Agreement of Easement of Right of Way 2
This AGREEMENT OF EASEMENT OF RIGHT OF WAY, made and entered into by and among;
RAFAEL QUIROY, Filipino, of legal age, married to Flaviana A. Quiroy and a resident of Mansasa District,
Tagbilaran City, hereinafter called the FIRST PARTY,

ELVIRA S. AGANG-ANG, ROGELIO A. SARABIA, NOLI A. SARABIA and MERELEN Q. PALMA, Filipinos,
of legal ages, all married and a resident of Mansasa District, Tagbilaran City, hereinafter called the SECOND
PARTY,
WITNESSETH
WHEREAS, the First Party is the registered and lawful owner of a parcel of land situated in Mansasa
District, Tagbilaran City, and more particularly described as follows, to wit:
“A parcel of land (Lot 2-A, of the subdivision plan, Psd-07-047753, being a portion of Lot 2 (LRC)
Pcs-11477), situated in the arangay of Mansasa, City of Tagbilaran, Province of Bohol, Island of Bohol.
Bounded on the NW., along line 1-2 by Lot 8, Tagbilaran Cadastre; on the NE., along line 2-3 by Lot 3 (LRC)
Pcs-11477; on the SE., along line 3-4 by Lot 2-B of the subdivision plan; on the SW., along line 4-1 by Lot 1,
(LRC) Pcs-11477. x x x Containing an area of ONE HUNDRED TWENTY EIGHT (128) SQUARE METERS,
more or less.”
WHEREAS, the Second Party are the lawful owners and actual possessors of a parcel of land
situated in Mansasa District, Tagbilaran City, which parcel of land is situated in the interior portion and has
no existing access to the nearest public road, and more particularly described as follows, to wit:
“A parcel of land (Lot 2-B, of the subdivision plan, Psd-07-047753, being a portion of Lot 2 (LRC)
Pcs-11477), situated in the Barangay of Mansasa, City of Tagbilaran, Province of Bohol, Island of Bohol.
Bounded on the SW., along line 1-2 by Lot 1 (LRC) Pcs-11477; on the NW., along line 2-3 by Lot 2-A of the
subdivision plan; on the NE., along line 3-4 by Lot 3 (LRC) Pcs-11477; on the SE., along line 4-1 by Lot 812,
Tagbilaran Cadastre. x x x Containing an area of SEVEN HUNDRED (700) SQUARE METERS, more or
less.”
WHEREAS, in order to have an access to and from the above-mentioned parcel of land coming
from the nearest public road/barangay road, it would be necessary for the SECOND PARTY to pass
through the land of the FIRST PARTY, which is used as Road-Right–of-Way and which is less burdensome
to the herein parties;
WHEREFORE, in view of the foregoing premises, the FIRST PARTY hereby voluntarily grants the
SECOND PARTY to have a permanent easement of right of way over his above-mentioned property,
limited to not less than four (4) meters wide, and is specifically described as follows:
“A parcel of land (Easement of Right of Way, 4.00 meters wide), being a portion of Lot 2-A, Psd-
07-047753), situated in the District of Mansasa, City of Tagbilaran, Island of Bohol. Bounded on the northern
portion by Lot 3 (LRC) Pcs-11477; on the eastern portion by Lot 2-B , Psd-07-047753; on the southern
portion of this lot; and on the western portion by Lot 810-C, (LRC) Psd-281596. x x x Containing an area of
THIRTY (30) SQUARE METERS, more or less.”
It is further agreed that the FIRST PARTY shall deliver unto the SECOND PARTY all the
necessary papers, deeds, and titles in relation to the servient estate in order to facilitate the registration of
the above-mentioned right of way, in accordance with law.
This agreement shall be binding between the parties and upon all their heirs, successors, and
assigns.

ACKNOWLEDGMENT
who made known to me to be the same persons who executed the foregoing Agreement of Easement of
Right of Way, consisting of three (3) pages, and they acknowledged to me that the same is their free act
and deed.
