DEED OF ABSOLUTE SALE

KNOW ALL MEN BY THESE PRESENTS:

This Deed of Absolute Sale (the “Deed”), made and executed this __
day of ___________ 2023, in Cebu City, Philippines, by and between:

JAMES EDWARD PIRIE, Australian, single, of legal age, residing


at 13 Reid Street Macksville, NSW Australia, duly represented by his
attorney-in-fact, MERLITA NINAL LEGASPI, of legal age, Filipino, with
postal address at Cambangyao, Dalaguete, Cebu herein referred to as the
“SELLER”;

-and-

JAMES NAVARRO MAHUSAY and RITCHIE G. MAHUSAY,


all of legal ages, married and residents of Sitio Looc, Barangay Luna,
Surigao City (Capital), Surigao del Norte, Caraga Region, herein referred as
the “BUYERS”;

WITNESSETH THAT:

WHEREAS, the SELLER is the absolute owner of a residential (2-


bedroom) condominium unit T2 21T Horizon 101 Cebu City, registered
under my name located at GENERAL MAXILOM AVENUE, COGON
RAMOS, CEBU CITY with an area of FOUR THOUSAND ONE
HUNDRED ELEVEN (4, 111) Square Meter under Condominium
Certificate of Title No. 107-20220033300 annotated on TRANSFER
CERTIFICATE OF TITLE 2015000727;

WHEREAS, the SELLER has offered to sell, transfer, and convey to


the BUYERS and the BUYERS have agreed to buy from the SELLER, the
above described property for a total purchase price of THREE MILLION
PESOS (Php 3,000, 000.00), Philippine Currency;

WHEREAS, the SELLER has the power, capacity, and authority to


sell and transfer the title of the Property to the BUYERS there being no
hindrance, legal or otherwise, to do the same upon the signing of the Deed of
Absolute Sale.

NOW THEREFORE, for and in consideration of the sum of


THREE MILLION PESOS (Php 3, 000, 000.00), Philippine Currency;
hand paid by the BUYERS to the SELLER, the SELLER DO HEREBY
SELL, TRANSFER, and CONVEY by way of Absolute Sale unto the said
BUYERS, their heirs and assigns, the certain parcel of land together will all
the improvements found thereon, free form all liens and encumbrances.
