Pursuant to your phone conversation with Deputy General Counsel Steve Aitken on th, September 26 and because the Department of Educations Gainful Employment Final Rule was published in the Federal Register on June 13, 2011 (publically available at ht: / /www. fcderalregistcr.gov/ardcles /2011 /06 / 13/2011-13905 /program-intcgri-gainful employment-debt-measures), you have tentatively agreed to accept, in satisfaction of your request copies of the Proposed and Final Rules as they were submitted to the Office of Information and Regulatory Affairs (OIRA) and returned by OIRA to the Department of Education upon conclusion of review documents which may be released under section 6(b)(4)(D) of Executive Order 12,866.
