Patio Party Reservation - Terms of Agreement

A written contract and a $250.00 deposit, in the form of a credit card or check (made payable to
El Gallo Restaurant) must be received to reserve your date and time. A cash deposit may be
given instead in the amount of $ 350.00 El Gallo Restaurant, referred to as EGR, will credit any cash deposits
towards the final bill, granted all criteria within this contract are met. Any monies left over will be returned directly
to the person the cash deposit was received from. All deposits will be held by El Gallo Restaurant.

Once the event is reserved and guaranteed, EGR we will begin to plan and finalize the specifics of your event. The
details of your event, including menu, set up, and special arrangements will be verbally confirmed. The balance is
to be paid in full at the conclusion of the event. Any adjustments to the menu after verbal confirmation will be
reflected in the final bill.

A final guest count is required one day prior to the event. If no updated count is received, the original guest
count written below and confirmed with your signature will be used as a firm guarantee. This is the minimum
number for which you will be charged. EGR enforces a charge of $15.00 per person for any guest not in
attendance or not eating. No food or beverage can be exchanged for this monetary amount. Tax, set up fee and
gratuity will be added to each per person amount.

Cancellations must be received 3 weeks prior to the event or subject to a $350 cancellation fee. "No Shows" will
result in a fee equal to 50% of the estimated total. EGR has no control over the weather, therefore EGR makes no
guarantee, but will attempt to accommodate you and your guest in other areas of the restaurant in the event that the
weather is unfavorable or unsafe for you and your guest.

Due to occupancy restrictions, reservations made for parties fewer than 70 people are NOT guaranteed to be held
in completely private dining areas. EGR will guarantee a group of tables be reserved and arranged on the patio
with all the specifics carried out. There is a minimum $ 500.00 food and beverage purchase total for the patio
during peak times.

A Limited menu is required for reservations/banquets in excess of 35 people. Kindly refer to the Banquet Menu
provided. No separate checks are available for banquet functions, unless approval is received prior to your
function. The complete Patio is available to you for 2 ½ hours at a fee of $75.00 or 10% of the total bill
(whichever is greater). If your guest count is 30 or below, you may have the lower portion of the patio for 2 hours
for $ 30.00. This will be manually added at the end of the bill. Any event needing longer than the hours stated
above, may with prior approval, pay an additional rate of $ 20.00 for every ½ hour needed. This fee is non-
refundable, should your event end earlier than the hours reserved. All food and beverage will have a 20% gratuity
and 8.25% sales tax charge

Food and beverages are contracted for consumption at El Gallo Restaurant only. Should you or any of your guest
request “to go boxes” EGR will charge a nominal fee per to go packaging item.

Alcohol Policy: No one under the age of 21 years of age will be served an alcoholic beverage at an EGR event. No
one under the age of 21 may sign a contract for services involving alcohol. Picture ID will be required to show
proof of age. We encourage patrons to utilize the designated driver program for such events.

With the signature of this contract, the signed company or individual is responsible to consents to all the conditions
set forth in the agreement above.
