FACTS
Petitioner Philippine Constitution Association and others files a writ of mandamus to sue
Cornelio T. Villareal, et al. to inspect and examine the books, records, vouchers and
other supporting papers of the House of Representatives that have relevance to the
alleged transfer of P26.2 million from various executive offices to the House of
Representatives dealing with the original outlay of the P39 million as appropriated for
the 1969-1970 fiscal year.
The respondents through an adopted resolution from this court requires them to file an
answer to the petition for mandamus within 10 days from notice hereof, and not to move
to dismiss the petition.

ISSUE
1. Whether or not petition to suit respondents to inspect and examine the books,
records, vouchers and other supporting papers of the House of Representatives
is indisputable.

CONCLUSION
1. NO. The Supreme Court ruled that under the theory of separation of powers the
absence of a cause of action, lack of legal personality to sue, nonjoinder of
indispensable parties as well as the mischievous consequences the petition is
hereby declared moot and academic on the ground of lack of jurisdiction.
