I. Policarpio Magtanggol, a Filipino citizen, and Juan Magbanta, resident alien,

were present when Cardo Dalisay, a Filipino citizen, and Coco Martin, a
resident alien, conspired to commit treason. However, Policarpio and Juan did
not disclose the information regarding such conspiracy to the proper
authorities. What are the respective crimes committed by Policarpio, Juan,
Cardo and Coco under the Revised Penal Code of the Philippines, if there be
any? Explain fully.

II. Uno, Segundo, Tersiero, Cuatro and Cinco, all armed with high powered
caliber guns, fired upon MV Philippine Princss vessel in the course of its
voyage. Later on, Uno, Segundo, Tersiero, Cuatro and Cinco boarded the
vessel and took control of the same. Significantly, while the piracy was taking
place, Uno stabbed Jugo, a member of the crew while the latter was sleeping.
And, immediately upon killing Jugo, Uno proceeded to rape Beauty who was
then sleeping in her room.

a. What crime/s crimes did Uno, Segundo, Tersiero, Cuatro and Cinco
commit under the Revised Penal Code of the Philippines? Explain Fully.

b. Assuming that Uno was arrested and charged of the crime of Qualified
Piracy while Segundo, Tersiero, Cuatro and Cinco were arrested and
charged of simple Piracy. Uno argued that Segundo, Tersiero, Cuatro and
Cinco should also be charged of Qualified Piracy and not a mere simple
Piracy. On the other hand, Segundo, Tersiero, Cuatro and Cinco, claimed
that Uno should only be the one liable for Qualified Piracy because it was
he who stabbed Jugo and raped Beauty. Rule on the contentions of Uno,
Segundo, Tersiero, Cuatro and Cinco. Explain Fully.

III. Janus boarded an airplane at the Manila Domestic Airport bound for Davao
City. While the airplane was still on the tarmac, its doors still open and
waiting for the last passenger to board, Janus ordered the pilot at gunpoint, to
take the airplane to China. When the pilot refused, Janus shot him dead. Is
Janus liable for the crime of Hijacking? Explain Fully.

IV. Police Captain Mikol Bal is a young and brilliant policeman. At around 10 in
the morning of August 28, while on patrol, PC Mikol Bal noticed the neck-
braking beauty of Mikayla, who was then outside her house. After that, PC
Mikol Bal could not get over with the beauty of Mikayla. Later on, at around
12 midnight of the following day, while PC Mikol Bal, together with his
policemen were in patrol, PC Mikol Bal went on to see Mikayla in her house.

 PC Mikol Bal knocked on the door of Mikayla’s house. Mikayla, who was
still awake, opened the door and asked the reason why PC Mikol Bal was at
her door step. PC MIkol Bal, driven by her ill and lustful desire against
Mikayla, asked Mikayla if he could go inside her house but Mikayla refused.
As such PC Mikol Bal forced his way inside Mikayla’s house against the will
of the latter. The following day, Mikayla filed a case of Violation of Domicile
against PC Mikol Bal. PC Mikol Bal countered that he could not be held liable
for the crime of Violation of Domicile because his entry into the house of
Mikayla was not in pursuit of his function as a police officer. Mikayla
contends however that PC MIkol Bal’s entry into her house was in pursuit of
his function because at that time of entry, PC Mikol Bal was then on duty and
in the course of patrolling their area. Rule on the contentions of Mikayla and

V. Sergio Valdez is one of the Top Ten Outstanding Policeman in the country.
On June 31, 2021, Sergio Valdez together with his team, were able to
apprehend Lex, in a drug buy bust operation in Laoag City, Ilocos Norte. That
on July 31, 2021, Sergio Valdez together with his policemen Pipo, Papi and
Pipi, while patrolling along Brgy. 1, Laoag City, caught in flagrante delicto
Kiko selling drugs to Biko. Subsequently, on August 31, 2021, Sergio Valdez
was also able to apprehend Boy in another drug buy bust operation. Because
of the said successful operations, Sergio Valdez filed an application for
official leave of absence which was later on approved by his superior official.
On September 2, 2021, at around 12 PM, Sergio Valdez, while on official
vacation, walking along the seashores in Fort Ilocandia Beach, saw Angelito
standing in a corner talking to someone through his cellphone. Sergio arrested
Angelito. Upon arrest, Sergio body searched Angelito but found nothing.
