Department, Northern Railway. - sir, Under the instructions and on behalf of my client Mrs. Sunita 4 Daughter of Mr. Gulab Meena, wife of Mr. Gajendra Meena, resident of Shiv Nagar Colony, Near Jain Temple, Circular Road, Bharatpur, I hereby bring to your notice as under: 1. That my client entered into-wedtock with Mr. Gajendra Meena on 3.4.2011 as per the rites and ritual prevalent in the community of my client and Mr. Gajendra Meena in District Bharatpur, Rajasthan. 2.That Mr. Gajendra Meena filed a divorce application registered as*Case No 11/2014 before the Civil Judge, Hindaun and obtained an ex-parte decree in his favour on the basis of fraud and misrepresentation. The said divorce decree was Passed on 15.4.2015 by the Civil Judge cum Judicial Magistrate, Hindaun City, Karauli. As soon as my client came to know about the said ex parte decree, my client filed an application under Order 9 Rule 13 for setting aside the exparte decree read with section 151 CPC, which was allowed vide judgment dated 9.10.2017 and the exparte divorce decree dated 15.4.2015 came to be quashed and set aside alongwith the divorce petition filed by Mr. Gajendra Meena. Copy of the judgment dated 9.10.2017 annexed. At the time of filing the said application under Section 13 of Hindu Marriage Act, Mr. Meena was posted as Locopilot at Loco Pilot Lobby, Kajipet Railway Station, District Warangal, Andhra Pradesh. 3.That in the meantime, Mr. Gajendra Meena, soon after the passing of the exparte decree dated 15.4.2015, in a preplanned manner and with ulterior motive, married one Guddi Bai daughter of Mr. Babulal Meena on 22.4.2016 and out of the said wedlock a son was born on 25.6.2020. Mr. Gajendra Meena has aeliberately and willingly deserted my client and denied her the status and rights of a legally wedded wife. “oe 4. That on 16.9.2018, my client filed en application under Section 125 CrPC against Mr. Gajendra Meena for grant of maintenance, wherein the Learned Family Court-2, Bharatpur vide its order dated 5.5.2022 directed payment of interim maintenance of Rs. 10,000/- from the date of application and the amount due was directed to be paid in 3 equal inste’Iments and the regular monthly maintenance was to be paid by 10% of every month, The said order was passed in the presence of the counsel for Mr. Gajendra Meena. Infact, throughout the whole proceedings, Mr. Meena was aware of the pendency of the ae aha ake ee acini acgaciaaice passin’ a of the order dated 5.5.2022 no sum was paid to my client from Mr. Meena. Infact, Mr. Meena filed a Criminal Misc. Petition Bearing number 4640/2022 titled Gajendra Meena vs sunita. “challenging the order dated 5.5.2022, before the Hon'ble Rajasthan High Court, Jaipur Bench which is pending till date, however no interim relief has been granted to Mr. Meena. ‘That the exparte judgment and decree dated 15.4.2015 has been set aside by a competent court vide judgment dated 9.10.2017 which is in the knowledge of Mr. Gajendra Meena however, he has willfully refrained from appearing in the said ~ ‘proceedings. Infact, my client's application for restitution” Of conjugal rights filed under Section 9 of Hindu Marriage Act has been allowed exparte vide judgment dated 28.6.2023. Copy Annexed. Further, my client submitted an application for maintenance under Section 425—of The Code of Criminal Procedure which also came to be allowed exparte vide judgment dated 28.6.2023 granting final maintenance of Rs. 10,000/-. Copy Annexed. Both the judgment have been passed by the Court in the absence of Mr. Gajendra Meena as he was proceeded ex- parte owing to his willful and deliberate absence despite service. + That not only Mr. Meena has failed in paying the maintenance to my client in terms of the interim order for maintenance dated $.5.2022; tne judgment dated 28.6.2023 but also has married another woman and has also entered her name as his nominee in the official records, denying my client the status of a legally wedded wife. Further, the marriage of Mr. Gajendra Meena with Guddi Bai is void-ab-initio as the ex- parte decree of divorce has been set aside and even the divorce petition filed by Mr. Gajendra Meena has been dismissed, by a competent court. Thus, my client is to date legally wedded wife of Mr. Gajendra Meena. a oe 7. Thus, it is requested that firstly appropriate steps be taken for deduction of salary from the salary of Mr. Gajendra Meena and the same be paid to my client towards the maintenance ac Girected by the Learned Courts; secondly disciplinary Proceedings be initiated against Mr. Gajendra Meena for entering into 2™ wedlock during the continuation of the ast marriage and thirdly the name of my client be entered ins the office records as the nominee of Mr. Gajendra Meena.
