AGREEMENT
This Deed of agreement is executed at Faridabad on this20th day
of_Jume , 2001 between_ sit, Barkha w/o sh, shyam sunder Kaush
(hereinafter galled the Seller) of the Ist Party and_sh Krishan Kumar
—Satowan_s/o Sh, Tle Ram (hereinafter called the purchaser) of
the 2nd party.
Whereas the first party is the allottee of house in sector-03
YANO, #55/FF_4.5.0olony,Faridabad, allotted by the Deptt-of Housing
Baord Haryana, vide Regn./Allotment No.1017 dt. 20/05/2001
And whereas the first party is mot in a position to pay the
balance instalments of the said house and want to sell the above said
house therefore, first party is hereby agreed to transfer rights of
the said house No. 4555ypp., Sector_=03 _, Faridabad in favour.of the
gnd party for a total consideration of Rs.50;000/= _(Rupees_pisty
thousand my ) ) on the following terms and conditions:
1. That the first party have recieved a sun of Rs.50,000/—
being the full and final consideration of the said house from the
2nd party.
2. That the said house is free from all encumbrances except hire
purchase with the Deptt.of Housing 8oard Haryana.
3. That the first party have handed over the all documents/physical
and vacant possession to the 2nd party.
4. That the balance amount due to the HEH shall now be paid by the
2nd party at his own costs, risks and responsibility. if 2nd party
shall not make the instalments in time and any loss or losses
occured due to non payment of any dues, the 2nd party shall be
responsible for the sama. The first party shall not be responsible
for making any payment on account of the said house.

That at present the Deptt.of HBH does not accepting the transfer
of the said house,therefore, as and when the said Deptt.shall
accept the said house whether the making the full payment or
earlier, the first party or his Regd.Attorney shall got the said
house transferred in the name of 2nd party or his any nominees
name. If the name of the first party cancel the said attorney, the
2nd party shall got to the court of law and entitled to get the
sale deed regd.through SPECIFIC PERFORMANCE OF CONTRACT and 2nd
party will also entitled the cost of the suit which shall be borne
by the 2nd party indefending with the said house.
6. That the first party and his/her legal heirs shall no concern
whatsoever with the said house.
7. That the first party has/have handed over the relevant Original
documents relating to the said house to the 2nd party.
8. That the first party shall fulfill the terms and conditions of
this agreement till the sad house is transferred in the name of
the 2nd party. If the first party shall not fulfill the said house
is transferred in the name of the 2nd party, the 2nd party shall
be entitled to get the said house is transferred in name of the
2nd party.
