DEED OF SALE WITH MORTGAGE

KNOW ALL MEN BY THESE PRESENTS:

This DEED OF SALE WITH MORTGAGE is made and executed this 3rd day
of October at Naga City, Camarines Sur by and between:

Donna Cruz; and hereinafter referred to as VENDOR-MORTGAGEE;


-and-
Manilyn Reynes; and hereinafter referred to as VENDEE- MORTGAGOR.

WITNESSETH:
WHEREAS, the VENDOR-MORTGAGEE is the registered owner of a parcel
of land located at Lot 3 Block 3, Magayon Homes, Cararayan Road, Del Rosario,
Naga City, Camarines Sur, Philippines, 4400 containing an area of 100 square
meters, and covered by Transfer Certificate of Title No. T-70633, of the Registry of
Deeds of Naga, Camarines Sur and more particularly described as follows:

“A parcel of Residential Land (Lot 3 Blk.3 of the cons. Subd. Plan Pcs- 33-300033,
being a portion of cons. Lots 13 to 22 Blk. 3. Pcs-00-30000 Lots 23 to 32 Blk 7. Pcs-
01-011111 & Lots 33-B-1 & 1-A-2, Psd-01-000000 LRC Rec. No.) situated in
Magayon Homes, Cararayan Road, Del Rosario, Naga City, Province of Camarines
Sur. Island of Luzon. Bounded on the W.,Along Line 2-3 by Lot 3 Blk 6; On the NW.,
and NE., Along Line 3-4-5 by Road Lot 2; On the E., Along Line 5-6 by Road Lot 4
(7.00 M. Wide) and on the S., Along Line 6-2 by Lot 4 Blk-6 XXXX containing an
area of one hundred (100) SQM ….including all the existing improvements thereon.”

NOW THEREFORE, for and in consideration of the total purchase price of


five hundred thousand pesos (Php. 500,000.00), of which the amount of two hundred
thousand pesos (Php. 200,000.00), has been paid by the VENDEE- MORTGAGOR
to the VENDOR-MORTGAGEE, upon execution of this agreement, the latter hereby
SELLS, TRANSFERS AND CONVEYS unto the VENDEE- MORTGAGOR, her heirs,
assigns and successor-in-interest, the above-described parcel of land, free from any
lien or encumbrance, except as herein constituted.

The balance of the purchase price shall be paid by the VENDEE-


MORTGAGOR in 60 monthly installments of Php. 5,000.00, commencing from
November 3, 2023 up to October 3, 2028 until the entire balance is fully paid. The
said monthly installments shall be covered by sixty (60) post-dated checks issued by
the VENDEE- MORTGAGOR in favor of the VENDOR-MORTGAGEE, which shall be
delivered at the time of the execution of this agreement.

As security for the payment of the aforesaid balance of the purchase price,
and for the fulfillment of the obligations of the VENDEE- MORTGAGOR that may
arise under this agreement, a mortgage by way of first mortgage is hereby
constituted on the above-described property in favor of the VENDOR-MORTGAGEE,
his/her assigns, heirs and successors-in-interest.

The mortgage is conditioned on the faithful compliance of the VENDEE-
MORTGAGOR to pay the monthly installments on the due dates they fall due until
full payment of the said balance of the purchase price. Upon compliance and full
payment thereof, this mortgage shall be of no force and effect; otherwise, the same
shall remain in full force and be foreclosed judicially or extra-judicially in accordance
with Act 3135 at the option of the VENDOR-MORTGAGEE.

Should the VENDOR-MORTGAGEE opted to extra-judicially foreclose this


mortgage, the VENDEE- MORTGAGOR hereby appoints the former as his attorney-
in-fact or his duly authorized representative to sell the subject property at public
auction without necessity of demand. The proceeds of the sale shall be applied to
the payment of the unpaid obligations of the VENDEE- MORTGAGOR, and to all
taxes and expenses for the foreclosure and sale of the subject property.

IN WITNESS THEREOF, we have hereunto affixed our signature this 3rd day
of October at Naga City.
