Rebar Sub-Contract Agreement

The parties

This agreement is made on the day of ________________between Hambra PLC (here in after
known as “the Employer”) in one part, Address: Addis Ababa, Sub-City: -Arada, wereda: -01,
house no: -030/H.N.2/49 (Here in after known as “the Sub-Contractor”).

and Ameneshewa Solomon and friends Small Building contractor p/s, Address: Addis
Ababa, Sub-City: -Nifas Silk, wereda: -05, house no: -051 (Here in after known as “the Main -
Contractor”).

Article One – Objective of the Agreement

whereas Hambra PLC wishes to Sub-Contract part of his work, i.e., Rebar works for Atena
Tera 4B+G+12 apartment building project.

Whereas Ameneshewa Solomon and friends Small Building contractor p/s willing to execute
the rebar works with the necessary equipment and tools for the Total price stated in the Table

Now, THEREFORE, the two parties hereby agree as follows:

Article Two

Obligation of the Sub-contractor

2.1. The sub-contractor shall provide the necessary equipment and tools such as cutter disc
and bar cutter for the work.

2.2.The sub-contractor shall perform the work in accordance with the contract and shall
deliver it according to the schedule.
2.3.The sub-contractor shall mobilize within three days after he signs the contract.
2.4.The sub-contractor shall submit the necessary labor and equipment schedule for
execution of the works to finish within the schedule.
2.5.The sub-contractor shall follow the employer’s site order to improve the quality and daily
performance of the work.`````

2.6.The sub-contractor shall demonstrate the quality of the work to the employer and ensure
that it is done in sufficient quality.

2.7.The sub-contractor’s work is accepted only after the quality of the work has been
approved by the consultant.

2.8.The sub-contractor shall submit performance bond for the work.

2.9.If there is a defect in the quality of the work after checking by the consultant engineer,
the sub-contractor is obliged to correct it at his own expense (material and labor) and
submit it to the contractor within 3 days.

2.10. If there is any delay more than 10 working days other than the schedule, the
contractor can terminate the contract at any time.

2.11. The sub-contractor shall take full responsibility for the care of works and materials
provided by the Employer and equipment for the incorporation therein from
commencement date until the taking over of the work by the Employer.

2.12. The sub-contractor shall be responsible for the death of or injury of any person which is
under sub-contractor; or loss of or damage to any property which may arise out of or in
consequence of the execution and completion of the work.

 Article Three
Obligation of the Employer

3.1. The employer shall provide necessary materials, sufficient working environment and
working drawings required for proper execution of the sub-contract work.

3.2 The employer shall be responsible to pay monthly payment for the sub-contractor as
mentioned in article 4.1 of this contract.

Article Four
Condition of Measurement and Payment

4.1.The sub-contractor shall request his monthly payment according to the measurement
taken and the rate agreed for the works and approved by construction supervision
consultant and employer’s office engineer.

4.2. Retention 5% will be paid when all work is completed.

4.3. Price adjustment will only apply based on the consent of two the parties
