LEARNING AGREEMENT

The following learning agreement was signed, for the Bachelor program, as follows:

II. TERMS OF CONTRACT

Art.1 The present contract is drawn up to cover curricular activities to be pursued in order to acquire the
competencies and abilities specific to the field for which the student has opted, subject-to-tax activities, specifying the main
rights and obligations of the signing parties, in accordance with the legislation in force, orders of the Ministry of Education
and regulations of the University Charter, the contract regulating the relations between the Romanian-American University
and the student ________________________________________________________________________________.

III. DURATION OF CONTRACT

Art. 2 This contract takes effect from the signing date until the end of the schooling period of the student within the Romanian-
American University, according to the regular duration of studies (3 years for the “Economics”), the diploma granted by the
graduates who passed the final examination, being related to level 6 of the European Qualifications Framework for lifelong
learning.

IV. TUITION AND PAYMENT METHODS

Art. 3. The amount of the tuition fee is set on a yearly basis by the University Senate according to the specific
education costs.

Art. 4. For the academic year 2022-2023, the annual tuition fee is as follows:

- Regular tuition fee for all applicants: 3400 EUR/year,


 payable in LEI, for students of Romanian citizenship, at the exchange rate of the Romanian National
Bank on the day previous to the payment day, while the exchange rate will be calculated considering the
4(four) digit exchange rate;
 payable in Euro/ LEI, for students who are citizens of other EU member states, or EEA and Swiss
Confederation, at the exchange rate of the Romanian National Bank on the day previous to the payment
day, while the exchange rate will be calculated considering the 4(four) digit exchange rate.

- Early registration for the first academic year for enrollment before July 28th, 2022: 2700 EUR/year.
Art. 5. The payment of the annual tuition fee will be made as follows:

a) For the 1st year of studies:


a1) For students of Romanian citizenship and citizens of other EU member states, or EEA and Swiss Confederation:
the full payment of the tuition fee, within 5 days, from the display of the final results of the entrance examination, on the
basis of the application for enrolment completed and signed by the student;

a2) For students from other states that are not members of the EU, EEA and Swiss Confederation: the full payment
of the tuition fee, within 5 days after obtaining the approval of the Ministry of Education, on the basis of the application for
enrolment completed and signed by the student;

b) For 2nd and 3rd year students:


b1) the full payment of the tuition fee until the 25th of September of the current calendar year, on the basis of the
application for registration completed and signed by the student;

or

b2) 1st installment, i.e. 50% of the annual tuition fee, until the 25th of September of the current calendar year, on the
basis of the application for registration completed and signed by the student, and 2 nd installment, i.e. the reminder of 50%
from the annual tuition fee by 15th of December of the current calendar year;

c) The tuition fee, full payment or in installments can be paid:


c1) in LEI, o n the following web page: paginamea.rau.ro;

c2) in Euro, on paginamea.rau.ro web page, by bank transfer in the following bank account

Art. 6. In duly justified cases, during the contract period, in the event of circumstances which harm the economic
interest of the University, and which could not be foreseen at the conclusion of the present contract, the parties agree on the
revision of the tuition fee, as the University Senate will decide.

V. THE RIGHTS AND OBLIGATIONS OF THE PARTIES

Art. 7. The Romanian-American University undertakes:

(1). To ensure the necessary resources for the unfolding of the teaching activity for the Major in
............................................................................... School of ………………………………………
......................................................................................................................, full time studies, on the entire schooling period.
The educational pathways will be established in accordance with the student’s options and based on the School’s Board
decisions.
(2). To provide the material and logistic conditions for the unfolding of the teaching activities, according to the
University curricula;
(3). To assimilate quality management as a defining component of the institutional policies and its development
strategy, being the primarily responsible for the quality of the educational services offered;
(4). To provide the space and technical equipment necessary for the unfolding of the educational process;
(5). To ensure the participation of the students in the scientific research activities, sports activities and cultural
events organized by the institution;
(6). To elaborate and apply, through the School’s Management and Quality Assurance Department, the internal
regulations, methodologies and procedures, for the insurance of the quality of education, which is made public;
(7). To establish and implement the system of evaluation, and the necessary conditions for promotion;
(8). To ensure the students’ access to the University’s Library, sports halls, as well as other specific activities;
(9). To issue and release free or by fee, the documents and diplomas that certify students’ qualification, in
accordance with the legal regulations in force, up-to-date school evidence, certificates, etc.;
(10). To ensure guidance for students preparing their final exams as well as rapid insertion on the labor market;
(11). To provide the frame for the unfolding of scientific research activities;
(12). To ensure students’ participation to the School’s and University’s management organizations;
(13). To provide access to professional competitions and scientific events organized at a domestic and international
level, taking into consideration the professional and scientific activity of the students, as well as their moral behavior;
(14). To ensure the right for every student to take part in the annual evaluation of the professors’ professional
activity;
(15). To grant scholarships and other forms of financial support for outstanding learning or research results,
according to the Regulations for awarding scholarships and other forms of material support;
(16). To provide accommodation, by fee, in the building placed in the University campus, or other appropriate
spaces provided by the University, within the limit of the available seats, based on a list of criteria settled by the University;
(17). To offer the adequate and relevant resources and services, in order to facilitate learning, and a high quality
student life;
(18). To set the terms of registration, enrollment, tuition, interruption of studies, expelling, re-registration and re-
enrollment of the student;
(19). To supervise and monitor how the student complies with his/her contract obligations undertaken herein and
under other contracts closed with the University.
(20). To set on a yearly basis the amount of the tuition fee, of other fees for academic services, of the facilities
offered, delay penalties for failure to pay the tuition fee on time, means of payment, and consequences for failure to pay the
obligations on time.

Art. 8. The student __________________________________________________________ undertakes:

(1) To inform himself/ herself on: the contents of the educational plan, the number of transferable credit points
allocated to each subject, syllabi, academic year structure, timetables for teaching activities and scheduled examinations,
results of the evaluations, School’s Secretariat timetable, the overall amount of university taxes, regulations and procedures
agreed by the Senate, which regulates the School’s activity, etc.;
(2) To meet in good condition and in due time the obligations which are part of the curriculum and the syllabus;
(3) To know and respect the documents that regulate his / her activity, the provisions of the University Charter, the
regulations on the professional activity of the students, all regulations, methodologies and internal procedures, University
Senate decisions, as well as the measures established by the University and/or School’s management;
(4) To regularly attend classes and applied activities covered by the curricula, the attendance being mandatory;
(5) To efficiently and effectively engage in participatory education, provided by the university professors, and to
produce in due time, the papers for the seminar, laboratory and applied activities;
(6) To fill in responsibly the academic evaluation questionnaires;
(7) To retake the exams failed in the current year or in the previous years, in accordance with the regulations
regarding the professional activity of the students;
(8) To choose an educational pathway in accordance with the regulations regarding the professional activity of the
students;
(9) To pay appropriately the taxes for educational services, approved by the University Senate, as well as the
contingent penalties;
(10) To have a respectable, correct and neat look; to comply with the university order and discipline, all along his/her
presence in the University campus;
(11) To have a civilized behavior towards faculty, colleagues, auxiliary personnel, technical and administrative staff,
as well as outside the University campus and undertake exclusive responsibility before authorities in case, through his/her
actions, causes injury to the other students present in the University campus, as well as to the University staff;
(12) To carefully use the lecture rooms, seminar classes, laboratories, libraries, as well as their related facilities and
not to facilitate entry into the lecture rooms, laboratories and seminar classes to any stranger;
(13) To support the damages caused to the University image, patrimony, university staff or other students, by his/
her exclusive fault;
(14) To prove loyalty towards the University and to promote the image of the University, by contributing to an
increase in its prestige;
(15) To permanently hold the student card, given the fact that access into the University Campus is granted by the
student card. In case of withdrawal from studies, the student card will be given back to the issuing School;
(16) The students are not allowed to use in lecture classes, seminar classes or during exams any transmission
devices, recorders, audio-video devices, mobile phones, or other wired/wireless means of communication, with the purpose
of defrauding examinations, tests, papers that they have to take;
(17) To follow the rules and regulations for the labor protection and fire protection, while on the premises;
(18) To use, for smoking, only the specially designated spaces;
(19) Not to bring, hold, distribute or use any alcoholic drinks or psychotropic substances in the University campus;
(20) Not to unfold any political activity in the University campus;
(21) To pay in due time the tuition fees, stipulated by the University documents, and, in case of breaching the
terms, to undertake the penalties settled by the University Senate.
(22) To offer the University the correct personal data solicited, according to the law assuming full liability for non-
compliance; and to inform in writing the School’s Registrars on any modification of the personal data and contact data (name,
address, telephone number, email, etc.), no later than 10 calendar days from the modification.
(23) Not to allow access to the examination room of another person to replace him/her for the evaluation; the
student will be expelled if he/she fails to comply with this obligation;
(24) To agree that the University informs, when necessary, the parents or the legal tutors, regarding the student’s
academic results during studies, or other information that might be of interest.
(25) To refrain from any acts likely to damage the personal interests of peers, faculty, administrative staff or the
University image.
(26) To obtain in due time a residence permit certifying the residence right in Romania, which it can be obtained
from the General Inspectorate for Immigration. In order to obtain the residence permit, the student will personally submit a
series of documents at least 30 days prior to the expiry of the residence right, granted by the visa;
(27) To understand that a prolonged absence (over 3 weeks) may lead to expulsion;
(28) To agree to the processing or to the transfering of personal data demonstrating the status of enrolled
student, in accordance with the legal provisions in force (eg. In order to benefit from health insurance without payment of
the related contributions, free of charge for the internal railway transport for all categories of trains, 2nd Class or other similar
purposes);
(29) To participate in online classes and to demonstrate commitment by completing assignments and other
coursework whenever there is an emergency transition to distance education due to unforeseen events.

Art. 9. The student has the following rights:

(1). To use the lecture rooms, seminar classes, laboratories, reading rooms, libraries, as well and any other means
used in the educational process, according to the schedule;
(2). To participate in didactic activities, scientific and cultural- sports events organized by the Schools and
University;
(3). To take part in the professors’ evaluation activities, according to the criteria established by the University
Senate;
(4). To receive support from the professors in elaborating projects, bachelor papers, as well as preparing the final
exams;
(5). To benefit from scholarships, diplomas, prizes and other forms of financial support, according to the
stipulations of the University Charter, for outstanding learning results; as well as diplomas and prizes for the activities
organized in scientific student activities;
(6). To participate in competitions and scientific events organized at a domestic and international level;
(7). To benefit from exchange programs, in order to study in EU and the USA, or any other country where there
is an agreement with the Romanian-American University, on the basis of the professional results achieved, and within the
limited number of scholarships or the number of places available, as part of the student exchange;
(8). To be appointed head of the year, head of the group, to vote and to be voted as a representative of the
students in the School’s Board or University Senate;
(9). To make proposals in order to improve the educational activity;
(10). To benefit from the guidance of the teaching tutors;
(11). To become a member of the student organizations;
(12). To become representatives of the students in the governing bodies, such as the Board for Evaluation and
Quality Assurance, if the student organization delegates this task to him / her;
(13). To get involved in the process of revision of the curricula and syllabi, following the internal rules imposed by
the University Senate;
(14). To have access to the learning resources and career counseling;
(15). To get involved in the volunteering activities unfolded by the university as part of some larger campaigns
promoted by the University;
(16). To be accommodated, by fee, in the University campus, or in other spaces provided by the University, within
the limit of the available places, based on the list of criteria settled by the University;
(17). To have unlimited access to regular meals at the University cafeteria, by paying the price of meals;
(18). To benefit from medical assistance in the University medical practice;
(19). To request interruption of studies in case of medical reasons or other good reasons, according to the laws in
force;
(20). To benefit from other facilities stipulated by the regulations regarding the professional activity of the
students;
(21). To request, in writing and reasoned, that the University should not notify the student’s parents or legal tutors,
regarding the student's academic results or other information that might be of their interest.

VI. CONTRACT LIABLITY

Art. 10.

(1). Delays in paying the tuition fees on term, as set under this contract, leads to the calculation of penalties and
the obligation to pay them.
(2). The amount of penalties is established by the University Senate for each calendar delay day, for a period of
maximum 90 days, after which, if he/ she continues not to pay the outstanding debts, the student will be expelled.
(3). The amount of penalties will be paid on the payment date of the main debt.
(4). Students expelled for failure to pay the tuition fees on time will be entitled to reenroll under an application
approved by the Rector, after paying the related fee and the outstanding debts.
Art. 11. In case of contractual breach, or improper fulfillment of the contract obligations, the student will incur the
following sanctions:

a. suspension of the right to attend the January – February session of exams, for failure to pay the annual tuition
fees;
b. suspension of the right to attend the May – June session of exams, for failure to pay the annual tuition fees;
c. expelling for failure to achieve the credit points required, according to the Regulations regarding the
professional activity of the students;
d. expelling for serious or repeated violations of the University Charter regulations, as well as for bringing
prejudice of any nature to the University;
e. expelling for failure to pay the tuition fees and/or due amounts on time according to art. 5 and art. 8,
paragraph (21) and art. 10 paragraph (2) of this contract.
Art. 12. If the present contract terminates until the 31st of October of the year when it was issued, by unilateral
withdrawal on the student’s part, 50% of the annual tuition fee paid will not be returned to the student. In case the full
tuition fee has been paid, 50% of the annual tuition fee will be retained, and the rest of the tuition fee will be returned,
based on a written request of the student, addressed to the Rector of the University, no later than 5 calendar days from the
date of its approval.
Art. 13. The unilateral withdrawal, for any reason, of the present studies contract, by the student, after 31 st of
October of the year when it was issued, exonerates the University from any responsibility. The student will be obligated to
pay the annual tuition fees.
Art. 14. In case of contractual breach, or improper fulfillment of the contract obligations, the University can cancel
the present contract, and the student will be obligated to pay the entire tuition fee, until the cancelation.

Art. 15. Any lenience from the University cannot be interpreted as a waiver to the expelling clauses and the stipulated
commissary pacts.

VII. CONTRACT SUSPENSION AND TERMINATION

Art. 16.

(1). The learning contract is suspended in case of extension of studies or interruption of studies. In this case the
student is obligated to pay the tuition fees during the stipulated time period. When resuming studies, the student will sign a
new contract, paying the difference in fee, updated according to the tuition fee regulations during the respective academic
year.

(2). For study-interruption, the residence permit of foreign students will be cancelled for the whole period of
interruption.

Art. 17. The contract can be terminated through agreement of the parties. The obligations arisen until termination
must be fulfilled according to the contract term.

Art. 18. The tuition contract is rightfully terminated upon the completion of studies or in the case of changing the
specialization/ form of education for which this contract was concluded. The obligations arisen until completion must be
fulfilled according to the contract term.

Art. 19. The contract ceases if terminated by the University for the student’s failure to comply with his/her
obligations, and if the student makes a written request to withdraw from the study program or to transfer to another higher
education institution. He/she must pay all the actual or outstanding debts, as well as any related delay penalties calculated
until the contract termination.

Art. 20. The contract is also rightfully terminated in case of student’s death.

VIII. FINAL CLAUSES

Art. 21. The failure to reach the terms of the learning contract leads to the loss of the student statute.

Art. 22. Any reference in the present contract, regarding the year of studies in which the student enrolls, the
academic year 2022/2023, regarding specific periods of time, due dates, installments, etc., associated with the year 2022 or
2023, will be considered automatically changed after passing or closing of the respective academic year, in the sense of
referring to the next academic year, and so on, until final graduation of the student.

Art. 23. The possible misunderstandings between the contracting parties, resulting from conclusion, interpretation,
execution and termination of the contract will be settled amicably, or otherwise, by the competent courts of Bucharest.

Art. 24. This contract relies on the provisions of Law no. 1/2011 on National Education, the Charter of the Romanian-
American University and the internal regulations of the University.

Art.25. If a student enrols in and pays the fee for a major where not enough students are registered to make up an
optimal study group and the University Senate decides that the said major would not be organized for the current academic
year, the said student may opt for another major within the University or may ask to be fully refunded for the paid fees.

I understand and agree that the processing of the data in this form will be carried out in accordance with the
details presented at the web address https://privacy.rau.ro regarding the processing of personal data by the ✓
Romanian-American University.
