AFFIDAVIT OF ADVERSE CLAIM


I, ROLANDO M. ROJAS, of legal age, Filipino, with address at McKinley Hills
Village, Taguig City, after having been sworn to in accordance with law, do hereby
depose and state:

1. That I am filling a NOTICE OF ADVERSE CLAIM on the property situated


at Bagac, Bataan covered by TCT NO. CARP-2017000024, registered under
the name of REMEDIOS Z. DEMILLO, widow, described as follows:

The complete technical description of the property is contained in the copy


of the title attached hereto as ANNEX “A”.

2. That on January 06, 1996, REMEDIOS Z. DEMILLO received from the


undersigned-affiant, Rolando M. Rojas, the amount of ONE HUNDRED
THOUSAND PESOS (PhP100,000.00) as partial payment for the sale of a
parcel of land in Bagac, Bataan awarded to REMEDIOS Z. DEMILLO as
CARP beneficiary, covered by collective CLOA Title No. 00926696. The
copy of the Acknowledgement Receipt and the collective CLOA title is
attached hereto as ANNEX “B” & “C” respectively.

3. That upon receipt of the above amount in 1996, the parties were not able to
execute a DEED OF ABSOLUTE SALE because the individual titles
pertaining to the collective CLOA have not yet been issued and registered
under the names of the individual beneficiaries at that time.

4. That REMEDIOS Z. DEMILLO, promised to execute a Deed of Absolute


Sale in favor of ROLANDO M. ROJAS, upon the issuance and registration of
the individual transfer certificate of title under the name of REMEDIOS Z.
DEMILLO.

5. However, upon registration of the individual title in January 12, 2015 in the
name of REMEDIOS Z. DEMILLO, under TCT No. CARP-2017000024,
REMEDIOS Z. DEMILLO refused to honor the sale and to receive the full
amount and execute a Deed of Absolute Sale in favor of the undersigned
Rolando M. Rojas. That despite repeated demands, REMEDIOS Z.
DEMILLO still refused to execute a Deed of Absolute Sale and deliver the
title to the undersigned.

6. That considering that REMEDIOS Z. DEMILLO had received the partial


payment which constitute a valid consideration for the sale of the said parcel
of land, the refusal to accept the full amount and execute a Deed of Absolute
Sale and deliver the title to the undersigned ROLANDO M. ROJAS are basis
for annotation of an adverse claim on the title of the said property.

7. That I am therefore executing this Affidavit to attest to the truth of the


foregoing facts in support of my request addressed to the Office of the
Register of Deeds of Bataan for annotation of an ADVERSE CLAIM on the
parcel of land covered by the above stated TCT No. CARP-2017000024.
