This the case in which, in the first instance, the petitioner has
filed
the Petition under section 5 of the Kamat*^ka scheduled cases and
scheduled Tribes (prohibition of Transfer of certain Lands)
Act, 197g
representing that she belongs to scheduled caste;
that her husband
Muniyappa s/o Poojappa was granted the land in S.No.55
measuring

at Bellahalli village, yelahanka Hobli, Bengaluru North (Addl.) Taluk,
is
s€E aside. In furtherance the mutation if any accepted
by virtue of the sale
deed No.302211996-97 dared 16.10.1996 as well as by virrue of
subsequent sale deeds, ifany, they are also set aside.

Further, it is ordered to restore the Khata of the land in s.No.55/pl

measuring 4A.00 situated at Bellahalli village, yelahanka Hobli,
Bengaluru North (Addl.) Taluk, in the name of Muniyappa s/o poojappa
as stood before. But, as at present, since Muniyappa is deceased,
the
inheritance of the said land be made in the name of his wife and
legal heir
Smt.Lakkamma w/o Late Muniyappa as per rules and regularize
the
entries in the revenue records such as RTCs etc.

The Tahsildar, Bengaluru North (Additional) Taluk, Bengaluru

shall take necessary action as directed above.

In the result, the Appeal is liable to be allowed.

Accordingly, the Appeal is allowed.

Endorse the parties.
