Dear Applicant,

Further to your application regarding the above subject which was provided with supporting documentation,
the Master Developer has no objection for the above said Works subject to the Applicant’s full compliance
with the below conditions.

Specific Conditions:

 RTA Access Approval is required. No work on the site should be done without securing RTA Access
Approval.
 Only interlock work can be done for car access as per RTA’s approval.
 No encroachment to the area in front of adjacent plot is allowed.
 The Plot Owner to bear the cost/responsibility of protecting the underground existing services in line with the
authorities’ requirements and regulations.
 Any Works outside the designated project/Plot limits shall be considered as temporary.
 The site must be accessible 24/7 to Service providers/the Master Developer whenever required.
 Any excavations in the proposed area must be reinstated/removed within a very short notice when required by
Nakheel.
 The work should be done as per the Master Developer’s standards/specifications, and after finishing the work,
the site should be handed over to Master Developer Community Team as per their satisfaction.
 The applicant to coordinate with the Master Developer’s Asset Management Team before commencing the Work
at Site.

General Conditions:

1. The Applicant should obtain NOC-s from all concerned authorities (EMPOWER, LootahBCGas
(Contact Call Center on 800 5224) DEWA (Power & Water) RTA & TRAKHEES) whenever Works
area falls/lay within limits of jurisdiction of those authorities before commencing the Work at Site.

2. The Applicant must submit the traffic management plan to the Master Developer's NOC Center at
Palm Jumeirah for approval prior to commencement of the Works in the event of road closures.

3. Compaction test certificate shall be approved by third certified party and submitted to Nakheel and
shall be part of the clearance certificate request/application.

4. The Master Developer's NOC Center and relevant PMT (project management team) should be given
at least 72 hours advance notice for commencement of Works with indication of anticipated
completion date.

5. Areas of excavation should be demarcated and adequately protected in compliance with applicable
requirements of RTA and Dubai Police and any other relevant authority. Relevant paperwork with
evidence of coordination of Works with noted authorities should be available with The Applicant at
the Site at all times.

6. The Applicant should minimize nuisance to the public in general caused by his Works at the Site and
employ adequate means to ensure completion of Works in the shortest possible time.

7. The Site must be kept dust pollution free with no stockpiles of unattended material. The Site should
be secured from unauthorized entry of public in general. Adequate and safe passages and accesses for
pedestrians around the Site should be maintained at all times

8. The present NOC automatically becomes null and void should the master plan of the district, in which
the Works are being carried out, undergoes modification with subsequent variation of the initial
design. The Applicant should obtain new NOC if the aforementioned master plan changes occur
during the validity of the present NOC. The new NOC shall be at no cost to the Master Developer.

9. The Applicant undertaking the Works in relation to this NOC must observe the following:

o Nakheel environmental management standards consistent with Nakheel's Environmental


Management Requirements (EMR 2009). Emphasis shall be placed upon protecting the
underground utilities and the existing Irrigation and Potable Water lines
o Comply with Nakheel Health & Safety Policy, 2008 - HS/C/D - 001, standards and Project
specific Health and Safety Management Requirements - HS/C/D - 002
o EHS Health & Safety And Fire Protection Regulations & Standards
o All applicable laws, regulations, codes and standards

10. Site Security, and Hoarding shall take into considerate ion all vehicle, and pedestrian movement in
the area of work as per their approved method statements and risk assessments, as well as complying
with legal requirements

11. The Applicant should render measures of extreme caution while working in the proximity of existing
underground/overhead / utility services plant and cables.

12. This NOC does not absolve The Applicant from the responsibility for any damage(s) to the property
of others caused by him.

13. Discharge of the dewatering water to the Master Developer's storm water or sewerage system is strictly
prohibited. In case of any such occurrence the present NOC will be immediately revoked and the
Applicant will be requested to vacate the Site immediately and pay for any costs incurred as a result
from this breach.

14. Noise pollution is to be kept to a possible minimum to avoid nuisance for local residents.

15. The Applicant must reinstate all roads, footpaths and street furnishing in their pre-existing condition
prior to commencement of the Works. Adequate number of photos of the Site should be taken prior
to commencement and at the time of completion of Works for this purpose. All abovementioned
should be carried out in presence of and to satisfaction of a representative of the Master Developer

16. The Applicant should carry out careful hand excavation for location of utility services plant in the area
of Works. No excavation shall be permitted closer than 300 mm from the anticipated location of an
existing services plant.

17. Landscaping must be reinstated at the Applicant's expense. Landscaping is deemed to include all grass,
trees, shrubs and irrigation pipelines (if applicable).

18. The Applicant must submit with the Master Developer's NOC Centre and PMT emergency contact
details of his staff in-charge. These details should be posted at the Site and be clearly legible.

19. The Master Developer reserves the right to revoke the present NOC for its convenience at any time
upon providing the Applicant with a one week notice
