Sub : Legal notice in reference to deficiency of service u/s 2(11) of Consumer Protection Act;

Sir/ Madam,

Under instruction and on behalf on my client Mr. Monu Rajpoot, 44 Panki Katra, Kanpur Nagar
with contact number 9696642153 serves you with the following legal notice;

That my client is a consumer u/s 2(7) of Consumer protection act and he is entitled to get better
service from your end to the amount he paid

That the fact of the case is that my client states that he purchased MOTOROLA Edge phone
from flipkart and paid an amount of Rs.14257/-. That my client states that he received damaged
product. That the phone is working properly. That my client immediately registered complaint
with flipkart and flipkart advised to visit Motorola service center. That he visited service center
and they examined the name and informed that the phone is damaged.

That on August 11 my client placed return request but the same was also canceled from your
end. That my client tried to connect flipkart multiple times but he was not provided with proper

response. That my client raised complaint immediately but he was not even provided with proper
response and after requesting repeatedly, no action has been initiated regarding providing him
solution. That my client placed return request within the prescribed time frame so my client is
eligible to return the product and get refund.

That my client have made several attempts to resolve this issue by contacting your customer
support, but my client haven't received any satisfactory response or resolution thus far. As a
consumer, my client is entitled to get better service from you and I believe you have failed to
fulfill this obligation. That my client have encountered numerous issues that have led to believe
that you are engaged in deceptive and dishonest practices.

As a consumer, my client has certain statutory rights and entitlements, including the right to
receive goods in satisfactory condition, which were accurately described at the time of purchase.
The sale of defective item is a violation of these rights and constitutes deceptive trade practices.

That you have malafide intention in cheating my client and have acted in a fraudulent way. As a
result of your actions, consumers have suffered financial loss and mental distress.
That the trade practice from your ends comes under UNFAIR TRADE PRACTICE; That you
have engaged in deceptive, fraudulent, or unethical business activities that harm consumers'
interests. These practices may include false advertising, misleading information, price
manipulation, product misrepresentation, hidden charges, and other forms of dishonest conduct.

That my client was forced due to total inaction to serve legal notice as you’re denied to take the
accountability. That if you are not refunding the amount to my client then we will make sure to
move to court and make your charges under Criminal offence. That the following act of yours
can be charged under Cheating and fraudulent activity of Indian penal code ie. As per Sec
Section 415 in The Indian Penal Code. Cheating.—Whoever, by deceiving any person,
fraudulently or dishonestly induces the person so deceived to deliver any property to any person,
or to consent that any person shall retain any property, or intentionally induces the person so
deceived to do or omit to do anything which he would not do or omit if he were not so deceived,
and which act or omission causes or is likely to cause damage or harm to that person in body,
mind, reputation or property, is said to “cheat”. And as per Section 25 in The
Indian Penal Code 25.“Fraudulently”.—A person is said to do a thing fraudulently if he does
that thing with intent to defraud but not otherwise.

I hereby call you to look into the matter with urgency and provide proper resolution by full
refund of the amount paid to you ie Rs.14257/- along with compensation of Rs.5000/- for the
inconvenience and mental harassment you caused to my client within 15 days of receiving this
notice failing which the undersigned shall be free to launch legal proceedings against your act of
Cheating, fraud and damages for which you shall be liable.
