DELA CRUZ WHEREAS, Section 16 of the Local Government Code of 1991 mandates every Local Government Unit to exercise powers necessary, appropriate or incidental for its effective and efficient governance and those which are essential to the promotion of the general welfare; WHEREAS, this Municipal Goverment as Government of our people and in pursuit of realizing a wider scope of General Welfare provision to our people, we hereby secure to adopt a guideline and establish a legal basis that will immediately provide a recovery assistance for our residents who might be victims of losing home/s due to fire disaster; NOW, THEREFORE, on motion of Councilor Walter E. Dela Cruz, duly seconded2 | Ord. No. 35, s-2020, Fire Disaster Financial Assistance BE IT ORDAINED BY THE SANGGUNIANG BAYAN OF SAN VICENTE, PALAWAN IN ITS SESSION ASSEMBLED, THAT: SECTION 1. TITLE. This Ordinance shall be known as “An Ordinance Providing Fifty Thousand Pesos (Php 50,000.00} Financial Assistance to a Family who lost home due to fire disaster otherwise known as “Fire Disaster Financial Assistance”. SECTION 2. BENEFICIARIES. Those family/ies living within the territorial jurisdiction of this municipality who are victims of fire outbreaks or disaster shall be entitled to avail this Fire Disaster Financial Assistance. SECTION 3. FINANCIAL ASSISTANCE PROVISION GUIDELINES. 3.1. After ascertaining of any fire disaster to a home/house of any of our resident, the Office of the Punong Barangay, without any cost of payment shall provide the family a Certification of Residency and Indigency immediately but not later than seventy-two (72) hours from the time of fire disaster. 3.2. The Bureau of Fire Protection and/or the Philippine National Police assigned within this municipality, without any cost or request coming from the victims of fire disaster, is requested to provide immediately the Municipal Welfare and Development Office a Narrative report of the fire outbreak stating therein the details and names of family/ies who are victims of a fire disaster. 3.3. The Office of the Municipal Social Welfare and Development Office through its Officer shall act and process within seventy-two (72) hours the Financial Assistance to any family victim/s of Fire disaster without any further request from the victims. 3.4. The following shall be the requirements for availing aforesaid financial assistance, to wit: a. Certificate of Residency & Indigency from concerned Barangay: b. Barangay Cerfification certifying that the house burned down was a family home of a person seeking financial assistance; c. Narrative Report from Bureau of Fire Protection or from Philippine National Police, and d. Valid ID, if only and still available SECTION 4. SEPARABILITY CLAUSE. If any provision of this Ordinance is declared unconstitutional or invalid, other provisions that are not affected thereby shall continue to be in force and effect. SECTION 5. EFFECTIVITY CLAUSE. This Ordinance shall take effect retroactively from the 1 day of January 2020 and forward until abolished or repealed. SO ORDAINED. ENACTED THIS 14™ DAY OF DECEMBER, 2020.3 | Ord.
