Moral, general legal and financial arguments for ALL actions

Moral, general legal and financial arguments Moral
Prestige engineering will indeed bear a moral obligation towards its employees. The company’s code of
ethics will encompass essential values like honesty, accountability, & openness with regard to its
workforce. In its pursuit of enhancing productivity the company will prioritize creating a secure working
environment for its employees. Furthermore, there will be a culture of mutual respect among workers at the
workplace. Should an accident occur as a result of the company’s failure to implement safety measures, it
will have detrimental repercussions on both the company’s productivity and reputation. Prestige
engineering WLL is committed to ensuring the health and safety of its Employees and workers
Legal
Prestige engineering WLL Adheres to the necessary legal safety standards to ensure the well being of its
employees. These standards are established in accordance with the ILO (International Labor Organization)
code of practices, which is delineated in various conventions aimed at creating a secure work environment
and promoting good mental health. The company conducts SSOW (SAFE SYSTEM OF WORK) risk
assessments to effectively identify and manage potential hazard there by ensuring compliance with legal
requirements.
In the event that the company fails to meet these legal obligations, employees have the right to seek
recourse through civil court proceedings they may also seek compensation for the injuries sustained,
treating such instances as criminal offenses in 1988, the ILO,s General conference recommended the
implementation of Law C157,which specifically addresses safety and health standards in the industrial
production facility
Financial
In the realm of production finances there are two categories of costs to consider: insured cost and uninsured
cost. Insured costs encompass expenses related to worker insurance, while uninsured costs involve damage
to materials, equipment’s, production facility & legal expenses. Its worth nothing that uninsured costs often
outweigh insured ones, but this imbalance can be rectified by enhancing production speed and reducing
absenteeism.

Justification for action 1
Action (Taken from column 4 of risk Install closed-circuit television (CCTV) monitoring at the production facility
assessment) hazard category (safe movement of people).
Specific legal arguments In accordance with the R175 (1988) recommendation, it is imperative to ensure the safety and health of
production facility personnel. This entails thorough training of drivers in compliance with the country’s
regulations. Furthermore, as per the ILO C167(1988) convention, it is the responsibility of the firm to
establish distinct pathways for pedestrians & vehicles, complete with designated crossing areas.
Additionally, drivers are expected to adhere to traffic regulations and speed limits.

Consideration of likelihood AND severity Excessive speeding by drivers poses a common safety hazard in the interaction between people and
vehicles, elevating the risk of accidents and worker injuries. Unsafe loading and unloading practices
● types of injury or ill health further contribute to this high-risk environment.
● number of workers at risk Negligent driving behaviors can lead to injuries, illnesses and even fatalities, particularly for pedestrians
● how often the activity is carried out and workers who may be struck crushed or run over.
● how widespread the risk is Around 77 workers face potential risks during loading and unloading tasks across the production facility,
with vehicle movements primarily occurring during daylight hours when workers are most vulnerable.
Effectively mitigating these risks relies on hiring skilled and qualified drivers
Severity levels are categorized as follows
 Low no injuries
 Medium minor injuries requiring first aid
 High injuries necessitating hospitalization
 Catastrophic fatal accidents
Vehicle-pedestrian collisions can result in severe injuries and fatalities ,& the condition of the vehicle
can be worsen in impact.
How effective the action is likely to be in The implementation of CCTV surveillance cameras effectively lowers accident risk and minimizes the
controlling the risk. This should include: likelihood of collisions. i.e. through continuous monitoring and real time video recording CCTV
Surveillance cameras provide enhanced visibility and situational awareness, allowing for timely

Justification for action 2
Action (Taken from column 4 of risk Provide double insulated armade cables
assessment) Hazard category electricity

Specific legal arguments The company has a legal obligation to furnish high quality electrical equipment’s to prevent accidents at
the workplace. Article 26 ILO C167- Safety and health convention outlines the employer’s legal
responsibilities towards their workers .it specifies that all necessary electrical equipment should be
authorized, correctly installed and maintained by a competent individual to reduce the likelihood of the
accidents. Additionally, the placement of electrical cables and other equipment must adhere to the country
rules and regulations. Prior to commencing work, equipment must undergo authorization. Furthermore, in
order to ensure safety and health machinery and equipment with minimal risks must be provided and
maintained. Adequate inspection and maintenance of electrical equipment are crucial to prevent electrical
hazards including short circuits, electrical shocks, fires, and explosions.
Consideration of likelihood AND severity The risk of danger in high when workers encounter low-quality cables instead of double-insulated ones,
leading to potential injuries or fatal from electrical shocks. Severe cable damage or contact with sharp

● how often the activity is carried out risk in the production facilities, electrical dept, performing essential electrical tasks throughout the facility.
● how widespread the risk is Inadequate wiring and improper grounding can worsen hazards, elevating the risk of electric shocks, burns,
arching, fires, and explosions.
The severity of the electrical hazard can be categorized in to four
 No injury or damage occurred.
 Minor - first aid for the injury
 Major – hospital treatment is required due to heart attacks/skin burn
 Catastrophic-Death /disability occurred due to electrocution /explosion
The severity of injuries depends on factors like cardiac arrest, heart attacks, and burns with death possible
due to asphyxiation or severe electric shock.
How effective the action is likely to be in Installing of double insulated cables not only provides protection against short circuits and fires but also
controlling the risk. This should include: minimize the risk of electrical shock. Rigorous inspection of electrical equipment’s are carried out to
enhance safety and additional circuit breakers are incorporated within the DB distribution box to further

control the risk specified needs, which is expected to be completed within in one month. To mitigate the risk effectively,
the approach involves the incorporation of supplementary circuit breakers, along with comprehensive
training and diligent supervision of the workforce. Additionally, the plan entails acquiring new ELCB units
to promptly trip circuits in order to protect workers from potential electric shocks and hazards.

Justification for action 3
Action (Taken from column 4 of risk Emergency alarm system for confined space
assessment) Hazard category confined space
Specific legal arguments 2001 confined space regulations were reinforced to prioritize the safety of workers. ILO Convention
The Confined Spaces Regulations 1997 (1997 No. 1713) (GBR-1997-R-95001) Protection against
particular hazards These legal provisions required organizations to establish emergency protocols
specifically designed for confined spaces, ensure swift response during crises. Additionally, they mandated
the provision of fire-resistant personnel protective equipment (ppe) for workers entering confined spaces
coupled with rigorous training in emergency evacuation procedures.
Recognizing the potential presence of dangerous gases, the regulations also stipulated the availability of
self-contained breathing apparatus (Scba) complete with oxygen cylinders for workers. This equipment was
crucial in enabling them to navigate and address hazardous situations safely. These legal measures
collectively emphasized the paramount importance of worker safety within confined spaces. Reflecting a
steadfast commitment to maintaining the highest standards of occupational protection and risk reduction.
Consideration of likelihood AND severity Workers engaged in hot work activities within a boiler vessel face significant risks, including the
generation of toxic fumes like cadmium and dust particles, which can lead to fires and explosions.
● types of injury or ill health Moreover, there's a heightened risk of oxygen deficiency, potentially resulting in fatalities. Confined spaces
● number of workers at risk pose various hazards, such as low oxygen levels, exposure to air contaminants, fires, explosions, and
● how often the activity is carried out engulfment, all capable of causing fatalities. Additionally, level 2 injuries, like fractures and spinal injuries,
● how widespread the risk is can occur in such constrained environments the likelihood of confined space is very high
Low- no injury
 Minor -first aid is necessary
 Major -the injury necessitates hospital treatment
 Catastrophic- the outcomes is fatal resulting in death
In the boiler vessel (confined space) workers may experience discomfort due to oxygen depletion and
fatigue caused by limited mobility. The severity of potential injuries significantly high in the presence of
toxic gases within the confined space.
How effective the action is likely to be in Implementing an emergency alarm system with confined spaces is crucial to safeguard the wellbeing of our
controlling the risk. This should include: workers during unexpected emergencies. I have allotted a 3 month timeframe to complete the required
tasks and have already approached the production manager to initiate the procurement of the emergency
 The intended impact of the action; alarm system. The production manager will be informed and prepared to respond effectively in emergency
 justification for the timescale that you scenarios by developing a comprehensive emergency plan that encompasses the installation and
