JUDICIAL AFFIDAVIT

I, ANDRES C. INOMES, Filipino, of legal age, with address at

__________________ Buguias, Benguet, petitioner in this case, after having been
duly sworn, hereby attests that:

PRELIMINARY STATEMENT

The person examining me is Atty. Rafael Palasi with office address at Rm. 2, 2/F
BSU Cooperative Bldg., Buguias, Benguet, Philippines, in English, a dialect I
speak and understand and after having been appraised in English dialect that all
answers I give under oath and any untruthful statements I make may subject me to
criminal prosecution for perjury or giving false statements, hereby execute this
judicial affidavit.

PURPOSE: This affidavit/testimony of petitioner ANDRES C. INOMES is being

offered to prove the following:

1. He is the Petitioner in the instant case;

2. He is legally married to respondent-Brenda P. Malucay-Inomes;
3. He is not capable of carrying out the essential obligations of marriage due
to his psychological incapacity;
4. His psychological incapacity is incurable;
5. He will identify relevant documentary evidence pertaining to this case;
and
6. He will likewise testify on all other related matters, facts and
circumstances relevant and material to this case.

DIRECT EXAMINATION:

A. I am Andres C. Inomes, of legal age, Filipino, married, resident
of ____________________ and presently working as
________________________.
2. Q. Why are you here today?
A. I am here today to execute my judicial affidavit in relation to the
Petition for Declaration of Nullity of Marriage pursuant to Article 36
of the Family Code I filed against Brenda P. Malucay-Inomes.

3. Q. How are you related to the respondent in this case?

A. She is my wife, Sir.

4. Q. How do you know the respondent in this case?

A. I met him at Buguias.

5. Q. What happened after you met her?

A. I instantly fell in love with her so I decided to court her. After three
months of dating we had sexual intercourse and I impregnated her.

6. Q. After respondent became pregnant, what did you do?

A. Our parents decided and came to an agreement that we should get
marry to formalize our union so we get married before the Office of
the Municipal Mayor in September 17,2001 at Buguias, Benguet.

7. Q. After your marriage, what did you do?

 A. We lived together and had children.

8. Q. How many children did you have?

A. We had two children namely Brenson, aged 21 and Brenses aged 16.

9. Q. At present, how is your marriage?

A. At present we are not living together as she is working overseas. She
left the children under my care and sometimes being passed on to
Brenda’s parents or her siblings.
