AGREEMENT ON

PERMANENT EASEMENT OF RIGHT OF WAY

KNOW ALL MEN BY THESE PRESENTS:

This AGREEMENT ON PERMANENT EASEMENT OF RIGHT OF WAY, is entered into this


______ day of ______________________, 2020 by and between:

ARMANDO BACILA, ANGELITA BACILA, and ERNESTO BACILA,


all Filipino citizens, and residents of Calatagan, Batangas,
JOSHUA ALEXIE BAUTISTA

hereinafter referred to as “GRANTORS”.

And

MASIGLA AGRI FARM CORPORATION, a legal entity duly


organized under Philippine laws, with address at Calatagan,
Batangas, herein represented by its Corporate Secretary, JOSHUA
ALEXIE BAUTISTA, hereinafter referred to as “GRANTEE”.

Witnesseth:

WHEREAS, GRANTORS are the beneficial owners of a parcel of an agricultural land


located in the Municipality of Calatagan, Province of Batangas, and more particularly described
as follows, to wit:
ERNESTO BACILA
ANGELITA BACILA
ARMANDO BACILA

which property is covered by Transfer Certificate of Title No. CLOA-2886 of the Register of Deeds
for the Province of Batangas, which lot is adjacent to GRANTEE’s property, and more particularly
described as follows, to wit:

JOSHUA ALEXIE BAUTISTA
ERNESTO BACILA

which property is covered by Transfer Certificate of Title No. 055-2019001392 of the Register of
Deeds for the Province of Batangas, Nasugbu Branch.

WHEREAS, in order that GRANTEE may have an access to and from, and to cultivate the
above-mentioned land, and so as to have an outlet to the nearest barangay road and least
burdensome to the servient estate and to third persons, it would be necessary for him to pass
through GRANTOR’s property, and for this purpose, a path or passageway of not less than five
(5) meters wide through the whole length of the EASTERN side of GRANTOR’s property is
necessary for the use of the GRANTEE and for all its needs in cultivating and/or use of its estate;

That said path or passageway is particularly described in the attached Location Plan,
“Annex A’.

NOW THEREFORE, for and in consideration of the sum of Philippine Currency:


________________________________________________ PESOS (P_____________________) the receipt whereof is
hereby acknowledged by the GRANTOR, the latter agrees and permits the GRANTEE to have a
permanent easement of right of way over the above-mentioned property of said GRANTOR
limited to not more than five (5) meters wide throughout the whole length of the eastern side of
said property and as specifically indicated in the attached plan which is made an integral part of
this contract, as “Annex A”
ARMANDO BACILA

GRANTEE shall have the right to erect poles, and single or multiple guy
anchorages along the course of said line. GRANTOR recognizes that the general course of said
lines, or the metes and bounds as above described, is based on preliminary surveys only, and
GRANTOR hereby agrees that the easement and right-of-way and its general dimensions hereby
granted shall apply to the actual location of said lines when constructed.

Together with the right of ingress and egress along and upon said easement and right-
of-way and over and across GRANTOR'S adjoining properties for the purpose of and with the
right to construct, maintain, operate, remove and reconstruct said lines; the right to relocate
along the same general direction of said lines; the right to relocate said lines in the same
relative position to any adjacent road if and as such road is widened in the future; the right to
lease wire space for the purpose of permitting others to string or lay wire or cable along said
lines; the right to prevent excavation within the easement area or for a distance of feet
on each side of the actual center of said lines; the right to prevent construction of, within the

easement area or for a distance of three (3) feet on each side of the actual center of said lines, any
and all buildings, structures or other obstructions which, in the sole judgment of GRANTEE, may
endanger or interfere with the efficiency, safety, and/or convenient operation of said lines and
their appurtenances and the right to trim or remove trees or shrubbery within, but not limited
to, said foot space, to the extent in the sole judgment of GRANTEE, as may be necessary to
prevent possible interference with the operation of said lines or to remove possible hazard
thereto. GRANTOR shall not make changes in grade, elevation or contour of the land within the
easement area as described above without prior written consent of Grantee.

GRANTOR reserves the right to use the land within the above described easement area for
purposes not inconsistent with GRANTEE'S use of such property, provided such use shall not, in
the sole judgment of GRANTEE, interfere with the exercise by GRANTEE of the rights hereby
granted.

It is further agreed that GRANTOR shall deliver unto GRANTEE all the necessary papers,
deed, and titles in relation to the servient estate in order to facilitate the registration of the above-
mentioned right of way.

This agreement shall be binding between the parties and upon all their heirs, successors,
and assigns.

IN WITNESS WHEREOF, the parties hereto have signed this agreement the day and the
year first above written, in the municipality of _______________________, province of Batangas,
Philippines.

acknowledgement is written, and signed by the parties and their instrumental witnesses on each
and every page hereof.
