AFFIDAVIT OF DESISTANCE
I, Jandale M. Padayo, of legal age, Single, and a resident of Brgy. 42 Apaya,
Laoag City, Ilocos Norte, after having been duly sworn to in accordance with the law,
hereby depose and state:
1. I am complaining witness for Slight Physical Injuries against Tristan y Mateo in
the case entitled “People of the Philippines versus Tristan y Mateo”, Criminal
Case No.12345 City Trial Court, Branch No.3, City of Laoag.

2. After my sober and Analysis of the incident, I am withdrawing my complaint

against the accused because it was an accidental in nature because of drunk
without a doubt to the accused or any other person’s who inflicted harm against
the me.

3. That I am formally no longer interested and I am permanently withdrawing my

complaint against the accused and without doubt the liability of Tristan Y Mateo
and since he was voluntarily defrayed the cost and provide money for
settlement.

4. I respectfully request that the Honorable Regional Trial Court Branch No.3,
City of Laoag and Honorable Provincial Prosecutor to DISMISS the above
mention case against accused Tristan y Mateo;

5. I am executing this affidavit in order to attest to the truthfulness of the

foregoing statements.
