休假。

 如果工人/职员与雇主之间达成协议或企业/商行的内部规章或劳资集体合
同规定，则可以在本通告规定的公共假日不同时间休假。

企业/商行所有者或总经理应准备必须轮流休假的工人/职员的名单，并须
始终保留该名单以提供劳工监察员进行检查。

在休息日期间，企业/商行的所有者或总经理可以临时使用其他工人/职员
来代替休假的工人/职员。

条款 3：
任何与本通告中相反的规定将被作废。

条款 4：
内阁总干事、行政和财政总局局长、劳工总局局长、技术和职业教育培训
总局局长以及所有关单位负责人须自 2022 年 01 月 01 起落地实施。
