AFFIDAVIT OF WITHDRAWAL OF COMPLAINT

That I, CESAR ROSAL LAMBAYAN, JR., of legal age, Filipino, and a

resident of Purok Garcia, Barangay Sto. Niño, Pagadian City, Philippines, after
having been duly sworn to in accordance with law, do hereby depose and say:

1. That I am the private respondent in NPS No. IX-05-INV-20L-

00230 for Physical Abuse in Relation to R.A. 9262 filed by
IVENE GRACE B. TABUDLONG as private complainant before
the City Prosecution Office of Pagadian City;

2. That after re-evaluating the incidents that brought about the filing
of the said case and its attending circumstances, I and the private
complainant came to a realization that pursuing the case will be
damaging to our mental, emotional, and physical well-being;

3. That I sincerely asked for forgiveness and the private complainant

decided to forgive me in this case, and that we agreed to go our
separate ways in a peaceful manner; hence, she is no longer
interested to prosecute me;

4. That in view whereof, the private complainant decided to desist

from further prosecution of the aforesaid case and she will
WITHDRAW her complaint from pursuing the same;

5. That I am executing this affidavit to have the case WITHDRAWN

for lack of interest on the part of the private complainant to
continue the same.

1. That I am the private complainant in NPS No. IX-05-INV-20L-

00230 for Physical Abuse in Relation to R.A. 9262 against
CESAR ROSAL LAMBAYAN, JR. filed before the City
Prosecution Office of Pagadian City;

no longer interested to prosecute him;

4. That in view whereof, I decided to desist from further prosecution

of the aforesaid case and I will WITHDRAW my complaint from
pursuing the same;

5. That We are executing this affidavit to respectfully pray for the

case to be WITHDRAWN and/or DISMISSED for lack of interest
on my part as the private complainant to continue the same.
