MOTION TO EXPLAIN

This motion pertains to the Order of the Honorable Court received by the

defendants-appellants dated September 1, 2022, regarding the failure on the part of the

defendants-appellants to attend on the said date of Judicial Dispute Resolution.

In line with this, the defendants-appellants’ failure to attend the hearing was due

to some confusion on the mere technicalities of the rules of procedure that were not

clearly presented and provided by the previous lawyers, hence the multiple availment

of the legal services of the latter. In connection with this, the defendants-appellants

failure to appear were inadvertently committed, and that even the material dates of the
hearing set by the court were not answered and attended to by the defendants-

appellants.

Thus, the defendants-appellants are humbly praying unto this Honorable Court

that an order granting the appellants-defendants to submit their Record on Appeal to

hear its meritorious defense and to be given full consideration, and to be heard in the

exercise of equality, just and fair play.
