1. Reference: Memorandum dated July 20, 2023 from OIC, RLO 4A with
subject: “Endorsement re Request for Legal Assistance/Representation of PCPT
RODRIGO C VALIENTE et al., for Misconduct (Damage to Property, Threat,
Coercion) docketed No Case Number yet.”

2. This pertains to the request for legal assistance/representation of PCPT


RODRIGO C VALIENTE, Pat Jomar M Regodon, Pat Rogen T Ocampo, Pat Bon
Devi G Paa, Pat Raymart John G Orcas, Pat Mark Kevin Dela Cruz, Pat Alfredo M
Simbrano Jr., and Pat John C Torres, relative to the administrative complaint for
Grave Misconduct (Damage to Property, Threat, Coercion).

3. Based on records, on February 4, 2023 at 8:00 AM, elements of 4th


Maneuvre Platoon of Cavite Provincial Mobile Force Company led by PCPT
RODRIGO C VALIENTE conducted a checkpoint at Juanito Remulla Road Sitio
Quarry, Brgy Sapang 1 Ternate, Cavite to implement traffic laws and Provincial
Executive Order No.7 Series of 2021 declaring Kaybiang Tunnel and its nearby
areas as "NO TOURISM ZONE”. Purportedly, several violations of the said rules
were committed such as lack of sanitary facilities, lifeguards on duty, parking areas
and business permit thus a checkpoint was conducted. Thereafter, complainants
arrived and without any reason intervened, prevented the checkpoint and berated
herein applicant-respondents questioning the legality of the establishment thereof
and their authority to conduct the same.
4. Claiming that applicant-respondents destroyed the old and abandoned
Municipal Health Center and further threatened and coerced the complainants, the
latter initiated this administrative case for grave misconduct hence this request for
direct legal representation.

5. After careful review of the documents submitted and endorsed OIC,
RLO 4A, this Division finds the said case to be service related/ connected, compliant
with the requirements set forth in PNP MC 2017-062 and is hereby recommended to
be approved. Further recommend PCPT JEARE B AGRA to be designated as Legal
Counsel of the subject PNP personnel and be provided with necessary fund support.

6. Respectfully recommend approval of paragraph 5 and signature on the


attached Memorandum for PCPT JEARE B AGRA.

conducted; copies of pleadings, motions and memoranda prepared; including the
status of the case to the Legal Assistance Division on or before the 25 th of each
month.
