PARKING LOT LEASE AGREEMENT

KNOW ALL MEN BY THESE PRESENTS:

This contract of lease is executed and entered into by and between:

RIZALDY and ODETTE UMALI, REYNALDO JR. and EVELYN UMALI,


RANDOLPH and AYZA UMALI, REYOLYN and MICHAEL DILODILO, represented by
REYNALDO UMALI JR., Filipino, of legal age, and with residence and postal address at 26
Gardenia Homes, General Ordonez Street, Parang, Marikina City, hereinafter referred to as
the “LESSOR”.

AND

_____________________________________, Filipino, of legal age, with residence and


postal address at

hereinafter referred to as the “LESSEE”.

WHEREAS, the LESSOR is the CARETAKER of a residential property situated at 95-


____ Paraiso Street, Parang, Marikina City.

WHEREAS, the LESSEE has found the size and location of the LESSOR’S residential unit
with an area of one hundred (100) square meters, more or less, to be ideal and the most suitable to
their needs and is desirous of said leasing space.

NOW, THEREFORE, for and in consideration of the foregoing premises, the parties have
agreed and accepted the following to be the terms and conditions that will govern the lease, and which
will be observed by both in good faith:

1. The lease shall be a period of twelve (12) months commencing on


_______________________ to _________________________. There shall be no tacit renewal of this
Contract of Lease notwithstanding the continuation by the LESSEE in the possession of the leased
premises for any period of time after the expiration of the term of the lease, in which case the lease
shall be deemed to have been renewed on a month-to-month basis and can be terminated by the
LESSOR at the end of every month;

1.1 The LESSEE shall strictly use the leased property for residential purposes only.
Accordingly, the LESSEE shall use, maintain, and continuously occupy the leased property
solely for this purpose. Use of the Leased Property other than the intended use shall not be
permitted without the prior written consent of the LESSOR.

2. The monthly rental shall be ____________________________________ (PHP


___________), Philippine currency. The LESSEE shall pay monthly rental on or before 1st day of
each month. LESSEE shall be charged a penalty of five percent (5%) per month of the amount due to
the LESSOR until the same is fully paid.

2.1 A security deposit in the amount of PHP ___________________ and an advance


rental in the amount of PHP ____________________ applicable on the first month of the
term of lease shall be paid or remitted by the LESSEE to the LESSOR upon signing on this
contract of Lease.

2.2 A security deposit shall be forfeited in favor of the LESSOR should the LESSEE fail
to complete the term of the lease except if such failure is due to any fortuitous event,

2.3 A security deposit shall likewise be made to answer for unpaid taxes for any
improvements introduced by the LESSEE in the leased premises; electricity, water, and other
utility charges and general services incurred by the LESSEE, but which may be left unpaid
and charged against the LESSOR; cost of repairs as well as undertaken by the LESSEE as
part of her obligations as such.

2.4 Upon expiration of the term of lease, the LESSOR shall, without need of prior
judicial determination, immediately re-enter, renovate or relet all or part of the Leased
Property to third parties. The security deposit will be returned to the LESSEE without
interest, and net of any amount which LESSEE is liable to pay the LESSOR after LESSOR
has cleared LESSEE of all liabilities. The security deposit shall never be applied for rentals
due and owing to the LESSOR.

3. The LESSEE shall erect at its own expense fixed improvements and/or alterations when
specifically permitted and only upon the written approval by the LESSOR of the construction plans.
All fixed improvements shall belong to the LESSOR at the end of the term of the lease without any
obligation on the part of the LESSOR to refund its value or cost to the LESSEE.

4. The LESSEE may install air conditioning units and other removable furnishings, appliances
and decorative items within the leased property which shall remain the property of the LESSEE. The
LESSEE shall see to it that the removal of these items shall not cause any damage to the leased
property.

5. Electricity, water, other utility charges and general services shall be paid by the LESSEE.
Any general services engaged by the LESSOR for the unit shall be paid by the LESSOR except when
specifically agreed upon. It is understood that the LESSOR shall not be liable for any stoppage,
absence, failure or deficiency in such utilities and services.

6. The LESSEE will be responsible for repairs of the unit due to normal wear and tear, willful
acts, carelessness, negligence, or fault of the LESSEE.

7. The use of the unit shall be exclusive for residential purpose and the LESSEE cannot assign
or sublease unit without the written consent of the LESSOR. The LESSE hereby agrees to keep
premises in good, tenantable, and sanitary condition.

8. The LESSEE agrees to abide the rules and regulations, and shall comply with the laws and
ordinance, regulations, and orders of the national or municipal government arising from or regarding
the use, occupancy, sanitation of the leased premises. Failure to shall comply with said laws,
ordinance, regulations, or orders shall be the exclusive risk and responsibility of the said LESSEE.

9. At anytime before the expiration of the stipulated term, or any renewal thereof, the LESSOR
may pre-terminate this Lease Agreement without need of any prior judicial determination by serving a
written notice of pre-termination upon the LESSEE at least fifteen (15) days before the intended date
of pre-termination upon any violation by the LESSEE of any of the terms, covenants, stipulations, and
conditions of the Lease Agreement. Thereafter, the LESSOR shall, without need of judicial
determination, immediately re-enter, renovate, or relet all or part of the Leased Property to third
parties, and cancel all rights and privileges granted to LESSEE without any restriction on recovery by
the LESSOR for unpaid rents, fees, and damages owed by the LESSEE.

9.1 In case of pre-termination attributed to the fault or negligence of the LESSEE, the
LESSOR may retain and forfeit all unused rental payments and security deposit by way of
penalty to cover its lost income opportunity. Moreover, the LESSEE shall pay in full amount
all its utility bills to the LESSOR within a period of five (5) days from the date of pre-
termination.

9.2 The LESSOR may, without need of any prior judicial determination, cancel, or
terminate this Contract of Lease if the LESSEE commits any of the following:

9.2.1 The LESSEE fails to pay any single monthly rental payment and/or any sum
due to herein.

9.2.2 The LESSEE uses the leased property for the purpose other than those
specified herein.

9.2.3 The LESSEE violates any of the terms and conditions of this Contract of
Lease.

10. The LESSOR or its authorized person shall, with prior approval of and by previous
arrangements with the LESSEE, except in case of emergency, have the right to enter the leased
premises to examine the same or make alterations or repairs or for any purpose which it may deem
necessary, for the operations or maintenance of the unit or its installations, and to show the unit to
prospective tenants.

11. The failure of either party to insist upon strict performance of any of the term, conditions and
covenants hereof shall not be deemed as relinquishment or waiver of any rights or remedy that such
party may have, nor shall it be construed as a waiver of any subsequent breach or default of terms,
conditions, and covenant hereof, which terms, conditions and covenants shall continue to be in full
force and effect. No waiver of any rights under this contract shall be deemed to have been made
unless expressed in writing and signed by the party making the waiver.

12. Any suit, action or proceeding under this agreement shall be field in the regular courts of
Marikina City only.

IN WITNESS WHEREOF, the parties hereunto set their hands at the bottom of this page
and at the left margin of all pages of this Contract of Lease on this __________ day of
