1. The application is at the instance of the 2nd Petitioner for a


fresh permission to travel overseas despite the existence of a Look
Out Circular or LOC against both Petitioners.

2. We had previously twice granted leave on 9th December 2021


and 4th March 2022. For Covid-related reasons the 2nd Petitioner
could not avail of the first leave but did travel overseas under the
second order and has complied with its terms and conditions. The
present application seeks the travel overseas to Geneva Switzerland
from 13th June 2022 until 20th June 2022 for stated business
reasons as set out in paragraph 7 of the additional Affidavit. There is
an undertaking to return to India on 21st June 2022.

3. In view of the history of the matter, we will grant the request


until 21st June 2022 subject to the same terms and conditions as
were imposed earlier, we permit the Petitioner to travel overseas for
a period from 13th June 2022 till 20th June 2022. The other terms
and conditions previously imposed will apply. This order will also be
subject to the usual conditions, viz.,

(i) the Petitioner is to file an undertaking to


return to this country at the end of this
period, if not already done;

(ii) the Petitioner is to file a detailed itinerary


with his contact details and addresses
overseas, if not already done;

(iii) The Petitioner must file an undertaking (if


not already done) not to apply for renewal or
extension of this order until he returns to this
country.

4. Subject to these conditions, the LOC in question against the


Petitioner is stayed until 21st June 2022.

5. The immigration authorities at all ports of departure


including all airports will permit the Petitioner passage and permit
the Petitioner to take his flights out of the country irrespective of
whether the Bank of Baroda has notified them or not and
irrespective of whether this suspension is noted in the immigration
authorities’ systems or not.

6. The immigration authorities will not ask for a certified copy of


this order but will act on presentation of an authenticated or digitally
signed copy of this order.

7. This order will dispose of the present IA. No costs.
