CHAPTER 10

EXECUTIVE DEPARTMENT

Executive Power The power to enforce and administer the laws.


 Qualifications -natural born citizen
(rule of interpretation) - registered voter
Expressioi unius est - able to read & write
exclusion alterius (the - at least 40 years of age on the day of the elections
expression of one term is - a resident of the Philippines for at least 10 years immediately
the exclusion of the other) preceding such election.
 Composition - president & vice president (elected by direct popular vote)
 The SC shall be the sole judge of all contests relating to the
election, returns & qualifications, & may promulgate its rules
for the purpose (PET, promulgated 2010 its Rules, consisting of
the members of the SC – the authority of its chairman to
appoint employees & confidential employees of every member
thereof, admin staff & the provision of a “seal”, separate &
distinct from the SC [Art 7, section 4 of the consti])
- Cabinet (nominated by the President with confirmation of commission
on appointment.
 Terms - President & Vice President = 6 years, no person who has succeeded as
president & has served as such for more than 4 years shall be qualified
for election to the same office at any time.

 Function  President
- has the mandate of control over all the executive departments,
bureaus, & offices, includes restructuring, reconfiguring, &
appointments of their respective officials, as well as the strict
implementation of laws.
- Power to give executive issuances (Administration code of 1987)
