RENTAL AGREEMENT

THIS RENTAL AGREEMENT is made and executed at Bangalore on this 31 of May Month, Year
Two Thousand Twenty-Three (31/05/2023)

Hereinafter called the “LESSORS / OWNERS” which term shall mean and include his /
her / their legal heirs, legal representatives, administrators, executors, assigns of the ONE
PART.

Herein after called the “LESSEES / TENANTS” which term shall mean and include his /
her / their heirs, executors, administrators, legal representatives and assigns of the OTHER
PART;
WHEREAS the Lessor is the absolute owners of the apartment in FLAT NO – 401,
‘E1- BLOCK’, “SNN RAJ SERENITY” Begur Koppa Main Road, Bangalore – 560
068, Karnataka State (Including Car Parking) which shall hereinafter be referred to as the
“SCHEDULED PROPERTY”.
WHEREAS the LESSEE / TENANT has offered to take the Scheduled Property on
lease and the Lessor are willing to let out the same to the Lessee.

WHEREAS the parties herein have agreed on the terms and conditions of the Rental
and have further agreed to reduce the same to writing as hereinafter set out.

NOW THIS DEED OF Rental WITNESSETH with following Term and conditions: -
1. RENT: The monthly rent payable by the Lessee for the Scheduled Property shall be
a sum of Rs. 36,000/- (Rupees Thirty Six Thousand Only), Monthly Maintenance
charges received by the SNN society shall be paid by the Lessee.
2. DURATION: The Rent shall commence from the 1st of June Month, Year 2023
(01.06.2023) for a period of 11 months. On expiry of the said 11 months the lease shall be
extended for a further period of 11 months at a monthly rent which shall be Rs 36000/- plus
5% (Five Percent). Extension of the Lease beyond the first period of 11 months will be by
mutual consent.
3. DEPOSIT: The Lessee / Tenant has agreed to pay to the Lessor a sum of Rs.
1,50,000/- (ONE LAKH FIFTY THOUSAND Only) as Security Deposit in favor of
Lessors / Owners in following manner.
Sum of 10,000 (Ten Thousand Indian Rupees Only) paid on 18th May 2023
Sum of balance amount of 1,40,000 (One lakh Forty Thousand Indian Rupees Only) to be
paid by end of May, 2023

The receipt of which is acknowledged by the Lessors and the same shall be held by the
Lessors as Security Deposit during the continuance of the Lease and / or any extension
thereof and shall be repaid to the Lessee free of interest at the end of the period of the lease
and / or extension thereof or earlier termination as may be the case after deducting rental
arrears, damages or any other dues whereas Lessees has not right to claim that Rent should
be deducted from deposit.
4. TAXES, DEPOSITS, and ASSESSMENT CHARGES: The Lessors / Owners shall
pay regularly the property taxes and municipal taxes in respect of the Scheduled Property
to the concerned authority and shall keep the premises free from all encumbrances.

5. ELECTRICITY CHARGES: The Lessees / Tenants shall pay directly to the


concerned authorities, the electricity charges as may accrue based on the electricity utilized
for their own use as per the actual meter reading during the period of Lease.
6. NATURE OF USE PERMITTED: The Lessees / Tenants shall be entitled and
permitted to use the Schedule Property for Residential Purpose Only and shall not use or
permit the use of the Scheduled Property for any unlawful purposes or such purposes as
may be likely to endanger the building. The Lessee will permit the Lessor, their duly
authorized agents with or without workmen with prior notice to enter upon the Scheduled
Property for inspection and / or undertaking of any structural or other repairs as may be
required at mutually agreed time.
7. SUB-LEASE: The Lessees / Tenants shall not be entitled or permitted to
assign, underlet or sub-let Scheduled property or any part thereof to anybody whatsoever.
The Lease agreed to herein will be for residential purposes only and that too for the Lessee
and his family and the Lessee shall not sub-let either the whole or even a part of the said
property including the basement car parking.
8. MAINTENANCE: The Lessees / Tenants shall be responsible for the day to day
upkeep and maintenance of the said property and shall be responsible for the upkeep and
maintenance of the fixtures and fittings provided in the Scheduled Property subject to
normal wear & tear. The lessee shall not affect any structural change or alteration of
Scheduled property without prior written consent of lessor subject to normal wear and tear
excepted.
9. LESSOR COVENANT: The Lessors / Owners hereby covenant that upon paying
the rent hereby reserved and observing the terms and conditions herein contained the
Lessee shall be entitled to quiet possession and peaceful enjoyment of the Scheduled
Property without any manner or let, hindrance, interruption or disturbance by or from the
Lessors, their heirs, or by any person or persons claiming through under or in trust for the
Lessors or their representatives.

10. TERMINATION OF THE LEASE: The lease shall be determinable under all or any
of the following circumstances namely:
a) By efflux of time
b) In the event of nonpayment of rent by the Lessee for a period of 2 consecutive
months.
c) In the event of breach by either party of the terms, conditions and covenants
hereof.
d) By giving One (1) month written notice period from either parties.
11. HANDING OVER THE POSSESSION: The Lessees shall deliver back the vacant
possession of the Schedule Property to the Lessor immediately upon the expiry of the said
term or on earlier termination if any, in good and tenantable condition, subject to
reasonable wear and tear upon which the Lessors shall return the Security Deposit free of
Interest less any deductions as may be due towards repair / damages.
12. The Lessees shall permit the Lessor, his assign representatives, legal heirs to enter in
the schedule mentioned property periodically to examine the state and condition of the
Scheduled Property in presence of Lessees with prior intimation.
13. The Lessees shall indemnify the lessor against any major damage caused to the
Scheduled Property either by them or by their employees, servants, pets, or agents during
the period of lease whereas lessees is not allowed to make any such changes.
14. At the time of vacating the schedule premises, the Lessee shall handover the
schedule premises in good condition, painting and cleaning charges to be paid as one
month rent. Deep Cleaning and Painting charges as rent for 1 month to be deducted
from security deposit or the Lessee should pay the expenses.
15. The parties herein do hereby covenant with each other that they will fulfill, observe,
perform and carry out all the obligations, of their respective part as stipulated in this
agreement.
16. Notwithstanding the terms of the lease agreed to herein in the event of the Lessees
committing any defaults in the compliance of the agreed terms and conditions, the Lessor
shall be entitled to determine the lease forthwith and the Lessees shall immediately vacate
and handover possession of the Scheduled Property with the fittings and fixtures as set out
in the following schedule.
17. Lessees / Tenants need to obey / follow all the terms and conditions of the Association
of SNN RAJ SERENITY / Society. Should maintain a peaceful stay in the schedule
premises and will not create any hindrance or problems to their neighboring flats of the
mentioned society.
18. Lessees/Tenants need to submit the self-attested copy of their ID proofs and
employment proof and police verification proof as per the law of local land.
19. The original of the rent agreement will be kept with Lessor and the copy of the same
will be given to lessees.
20. Lessees have no right to mortgage the property or involve in any kind of illegal activity
any such dispute will be addressed at Karnataka court only.

The piece, part & parcel of the premises residential apartment in FLAT NO –E1-401, ‘E1-
BLOCK’, “SNN RAJ SERENITY” Begur Koppa Main Road, Bangalore – 560 068 ,
Karnataka State (Including Car Parking) . Consisting of 1535sft Hall, 3 Bedroom with
TWO Attached Bathroom & Toilet, One Common Bath & Toilet, One Kitchen, 2 balconies
and one covered utility area provided with electricity and water facilities (Semi Furnished)
