AGUSAN SUR NATIONAL HIGH SCHOOL

EMPLOYEES ASSOCIATION

CONSTITUTION AND BY-LAWS

PREAMBLE

We, the employees of Agusan del Sur National High School, for the purpose of supporting one
another in practicing the best instructions, upgrading professional growth, being globally competitive, being
agents of moral resurgence, being the institution of truth, justice and knowledge do hereby enact and
promulgate this by-laws and constitution, with the aid of our Almighty God, for all the educators of this
institution.

ARTICLE I
NAME AND PURPOSE OF ORGANIZATION

SECTION 1. The name of the organization shall be known as AGUSAN SUR NATIONAL HIGH SCHOOL
EMPLOYEES ASSOCIATION (ASNHSEA), hereinafter referred to as the association, with the
name being written in proper sequence with no deviations, and have an office at Agusan Sur
National High School, San Francisco, Agusan del Sur.
SECTION 2. Purpose of Organization
2.1 This association is established for the mutual aid and protection of its members.
2.2 This association shall:
2.2.1 Provide leadership among the teachers in the school towards the successful
realization of a goal, a mission or an activity duly convened and approved by the
association;
2.2.2 Clarify any issue in question with respect to the association, its members, officers
and activities;
2.2.3 Define the duties and responsibilities of the association member;
2.2.4 Define the sanctions and penalties to be bared by the erring association member or
officer against the rules and regulations duly constituted by the association;
2.2.5 Serve as a welfare station that improves, upgrades, uplifts or develops professional
growth among its members and officers for the betterment of the educational quality of
the school;
2.2.6 Aid financially for medication and hospitalization of the member only and a mortuary
assistance to the member only; and
2.2.7 Hone the moral and spiritual well-being of every officer or member.
ARTICLE II
DEFINITION OF TERMS

SECTION 3. Terms are referred as follows:


3.1 Association. The word “association” in this document shall refer only to the AGUSAN DEL SUR
NATIONAL HIGH SCHOOL EMPLOYEES ASSOCIATION and none else.
3.2 Employee. Comprise of teaching and non-teaching personnel, to hereby specified – principal,
officer-in-charge, school department heads, regular permanent teacher assigned to the any
grade level, substitute teacher, class advisers, floating teacher, Special Education teacher,
Alternative Learning System teacher, School Medical Team (e.g. Nurse, etc.), and other
personnel hired to adopt, practice or execute an act of teaching to the students.
3.3 Duties. Duties refer to every responsibility or duty of the association member as defined under
Article IV and VI.
3.4 Officers. Refers to the club officers of the AGUSAN DEL SUR NATIONAL HIGH SCHOOL
EMPLOYEES ASSOCIATION.
3.5 Member. Refers to whomever teaching or non-teaching personnel of Agusan del Sur National
High School.
3.6 School. “School” in this document refers only to Agusan del Sur National High School.

ARTICLE III
MEMBERSHIP AND FEES

SECTION 4. Membership
4.1 Every bona fide teacher and employee of Agusan del Sur National High School shall voluntarily
be a member of the club with signed membership form regardless of his or her length of service.
4.2 Members of the faculty club with designation as administrative officials shall be disqualified
from being voted to any faculty club office during their tenure as such.
SECTION 5. Membership Fees
5.1 A membership fee of Php 200.00 shall be paid upon membership and will be utilized by the
association to organize various activities as revolving funds.
5.2 The funds collected shall be deposited to ASTECCO, a well-recognized cooperative in the
countryside.
ARTICLE IV
COMPOSITION OF CLUB OFFICERS AND TENURE

SECTION 6. Composition of Association Officers


6.1 The club has to be constituted of twelve (12) offices and twelve officers -- the president, the
vice president, the secretary, assistant secretary, the treasurer, the two (2) auditors, the business
manager, the Public Information Officer and three (3) Board of Directors. All officers shall work
harmoniously to carry the purposes by which the club is founded upon.
SECTION 7. Tenure
7.1 Each office of the club has to serve one (1) term of office in the same position and can be re-
elected in a different position thereafter, as long as he/she is voted by the majority. Each club
officer shall exercise their rights, duties, responsibilities, and privileges of his office right after the
election has been made.

ARTICLE V
ROLES, RESPONSIBILITIES, AND RIGHTS

SECTION 8. Roles and Responsibilities of Association Officers


8.1 President. The president shall oversee the overall condition and wellbeing of the club. He or
She shall also put into assurance that every club member is executing their duties and
responsibilities according to the club’s rules and regulations.
8.2. Vice President. The vice president shall assume full responsibility of club leadership in the
absence of the president. However, the body has to inform the president about the actions and
decision undertaken by the body.
8.3 Secretary. All documents concerning the club shall be of the proper care and obligation of the
secretary. He or she shall bare records on the club’s meetings, activities, memorandums, etc.
Aside from the president, the secretary has the sole right on keeping and drawing any record or
document belonging to the club.
8.4 Asst. Secretary. He or She shall be in-charge of the roll call of attendance during meetings,
shall make communication letters, and other tasks that can assist the secretary.
8.5 Treasurer. The treasurer shall be in-charge of all financial records of the club. She is also task
to take good care of the fund of the club bare secure records of all financial activities of the club.
The treasurer shall disclose all financial matters to the club president and auditor as required.
However, no club officer can withdraw any amount from the club fund without proper and
accurate inventory.
8.6 Auditors. There shall be two (2) auditors. The auditor shall audit the financial records of the
treasurer in relevance to the cost of project or activity the club has undergone expenditure to.
Any irrelevance and discrepancy shall immediately be reported to the office of the president for
proper address provided for that proper explanation and evidence be made to support the
argument the office of the auditor has to make.
8.7 Business Managers. The club shall constitute of at least one (1) business manager but should
only have a maximum of three (3). Their duty is to coordinate every decision, activity and projects
of the club to any concerned party inside or outside of the school premises.
8.8 Public Information Officer. The PIO shall be in-charged of carrying out all the club’s
announcements and publications for public information, However, they’re authorization must only
be limited according to the instructions and authorizations issued by the office of the president.
8.9 Board of Directors. There three (3) elected Board of Directors representing the Junior High
School Teachers, Senior High School Teachers, and the Admin Staffs shall be the in-charged of
carrying out all specific tasks in their group.

SECTION 9. Responsibilities of Members


9.1 Every member of the association, regardless of his or her position, shall serve humbly enough
and act cordially enough to reflect the purposes by which the organization is standing upon;
9.2 Each association officer and member shall be aware of his position’s scope and delimitation to
exercise its rights, responsibilities and accountability accordingly;
9.3 Every member of the association shall uphold the highest quality of education as possible
which therefore compels him or her to submit oneself to continuous upgrade of teaching skills
and resources informally, non-formally or formally, whichever is possible;
9.4 Every member of the association shall support and respect whatever decision the association
has made regarding the matter at hand even if the decision is against his or her personal
perspectives;
9.5 Every member of the association shall put God in his or her priorities in every aspect of his or
her life regardless of his or her own religious affiliation. In this regard, he or she shall exercise
religious freedom without question provided for that he or she also respects the same freedom of
others.
9.6 Every member of the association has the right to present his or her ideas on improvement and
innovation before the association to be dealt with accordingly provided for that the said idea is
originally of his own.
9.7 No member of the association shall proclaim ownership of any work or physical entity that is
not of his or her own.
9.8 Every concern brought before the association shall be dealt and be resolved by the association
members through a plebiscite. The final decision shall be ratified by the majority of the votes and
thus be respected by the rest of the body without further question.
9.9 Every association member shall be of highest concern and interest on matters involving the
welfare of the school and take appropriate action accordingly.
SECTION 10. Rights of Members
10.1. Every member has the right to express his or her ideas provided for that the manner of
expressing is done appropriately;
10.2 Every member shall have equal rights of availing financial, professional, moral, spiritual
assistance;
10.3 Each member shall have his or her right to remain silent;
10.4 Each member elected as an officer shall have his or her right to resign from the position he or
she has been elected upon;
10.5 Each member has the right to be informed of every action and decision undertaken by the
club;
10.6 Every member has the right to defend himself or herself against unjust accusations made
against his name;

ARTICLE VI
ELECTION OF OFFICERS AND REMOVAL FROM OFFICE

SECTION 11. Election of Association Officers


11.1 Election of the officers of the club shall be done every two years through nomination and
show-of-hands or through a ballot box during an assembly. Shall an officer transfers to other
school, a snap election shall be executed a week before the member transfers out of the school
to give way for the turnover of records to the next officer of the same office.
SECTION 12. Removal from Office
12.1 No officer shall be removed from office by any other means but through resignation only.

Article VII
MEETINGS, PROCEDURES AND DECISION-MAKING

SECTION 13. Meetings


13.1 The association officers shall hold a regular meeting every last Thursday of every month. In
case that a class suspension is imposed on a Thursday, the meeting shall be rescheduled a day
before the affected Thursday.
13.2 An assembly for the association shall be held twice per school year.
13.3 Emergency meetings can be held anytime as deemed necessary.
SECTION 14. Procedures
14.1 Each meeting, the club officers and members should observe the following:
a) Presiding and formal opening of the meeting by the club president;
b) Reading of the minutes of the previous meeting by the secretary;
c) Presentation of issues concerned before the club;
d) Deciding on matters at hand by a quorum;
e) Reading of decisions made by the club by the secretary;
f) Formally closing of the meeting by the president.
SECTION 15. Decision-making.
15.1 A quorum in decision-making shall be observed by the association in deciding over issues
needing final ruling. The term “quorum” shall be defined as half of the population plus one (1).

ARTICLE VIII
FUNDS AND PROJECTS

SECTION 16. Funds.


16.1 The funds of the association shall only be used for the activities and projects of the
association, financial aid for medication and hospitalization of the member and mortuary
assistance, not for personal expenditures of any officer or member of the association. It can be
used to procure teaching material to enhance the teaching quality of teachers and to purchase
equipment that contributes to the enhancement of the school’s overall condition.
16.2 The sources of funds are the membership fee, fund-raising activities, IGP, solicitation and
donations.
16.3 The club’s funds shall be disposed of by the association treasurer for safe keeping or banking.
No other association officer or member has the right to withdraw any amount from the
association fund without the approval of the following: President, Vice-President, Treasurer and
Auditor.
16.4 The revolving fund is the accumulated membership fee of the association. Part of the fund
shall only be spent for emergency purposes and shall be replenished immediately.
16.5 In case the association has excess funds, the excess shall be forwarded to the next term of
officers.
SECTION 17. Projects.
17.1 The projects that shall be funded by the association shall only be for the school. No projects
shall be passed to nurture an individual member in a bias manner. The association has to come
up with a project every term.
Article IX
BENEFITS

SECTION 18. Benefits.


18.1 A member can benefit a medical assistance only once if he or she experiences one of the
following: Major Operations, Major Cases, and/or accidents, and a mortuary assistance. The
active member can claim the medical assistance if he or she will present a certificate from a
Licensed Physician and is approved by the association’s Medical Team. The association shall
collect an amount of Php 50.00 to each member for the financial aid of the in-need member.
18.2 A mortuary assistance shall be given to an active member only. The association shall collect
an amount of Php 200.00 to each member for the mortuary aid for the deceased member.
18.3 An Exit Benefit shall be given to an active member once he or she experiences one of the
following: Transfer of station, Retirement, and Resignation. The active member can claim the exit
benefit with the condition as follows:
18.3.1 The active member has rendered two (2) to five (5) years in service of Agusan del
Sur National High School. The association shall collect Php 50.00 from each
member and will be given to the exiting member.
18.3.2 The active member has rendered six (6) to ten (10) years in service of Agusan del
Sur National High School. The association shall collect Php 100.00 from each
member and will be given to the exiting member.
18.3.3 The active member has rendered eleven (11) years and above in service of Agusan
del Sur National High School. The association shall collect Php 200.00 from each
member and will be given to the exiting member.

Article X
AMENDMENTS

SECTION 19. Amendments


19.1 Any amendment to or revision of this Constitution and By Laws may be proposed by a
majority of all members association or at least fifty (50) percent of the general membership of the
association subject to the approval by a quorum vote of all individual members of association,
voting jointly.

Article XI
EFFECTIVITY/TRANSITORY PROVISION

SECTION 20. Effectivity / Transitory Provision


20.1 This Constitution and By-Laws shall take effect immediately upon its ratification by a quorum.
20.2 Other rules, regulations, all issuances inconsistent with these guidelines shall be superseded
accordingly.
20.3 Election of new set of officers shall be elected one week after the ratification of this
Constitution.
