ORDER
Sri P. Jithender Reddy, R/o Hyderabad filed 2nd appeal dated 13-07-2020 which was
received by this Commission on 14-07-2020 for not getting the information sought by him from the
PIO / O/o The Telangana State Waqf Board, Razzak Manzil opp Public Garden, Nampally,

The brief facts of the case as per the appeal and other records received along with it are that
the appellant herein filed an application dated 08-02-2020 under Sec.6(1) of the RTI Act, 2005,
before the PIO seeking the following information:

The Public Information Officer through vide ref No.118/RTI/RR/2020 date 19-03-2020
rejected to furnish information as details of institution were not mentioned.

Since the appellant did not receive the information from the Public Information Officer, he
filed 1st appeal dated 21-03-2020 before the 1st Appellate Authority requesting him to furnish the
information sought.

As per the records enclosed it is noticed that the 1st Appellate Authority had failed to hear the
case and pass appropriate orders on the 1st appeal filed before him.

As the appellant did not get information from the Public Information Officer, he preferred
this 2nd appeal before this Commission requesting to arrange to furnish the information sought by
him.

The 2nd Appeal was taken on file and notices were issued to the parties concerned for
hearing on 13-12-2021.

On 13-12-2021 the case is called. The Appellant is present. The PIO / O/o. the Telangana
State Waqf Board, Razzak Manzil, Nampally, Hyderabad is present. The First Appellate Authority /
O/o. the Telangana State Waqf Board, Razzak Manzil, Nampally, Hyderabad is absent.

The Appellant submitted that he did not receive the sought information from the PIO.

The Public Information Officer submitted that the notice from the Commission was received
on 10-12-2021 and as such he could not verify the records due to non availability of time and hence
requested to adjourn the case by granting (15) days time.

 The Commission directs the PIO to communicate a date for inspection of the connected
records and furnish the required information on payment of cost. The entire process shall be
completed within (30) days and submit compliance to this Commission.

With the above direction, the Appeal was adjourned to 16-09-2022.

On 16-09-2022 the case is called. The Appellant is present. The Public Information Officer
/ Superintendent, O/o the Telangana State Wakq Board, Hyderabad is present. The 1st Appellate
Authority is absent.

The Appellant submitted that he did not receive the sought information from the Public
Information Officer.

The Public Information Officer submitted that the appellant has not mentioned the name of
the Wakq institution and correct file number and hence rejected to furnish information. However, he
has assured to furnish information to the appellant within (7) days.

Heard both the parties and perused the records.

The appellant in his 6(1) application sought to provide the details of survey numbers and
extent of wakq lands in Kongara Kurdu village, Maheshwaram mandal and he furnished the
available file number.

The Commission is of the view that the Public Information Officer cannot expect the

appellant to furnish file number etc. The details of wakq lands in Gatkesar mandal must be available
in the records.

Therefore, the Commission directs the Public Information Officer to furnish the details of all
wakq lands existing in Kongara Kurdu village, Maheshwaram mandal to the appellant by RPAD
within (30) days and submit compliance to the Commission.

With the above direction, the Appeal was adjourned to 27-01-2023.

On 27-01-2023 the case called. The Appellant is present. The Public Information Officer /
Superintendent, O/o the CEO, TS Wakf Board, Hyderabad is present. The 1st Appellate Authority
is absent.

The Appellant submitted that he did not receive the sought information from the Public
Information Officer despite the direction of the Commission.

During the last hearing the Public Information Officer assured to furnish information within
(10) days and accordingly directions were issued to the Public Information Officer but the Public
Information Officer failed to furnish the information as assured. Instead the Public Information
Officer submitted a letter dated 26-10-2022 addressed to the appellant stating that the file mentioned
by him of 2018 is not readily traceable etc.,

The Commission took serious note of the rejection made by the Public Information Officer
and disobedience of the orders of the Commission. The appellant furnished ample details in his 6(1)
application viz. survey numbers, extent, village and mandal etc.

Therefore, the Commission once again directs the Public Information Officer to furnish
details of all wakf lands existing in Kongarakurdhu Village in Maheshwaram mandal to the
appellant by RPAD within (15) days from the date of receipt of this order and submit compliance to
the Commission. Otherwise penalty shall be imposed by issuing Show Cause Notice.

With the above direction, the Appeal is closed.
