Introuction

Public notice are notices to the common people or the powerful individual and they are
generally distributed in papers either by government offices or authoritative bodies. Public
notice information alerting individual government-related activities that may cause individual
to take action. They are required to make public notice in the rule making procedure with the
goal that the individual from the general population are available to make their assessment
on specific recommendation before a bill is drafted. Public notice can also include item like
lottery result, development application etc. public notice provide information for the public
which is widespread throughout other type of media also .

Public notice is actually formal announcement which is published in a newspaper legally. It is


public to know about latest meeting, licensing matter and request for proposal of government.
As papers are significant and confided in types of media, public are regularly distributed in
papers which thusly, consequent have a record of different government activities.

A significant reason found in administrative, state, and local governments is that data about
government exercises must be broadcast with the end goal for individuals to settle on well-
educated choices. Public Notice give this kind of straight forwardness and openness to
residents who need to find out about government activities. Giving public notice gives the
chance to people in general to impact administering bodies and enables the general
population to be a functioning member in a law based society.

History of Public Notice


The history of public notice begins long before the emergence of newspapers. The concept itself has
existed since early civilizations posted notices in public squares. This crude method was eventually
refined with the publication of the first English language newspaper in 1665. This was a court
newspaper called The Oxford Gazette. Later, after being renamed The London Gazette, this official
newspaper carried not only notices from the King’s Court, but also public notices from London

(1947). The American system is modeled closely after the British system. While state governments
had been publishing public notices in newspapers throughout colonial times, it was not long before
the newly-created federal government followed suit. In 1789, the Acts of the First Session of the

publicly available newspapers.

Who Can Issue a Public Notice?

A public notice can be issued by the following authorities:

 State government in the form of a notification in the official Gazette


 District magistrate or officer authorised by him in this behalf
 Chief secretary or his authorised representative
 Commissioner of police or his authorised representative
 Inquiry officer appointed under Section 156 of the Indian Penal Code
 Police officer not below the rank of sub-inspector in charge of a police station or head
constable in charge of a subdivision.

PUBLIC NOTICE
Compulsary Structural Audit of Private Buildings

The owner/occupants of the residential/non residential buildings in Greater


Mumbai Limit are hereby informed that as per the provision of section 353B of the MMC Act
1888, it is obligatory on the part of every owner and occupier of buildings which are in existence
and in use for more than 30 years to have them inspected through qualified Structural Engineer
registered with Municipal Corporation of Greater Mumbai

The said period of 30 years shall be from the date of (i) issue of its completion
certificate by the Corporation, or (ii) issue of permission to occupy a building under section
353A; or (iii) its physical occupation of at least 50 percent of its built-up area, whichever is
earlier. It is also mandatory to get the repair work as suggested by the qualified Structural
Engineer and submit the Completion Certificate alongwith the Structural Fitness Certificate to
MCGM.

All the owners/occupiers of the building shall cause such building to be examined
by such Structural Engineer and to submit the Structural Stability Certificate to the Assistant
Commissioner of the respective wards within a period of 30 days from the date of the publication
of this public notice, the Proforma of which is open for Inspection in the respective ward offices.

If the Structural Engineer recommends any corrective repairs for securing Structural
Stability of the building such corrective repairs shall be carried out by the owner/occupier of the
building to the satisfaction of the Commissioner within a period as suggested by Structural
Engineer in his report not exceeding six months failing which action as per due procedure will be
taken.

The Appeal is issued in general interest of the public at large.

1. No adversed orders shall be passed.


2. No case shall be dismissed in default
3. Bailable and non bailable warrant shall also not be issued
