CONTRACT OF EMPLOYMENT
‘This agreement entered into today between Liftman Malta Ltd hereinafter referred to
as employer and Mr Faycal Ezzerki (bearer of ID/Passport LF8572725) residing at
. hereinafter referred to as employee.
Employment details
‘The employer hereby employs the employee as a lift technician on a full-time basis for an indefinite
period. The employee hereby agrees to such employment starting from the.
Description of duties
Employee will be responsible for electrical and mechanical repairs, fault finding and replacing of material
‘and parts of lifts. Job duties may vary from time to time but advised beforehand.
All call outs and site services are to be documented in job sheets, which will be given by the employer
and in log books which are found in lift machine rooms where and if applicable. Employee shall be
responsible and must ensure that all relevant documentation such as job sheets are duly completed
‘including customers’ signature. A weekly time sheet detailing work done and times worked shall be filled
in and handed to employer the following week.
Employee agrees to travel to Gozo to carry out specific jobs should need arise. Employee will be given a
‘company sim card with unlimited data to be used for work purposes. Any data that is chargeable and
goes over and above the contract will be deducted from employee’s salary accordingly.
All jobs are to be carried out with responsibility, diligence and carefulness. Employee shall keep himself
‘well informed of developments connected with the services provided by the Employer in order to give
the best possible service to the Employer and to the Employer's clients.
Hours of work
Employee shall work a 40 hour week, from Monday to Friday from 8.00am till 5.00p.m. with an hour
break every day. This may require such time to be extended until jobs in hand are finished. Should
Employee report late for work, the time lost shall be deducted from his salary. If employee arrives
Page 1 of 4~ Liftman Maltabetween 30 to 60 minutes late, he may be sent home on a full day vacation leave. Employee must report
‘on site at 8.00 a.m. sharp unless otherwise informed by the employer.
Compensation
Employer agrees to pay Employee a basic gross salary of €1300 per month. Salary will be paid monthly,
Probation is of 6 months and after 6 months probation and on reaching expected levels, salary will be
of €1600 gross per month.
‘ny overtime hours worked after normal working hours will be paid once monthly with the Employee's
salary. Employee shall be entitled to receive all future wage increases as well as all bonuses and benefits
a according to law. A weekly allowance (if applicable) of €5/day from Monday - Friday and €7/day
Saturday, Sundays and Public Holidays, will be remunerated for every week if the Employee is required
to remain on stand-by after normal working hours. This shall be payable with the Employee's salary.
The Employer shall in accordance with law, deduct the applicable Social Security contributions and
Income Tax from the employee's salary.
No payments in advance can be asked for by employee to employer.
Annual Leave Entitlement
The employee is entitled to the number of statutory leave and public holidays stipulated by law and
‘calculated on the basis of a 40 hour working week and an 8 hour working day, in accordance with the
‘organization of work time regulations
Leave shall be taken in consultation and with prior permission from the Employer or his representative
and employee may not absent himself from work except with the express consent and approval of the
employer.
Permission for leave isto be requested by the employee to the employer by not less than 48 hours before
leave is taken. If leave required fs for more than 3 working days, employer is to be informed as early as
possible. The employer reserves the right to refuse such request.
ickness and other leave entitlement
The Employee is entitled to sick leave on full pay for the number of days specified by law. Any absence
is to be reported at least 1 hour prior to starting of work and employer advised as early as possible and
before 1.00pm the same day, with how many absent days are given by medical doctor and when employee
is returning back to work. A medical certificate is to be presented, The employer reserves the right to
appoint his own medical advisor to examine employee and this supersedes decision of private GP of
‘employee.
Page 2 of 4~Liftman MaltaDuring the first 12 months of employment, there will be no payment for sick leave as in accordance with
the law regulations. In the case of employee being sick for the first 12 months, he may avail from his
vacation leave if applicable or else sick will be deducted as unpaid.
Birth, bereavement, special leave, parental leave and jury service shall be as contemplated by law.
‘Accommodation and travel
Employer will take care of the first 1 month of rent, from when employee starts employment. After this
1 month, employee can either opt to stay in same rental place and pay a monthly rent or else find an
alternative rent. Utilities, such as water, electricity and internet have to be and will be borne, by
employee. Employer will also take care of the one-time flight ticket to Malta. All other travel expenses
are to be borne by employee.
Visa/ID Malta documentation
Employer will take care of the documentation and fees needed for any permits/Visa needed. If employee
leaves job before 2 years, he has to pay the fees and expenses made for and on behalf of employee by
employer.
Reimbursement of expenses
‘The Employer shall reimburse the Employee for any expenses deemed reasonable and necessarily and
incurred in the performance of his duties as set out in this agreement. Any invoices and/or receipts must
be presented in order to qualify for re-imbursement. A petty cash allowance of €100 will be given to
‘employee so any expenses relating to his job dutfes can be purchased from this allowance. Prior to any
purchase employee must inform employer accordingly. Company car may/shall be provided. Vehicle has
to be maintained in good condition both from inside and outside. Fines, traffic accidents and
contraventions and excess in case of claims have to be paid by employee and are employee's sole
responsibility. Employer has every right to decide against involving insurance.
Confidentiatity and competition
Employee shall at no time during his employment, take any action that could discredit the reputation of
the Employer or any of its clients. Employee hereby agrees to keep confidential and not to disseminate,
for authorize to be disseminated for whatever reason, use for personal gain or for the benefit of third
parties any proprietary information or other knowledge acquired by him in the course of his duties with
the Employer. All such proprietary information or other knowledge shall remain the property of the
Employer. Employee shall not, without the consent of the Employer, retain, make original or copies of
‘manuals, programs, circuit diagrams, forms, reports, presentations, designs or any other documentation
belonging to the Employer or to his clients. He shall deliver all documents he has in his possession if
employment is terminated.
The Employee shall not hold any other position and/or accept deals in businesses whether directly or

‘any commercial and technical information including any professional or trade secret. Employee shall in
no way whatsoever solicit or provide a service to the Employer's clients during his employment. He may
ot solicit or approach employer's clients or suppliers to transfer their custom to him after termination

(on his own behalf.
Termination
Without prejudice, the Employer has the right to terminate the employment of the employee, in the
event of redundancy and/or good sufficient cause that justifies such termination such as proved non-
performance of duties and/or breach of this contract. Theft, misappropriation and/or breaching of
contract entail immediate dismissal. If the employee terminates the work without pre-advice, a fine of
£€1600 has to be paid immediately by the employee for each month that remains of the employment.

Notice
The following notice periods, considering the nature of the employee's work, shall apply.

Amendment
This contract may be amended from time to time, in writing, with the consent of both parties. Contract
