ABDUL SHAKooR..r.- Throu gh the instant

constitutional petition, petitioner (Mst. Zeenat

Begum) seeks a direction of this Court to

respondents to issue Pakistani Citizenship

Certificate / Computerized National Identity

Card (CNIC) to her husband (petitioner No'2 /

Muhammad Tahir, an Afghan national).

2. The latter Present ln Court, while

accepting notice on behalf of the respondents,

stated at the bar that petitioner No'2 is not

entitled for issuance of CNIC unless he

obtains the Citizenship Certificate under

Section 10(2) of the Pakistan Citizenship Act

1951, after aPPlYing to the Federal

Government through Secretary Ministry of

3. Heard.

4. Perusal of record would show that

petitioner, without adopting the proper
procedure laid down under the law by

approaching the Ministry of Interior for the

grant of Citizenship Certificate, has directly

invoked the jurisdiction of this Court through

the instant petition, for issuance of the desired

writ.

5. In view of the above, we without

dilating upon the merit of the case, direct the

petitioner No.1 or for that matter the husband

(petitioner No.2) to first approach the

Ministry of interior, for the grant of
Citizenship Certificate of Pakistan, as per laid

down procedure under the law' The Ministry

of Interior is expected to decide the matter of

petitioner in respect of the issue raised in the

petition in case petitioner(s) approached it for

the said purpose, at the earliest, strictly in

e accordance with law. The petitioner No'2

after obtaining the requisite certiftcate would

be entitled for issuance of Pakistani CNIC.

6. The Instant petition stands disposed of

in the above terms.
