CANCELLATION OF AGREEMENT TO SELL & PURCHASE

This Deed of Agreement is executed at Delhi, on this 3rd day of May 2022

BETWEEN

Ms. Aarushi Tuli D/o Late Sh. Narinder Paul Nayyar R/o C-2/157, Janak
Puri, New Delhi hereinafter called as Party No.1.

AND

Shri Sudhir Lamba S/o Sh. R.S. Lamba R/o Flat no. 370, Pocket A, Sector-
17, Dwarka, New Delhi - 110075 hereinafter called as Party No. 2.

The expression of Party No.1 & 2, wherever they occur in the body of this
Agreement shall mean and include their respective heirs, legal
representatives, successors, administrators, executors and assigns etc.

Whereas both the parties entered into an Agreement to Sell in respect of Built
up upper ground floor without roof rights out of built up property no.
157, area measuring 210 Sq yard, block A, Sector-8, Dwarka, New Delhi
with one fourth in common parking area at Stilt vide E-stamp certificate
number: IN-DL31949727564594T issued and executed on 02 Oct 2021 of
which the originals were kept with Party No. 2.

That the final date of the agreement for complete payments i.e. 03 rd day of
January 2022 has already passed long ago.

That Party No.1 has already given additional time till the date of execution of
this agreement to Party No.2 for completing the transaction but to no avail and
Party No.2 has not been able to complete the transaction by making full
payments.

That Party No.1 cannot give more time to Party No.2 and still out of goodwill
gesture intends not to forfeit any bayana values given by Party No.2

Now whereas both the parties have mutually agreed to cancel the aforesaid
Agreement to Sell and Party No.1 has agreed to refund the following amount
to Party No.2, on/before 15 Aug 2022.

The following amounts were received by Party No.1 from Party No.2 against
the prospective sale of the aforesaid property:-

1. Rs.10,00,000/- (Rupees Ten Lacs) were received vide cheque no. 726881
dated 03/10/2021 draw on Axis bank.

2. Rs. 40,00,000/- (Rupees Forty Lacs) were received as CASH values.

At the time of sign-up of this cancellation agreement, the following amount


has been returned to Party No. 2

1. Rs.10,00,000/- (Rupees Ten Lacs) CASH

The remaining value of Rs. 40,00,000/- (Rupees Forty Lacs) shall be returned
on/before 15 Aug 2022 in the format received by Party No. 1.

Now upon signing this agreement Party No. 2 or his legal heirs hereby forfeit
all their rights over the said property and shall have no claim/objection on the
said property except the due returnable value from Party No. 1 in the time
stipulated above and Party No. 1 remains the absolute owner of the property
with rights to sell to any other third party.
